Our Pension Arrear 1st case OA2260/2017 was listed in PCAT court 1 sl no 51 today. But could not be heard due to shortage of time. It is now listed for hearing on Monday 29th July in same court 1 sl 42.

DOT:-  Com, Prahlad Rai ,General Secretary All India Retired BSNL Executive’ Welfare Association (AIRBSNLEWA) met with Sh.S.K.Jain ,DDG(Estt.) DOT and apprised him regarding newly elected CHQ body of AIRBSNLEWA in the 3rd AIC held at Vijaywada (AP) ON 17TH July -2019.Director(Estt) was also present there.

a)He requested DDG(Estt.) for the settlement of the Pension Revision of BSNL Pensioners. DDG(Estt.) and  Director(Estt.) informed that recently a letter from DOP&PW has been received wherein some queries have been made w.r.t. delinking of Pension Revision from Pay Revision. They mention that matter is under discussion in DOT and after the approval of the competent authority, reply will be sent to DOP&PW at the earliest. They further mentioned that at present as per existing rule the Pension Revision with Pay Revision only. The decision for delinking of Pension Revision from Pay Revision is to be taken at top level.

(b) Mapping of Pay Scales of 2nd PRC with 7th CPC Pay Scales for the purpose of CGHS Contributions Payment from BSNL:- We extended thanks for issuing the order and now BSNL Pensioners are getting CGHS Card without any difficulty.

(3) Payment of Pension Contribution on Actual Basic Pay instead of Maximum of the Pay:-  DDG(E) informed that DOE has asked some queries regarding Pension Contribution from MTNL and it is awaited from MTNL .He further mentioned that since the Pension Contribution in MTNL is being paid on actual Basic Pay ,thus there will be no refund case as it is in BSNL to refund Rs. 2000/= Crores.  

(4) Recovery from Pension by Pr. CCA Kolkatta against the Pay fixation in E2A Pay Scale on completion of 5 years of service:- Director (Estt.) informed that our Association letter along with the Pr.CCA Kolkatta letter has sent to BSNL for comments but the reply is still awaited. He assured to talk with the concern officer in BSNL for early reply. He assured an early action in this regard.

(5) Revival of BSNL/MTNL:- It is understood that after the GOM meeting, DOT has drafted a Cabinet Note on following points:-

(a) 4 G Spectrum Allocation to BSNL/MTNL through SPV Model. Govt. will bear the spectrum fee.

(b) VRS to BSNL/MTNL employees after the age of 50 years and above. Roll out of age from 60to 58 years w.e.f.1.1.2020.

(c) Monetization of BSNL/MTNL land and assets.

(d) Merger of BSNL/MTNL etc.

19.07.2019:       3RD AIC OF AIRBSNLEWA AT VIJAYAWADA, A.P.

AIRBSNLEWA held its 3rd All India Conference at Hotel Swarna Palace, Vijaywada, Andhra Pradesh on 17th July 2019. 98 delegates from different part of country attended the conference. The conference was graced by the newly elected President and General Secretary  of AIBSNLEA Coms Subhasis Mitra and Shivakumar. Com A K Kaushik and Com Yadav from MTNL was also present at the meeting. The conference started at 10.00Hrs and continued upto 19.00 Hrs. All the important issue of the pensioners were discussed in details and future plan worked out. Com Kishan Singh and Com Prahlad Rai has been elected as President and General Secretary respectively. The details will be uploaded shortly.

07.07.2019:     Latest Development on Pension Revision Issue

Pensioners may recall that on 12 th Feb 2019, CBMPA wrote to DOP&PW an exhaustive letter covering every aspect of our pension revision, requesting them to take some action. The letter is again reproduced below.
 
On 8th March DOP&PW wrote to DOT on our pension revision enclosing our letter and asking comments of DOT on the suggestion given by CBMPA. That letter is also produced below again.
 
Thereafter nothing happened in DOT. Yesterday we came to know that DOT has replied the DOP&PW's letter. On enquiry it was learnt that DOT has sent the complete file to DOP&PW with their remarks.
 
 Today GS, President AIBSNLEA met Director(Estt), DoT and discussed regarding reply to DOP&PW delinking of Pension from Pay revision :
 Director(Estt) informed that the reply to DoP&PW has been sent clarifying these points.
 
a) At present the pension revision is linked with pay revision as per the Rule.
 
b) In case pension is revised to pre-retired 1.1.2017 BSNL Pensioners, then pension will be more than the post retired BSNL Pensioners in case the Pay is not revised, this will create anomaly.
 
c) DoP&PW has to suggest mean and manner under which the pension revision is delinked from pay revision by framing the Rule.
 
He also advised to pursue with DoP&PW for early reply.

 

Therefore now the issue is with DOP&PW. We have to wait for their action.

 02.07.2019:       MEETING WITH RAVI SHANKAR PRASAD JI HON'BLE MOC

Com Gangadhara Rao GS AIBSNLPWA and his teammates along with Coms M K Bagchi and S S Nanda of RTOWA MTNL Delhi had a meeting with Hon'ble MOC on pension revision issue. This meeting took place due to extra ordinary efforts of Com Gangadhara Rao and others with the help of Sh. Prahlad Joshi Hon'ble Minister of Parliamentary Affairs and 4th time MP from Hubli. Karnataka.

As per the report received, the Minister was angry at the beginning on the recent status of BSNL/MTNL and expressed his annoyance in strong words. But due to calculative approach of Com Gopalkrishnan, who played the main role IN discussion, minister calmed down and heard the problems of pensioners. At some point of time he even asked some questions for which proper reply was given by the delegation. At the end he assured the delegation and remarked "I WILL TAKE CARE OF IT".

29.05.2019:         Well organized General Body meeting of Lucknow Dist.UP (East) Circle
 
Well organized General body meeting of *“ALL INDIA RETIRED BSNL EXECUTIVES’ WELFARE ASSOCIATION”* Lucknow District UP(East) Circle was held on 25th May 2019 at *“HOTEL SILVETE”* Lucknow in the presence of Com Pallab Bose Circle Secretary & CHQ Org. Secy Com D.N.Verma . Hundreds of BSNL pensioners from Lucknow, Varanasi, Hardoi district attended the meeting, which lasted for more than 4 hours. 
The meeting started with opening remarks from Com R.J.Pandey Lucknow Dist. President and he welcomed all members of Association. 
Com Pallab Bose Circle Secretary apprised the members about “AIRBSNLEWA” being the only association which is seriously working for the welfare of rtd BSNL executives for a very long time.  He expressed his concerns for BSNL’s current financial situation.
On behalf of AIRBSNLEWA UP (East) Circle, we conveyed our heartfelt gratitude to Com Prahalad Rai GS AIBSNLEA, Com Kishan Singh GS & CHQ for their continued efforts in the  pension revision issue.
All present developments related to pensioners were explained in detail. He also discussed other critical issues such as the 3rd PRC, Medical issues, CGHS scheme, KYP issue in CCA and explained the actions being taken by AIRBSNLEWA. 
Circle Secretary conveyed his special gratitude to all participating members who spared their time to attend the meeting on a hot summer day when temperatures rose to 44 degree Celsius.  
Com Bose CS apprised the house that next court case reg 78.2% arrear is 12th July and 26th July 2019 and our next AIC  will be held on 17th July 2019 instead of 12th April 2019 at Vijayawada (AP).
Meeting was addressed by Com C.S.Verma Circle Finance Secy. Com A.K.Tripathi ACS, Com R.J.Pandey. Lucknow dist President Com S.C.Yadav DS Lucknow.
05 new members joined our association in this meeting including Varanasi comrades.

24.05.2019:                COURT CASE ON PENSION ARREARS      

Our Pension Arrear 1st case (OA 2260/2017) was listed for hearing on 24-4-2019 in PCAT New Delhi. But in the causelist it was not allotted to any bench that day and was mentioned as later on. Subsequently on 17-5-2019, it was listed in court no 4 (single bench) just for adjournment. Next date fixed as 26-7-2019.*

21.04.2019:   For BSNL pensioners, It is the right time to migrate to CGHS
 
BSNL pensioners are in absolute trouble due to fund crunch in BSNL. Their all kinds of medical claims are stucked up whether it is with or without voucher outdoor claims or hospital Indoor claims. Although medical claims of serving employees are cleared upto date but for pensioners the claims which are entered in SAP are cleared upto January. But the fact is most of the claims of pensioners are not processed at all by the pay offices on the pretext of non availability of funds and therefore not entered in SAP at all.
 
Present CMD is retiring in June 2019 and next CMD will be the present CMD of MTNL who is from accounts side and was previously Dir Fin MTNL. Therefore it may not be wrong to anticipate that on his joining, he may like to introduce present medical policy of MTNL in BSNLalso to save some expenditure on this account. Hence it is important that we should know what is the medical policy of  MTNL at present for Pensioners.
 
(1)  MTNL Group Health Insurance Scheme for pensioners is named as CGEIS which is quite different from CGHS and present policy of BSNL. Only treatment under hospitalization is covered under CGEIS. If husband and wife both are alive, maximum entitlement is Rs 1,50, 000/- cashless. If one of them only is alive, maximum entitlement is Rs 1,00,000/- cashless. If the treatment cost is more than Rs 1,50,000/- or Rs 1,00,000/- whatever may be the case, for the amount exceeding the insured amount, it will be paid from the floater fund after certification by the concerned TPA. This payment is outside of insurance obligation and this will be paid by MTNL. This is not cashless. The beneficiary will have to pay on his own before being discharged from hospital. MTNL will reimburse the payment after sanction by the competent authority. Floater fund upto  Rs 1,50,000/- ( beyond the insured amount) is sanctioned by ED, Delhi and ED, Mumbai as per their respective jurisdiction. Floater fund beyond that, for another lot of Rs 1,50,000/- or less , the sanctioning authority is CMD, MTNL. Total maximum amount one can expect is 1,50,000/- + 1,50,000/-+1,50,000/- = 4,50,000/-.under CGEIS Scheme.
Please note that any amount to be paid from floater fund is restricted to 90% I.e., if 1,00,000/- needs to be paid from floater fund only 90,000/- will be paid. The present backlog of reimbursement payment from floater fund is for the years : 2013 -2014 and onwards.
 
(2) OPD entitlement is maximum upto 50% of Basic Pay at the time of retirement. This is applicable for those who retired upto the year 2008. Those who retired or will retire in any year after 2008, their entitlement will also be maximum up 50% of the Basic as in 2008. Further, this amount will be reduced by way of deduction of Rs 6000/-so as to pay premium for CGEIS. To claim OPD amount, one has to submit bill enclosing Cash Memos and Receipt of doctor’s fees etc.
 
Thus under the prevailing situation, it is a better option for BSNL pensioners to migrate to CGHS. For lifetime plastic cards. Those who retired with SDE/AO scale has to pay onetime around Rs 78000 and Rs 1,20,000 for higher pay scales. This amount is for the whole family and individual cards will be issued to each family members. As per present order this amount is fully reimbursable by BSNL. But presently MTNL is reimbursing only 50% of deposited amount. Those who are living outside CGHS area may either opt for fixed medical allowance of ₹1000 per month or may get registered with nearby Wellness Center. All indoor treatment is cashless in empanelled hospitals. Pensioners may go through the FAQ posted below or visit www.cghs.nic.in for more information.

Finally whether to opt for CGHS or not is always an individual decision. My effort is to enlighten the pensioners with the present situation. -amit gupta.

  17.03.2019:        Marvelous General Body meeting of UP (East) Circle* 
 
Marvelous and well organized *'Pre-HOLI MILAN'* General body meeting of “ALL INDIA RETIRED BSNL EXECUTIVES’ WELFARE ASSOCIATION” UP(East) Circle was held on 16th March 2019 at *“HOTEL SILVETE”* Lucknow in presence of our AGS Com. Pradip Goyel . Hundreds of BSNL pensioners from Lucknow, Raiberely, Hardoi district has attended the meeting which lasted for more than Four hours. 
Meeting started with the opening remark of Com *S.M.Abbas* Circle President and he welcomed all members of Association. 
*Com Pallab Bose* Circle Secretary apprised the members that “AIRBSNLEWA” is the only Association who had sincerely persued the 60:40 pensions sharing with BSNL, and 78.2% IDA merger issues of retired executives of BSNL at CHQ level. 
*He told that only our Association AIRBSNLEWA had initially raised 60:40 pensions sharing issues. He mentioned that today many associations are claiming the credit of achieving the demands but in reality they did nothing about it. After continuous struggle of AIBSNLEA and AIRBSNLEWA, the 60:40 sharing provision from pension Rule has also been withdrawn after great efforts. It has strengthened the way for future pension revision of BSNL Pensioners.* Due to 60:40 decision, today BSNL Pensioners are getting their pension in due date while working BSNL employees are not getting their  salaries in time.
It is a great achievement of AIBSNLEA & AIRBSNLEWA. 
*On behalf of AIRBSNLEWA UP (East) Circle we conveyed our gratitude to Com Prahalad Rai GS AIBSNLEA, Com Kishan Singh GS & CHQ specially Com Amit Gupta AGS for his foresightedness and bringing into light the 60:40 cabinet decision through series of RTIs.*
Com Pallab Bose CS  addressed the house. All present developments related to pensioners were explained in detail by Com Bose. He apprised the house with details the collective efforts of AIBSNLEA and AIRBSNLEWA in settling the burning problems of BSNL Pensioners and assured the members that AIRBSNLEWA CHQ will take appropriate action for Pension Revision at the correct moment. 
He also clarified other issues like 3rd PRC, Medical issues , CGHS scheme, KYP issue in CCA, and explained the actions being taken by AIRBSNLEWA. 
Circle Secretary conveyed his thanks to all participants who have spared their time to attend the meeting.

The General body meeting ended with a vote of thanks by Circle President. 
In second session a Work shop on “Customer Financial Awareness” conducted by ICICI Securities & HDFC Mutual Fund. Most of the pensioners participated actively. There was a nice interactive session and ICICI Financial experts answered each and every question raise by our pensioners & cleared all doubts related to safe investment and Income tax. 
At the end of session all members of AIRBSNLEWA UP (E) had a delicious snacks & Tea with CHQ and Circle Leaders, at  “Hotel Silvete” Lucknow.

27.02.2019:     DEDUCTIONS AT THE TIME OF RETIREMENT     
Supreme Court of India in a landmark judgment declared any deductions at the time of retirement as unlawful. DOP&T has also subsequently issued the executive order. In order to know the status in DOT and BSNL two RTI applications are submitted by our AGS in the interest of all pensioners. Let us wait for the reply  and then further course of action will be decided.

18.02.2019:    THREE DAYS STRIKE BEGINS IN BSNL   

It is a do or die situation - AUAB calls on the employees to organise the 3 strike massively.
The AUAB held it's crucial meeting today. General Secretaries / senior leaders of BSNLEU, NFTE,
AIBSNLEA, SNEA, AIGETOA, BSNL MS, ATM, TEPU and BSNL OA participated. The meeting reviewed the preparations going on throughout the country for the 3 day strike. All the General Secretaries gave their reports on the preparations. It is very encouraging to note that, excellent preparations are going on. Especially, the momentum has picked up tremendously in the last 2 days.

After considering all the factors, the meeting unanimously decided to go ahead with the strike. The strike starts from midnight (00:00 hrs.) today. If any clarification is required, comrades are requested to contact their respective General Secretaries.

Charter of demands for the 3 day strike from 18.02.2019>>>>>

1. Implementation of 3rd Pay Revision with 15% fitment.

2. Allotment of 4G spectrum to BSNL, as per the proposals submitted by the BSNL Management.

3. Implement assurance of the Hon'ble Minister of State for Communications for delinking pension revision from pay revision. Revise pension of BSNL retirees w.e.f. 01.01.2017.

4. Payment of pension contribution by BSNL as per the government rule.

5. Settlement of the left out issues of the 2nd Pay Revision Committee.

6. a) Approval for BSNL's Land Management Policy without any delay.
6. b) Expeditiously complete the mutation and the process of transferring of all assets to BSNL, as per the Cabinet decision taken on the eve of the formation of BSNL.

7. (a) Ensure financial viability of BSNL, as per the decision taken by the Group of Ministers, at the time of formation of BSNL.
7. (b) Issue letter of comfort for BSNL's proposals for taking bank loans.
7. (c) Expeditiously fill up all vacant post of BSNL Board of Directors.

8. Scrap BSNL's outsourcing for the operation and maintenance of it's mobile towers.

31.01.2019:  AUAB meeting with Additional Secretary (T), DOT and its internal meeting tomorrow : In continuation to   the discussion that the AUAB had with the Additional Secretary (Telecom) yesterday, further discussions took place between the AUAB and the CMD BSNL yesterday, as well as today. The representatives of the AUAB met Shri Anshu Prakash, Additional Secretary (Telecom) today afternoon. To their surprise, the Additional Secretary (Telecom) told the AUAB representatives today that, even giving the 5% fitment would be difficult. The AUAB did not accept the 5% fitment offer made yesterday. In this backdrop, the AUAB will be holding it's meeting at 11:30 am tomorrow. The meeting will take appropriate decision on the charter of demands. The Executives and Non-Executives are requested to keep ready for struggle.
30.01.2019:  AUAB meeting with CMD (BSNL): GS AIBSNLEA, GS SNEA,GS BSNLEU and GS NFTE  met CMD,BSNL  in the presence  of Director (HR) BSNL Board  as per the advice of AST to discuss the viable proposal for pay revision : AUAB  leaders demanded 15% fitment benefit for pay revision. Regarding Pension revision less than 15% fitment benefit can not be accepted by AUAB since the pension contribution of the BSNL pensioners was paid BSNL to DOT as per rule. After detailed discussions CMD BSNL mentioned that tomorrow morning 11.00 Hrs; he will be giving a presentation to Secy (T) on revival plan of BSNL including 4G spectrum allocation, monetision of non core land of BSNL, pay revision, payment of pension contribution on actual basic pay and pension revision wherein views of AUAB will also be presented.
30.01.2019:  Meeting between AUAB and the Additional Secretary, Telecom: A meeting was held today between the AUAB and Shri Anshu Prakash, Additional Secretary(Telecom). AUAB representatives in the Committee for Periodic Interaction, Com.P.Abhimanyu, GS, BSNLEU & Convenor, AUAB, Com.Chandeshwar Singh, CS, NFTE & Chairman, AUAB, Com.Prahlad Rai, GS, AIBSNLEA, and Com.K.Sebastin, GS, SNEA participated. From the DoT side, Shri R.K. Khandelwal, Joint Secretary(Admn.) Shri S.K. Jain, DDG (Estt.), Shri Rajeev Kumar, DDG (Budget), also participated. Ms. Sujata T. Ray, Director (HR) and Shri A.M. Gupta, GM(SR), represented BSNL. Detailed discussion took place on the 3rd Pay Revision, 4G spectrum, Payment of Pension Contribution on actual basic pay and Pension Revision issues. As regards the 3rd Pay Revision issue, it was suggested from the DoT side that, Pay Revision with 5% fitment could be given. If the AUAB accepted this, then this issue would be placed for the approval of the Digital Commission meeting, to be held on 05/02/2019, and that thereafter it would go for the approval of the Cabinet, said the DoT side. The AUAB stated that 5% fitment is very low and that they could not accept it. Thereafter, the AST suggested that the AUAB representatives could discuss the issue with the CMD BSNL and could come back to him within a day or two. 

Regarding 4G spectrum allocation to BSNL, AST mentioned that the queries made by DOE & Niti Aayog have been replied by BSNL and on that basis the matter will be discussed in the Digital Commission Meeting which is scheduled to be held on 5th Feb., 2019, along with 4G spectrum allocation proposal, the revival plan of BSNL including monetization of BSNL non-core land will also be discussed. After approval of Digital Commission, it will be taken up in the Cabinet for approval.

Replies received from BSNL for the payment of pension contribution on actual basic pay will be send to DoE after the clearance of Internal Finance of DoT.

The issue of pension revision, delinking from pay revision, AUAB representatives demanded 15% fitment since the pension contribution has already been paid to DoT by BSNL.

Regarding anomaly on pension revision for the BSNL pensioners retiring after 01/01/2017, AST directed DDG(Estt.) to have separate discussion with the leaders of AUAB to prepare the formula for pension revision. Accordingly AUAB leaders had separate discussion with DDG(Estt.) on pension revision & decided to submit the formula for pension revision of post retiring 01/01/2017 BSNL pensioners shortly.

24.01.2019:    Judgement of Pension Arrear Case filed in Shimla CAT has been 
                                       pronounced yesterday 23-1-09 in favour of the applicants
 
29 pensioners all retired between 1-1-07 and 9-6-13 filed an OA at Shimla CAT asking Pay Arrears from 1-1-2007 to 9-6-2013 and arrears of Retrial Benefits like DCRG, Commutation and leave encashment on revised notional Pay as per 78.2 IDA merged.
✔Court has allowed the arrears of Retrial Benefits as prayed that is Commutation, DCRG, and leave encashment as per revised notional pay.
✔For pay arrears from 1-1-07 to 9-6-13 the court observed that if it is paid to serving employees then it should also be paid.
 ✔For pension arrears from date of retirement to 9-6-13 has not specifically mentioned by the court as perhaps it was not mentioned in the prayer itself.

24.01.2019:  Court Case for Pension Arrears*
Our pension arrears 1st case OA 2260/2017 came up for hearing yesrerdat 23-1-2019 in P.CAT ND alongwith a case filed by other Association OA 2853/18.
Our Advocate pleaded nicely & logically that in our case pleadings are completed and it is for final hearing but OA 2853/18 pleadings are not yet completed hence our case cannot be linked and may please be delinked from 2853/18. DOT Advocate replied that their counter reply is same as for 2260.
After hearing both parties Judge ordered that OA 2853 was was ordered for hearing with OA 2260/17 by Double       Bench court hence de linking is also to be done by DB court. Case is listed for hearing on 05/02/2019.
24.01.2019:  General Body meeting of AIRBSNLEWA Lucknow district
A well organized   General body meeting  of  “ALL INDIA RETIRED BSNL EXECUTIVES’ WELFARE ASSOCIATION” Lucknow dist. UP(East)  Circle  was held on *19th Jan 2019*  at Conference Hall of "Door Sanchar Sadan" Laplace  Lucknow.   Hundreds of BSNL pensioners  from Lucknow district  has attended the meeting. 
Meeting started with the opening remark of *Com S.M.Abbas  Circle President* and he welcomed our CHQ leaders & all members of Association.

17.01.2019:  AUAB WOULD BE COMPELLED TO TAKE RECOURSE TO STRIKE- THE AUAB CAUTIONS THE ADDL SECRETARY DOT.       

As per the decision taken in the AUAB meeting held yesterday, representatives of the AUAB, viz., Com. Com.P.Abhimanyu, GS, BSNLEU & Convenor, Com.Chandeshwar Singh, GS, NFTE & Chairman, Com. K. Sebastin, GS, SNEA and Com. Prahlad Rai, GS, AIBSNLEA, met Shri Anshu Prakash, Additional Secretary, Telecom, today. The representatives conveyed him the decision of the AUAB meeting held yesterday. They told the Additional Secretary, Telecom, in no uncertain terms that, the employees are unhappy that not much progress is made in the 3rd Pay Revision issue. They also informed him that the AUAB will be compelled to give call for the strike, since not much time is left for the Parliament elections. The Additional Secretary, Telecom, informed that he would hold a meeting with the AUAB next week in which crucial discussion would be held in respect of the issue of 3rd Pay Revision.

17.01.2019:  AUAB writes to the Hon'ble Minister of State for Communications - Informs strike will become unavoidable due to the delay in the settlement of the 3rd Pay Revision........<<<<Click here for letter>>>>

As per the decision taken in meeting held yesterday, letter has been written to Shri Manoj Sinha, Hon'ble Minister of State for Communications, by the AUAB, communicating it's unhappiness over the delay in the settlement of the 3rd Pay Revision issues. In the letter, the AUAB has stated that it would be compelled to go on strike, if no positive outcome comes on the issue. The letter was delivered by hand to the Private Secretary to the Hon'ble Minister of State for Communications today, by the AUAB representatives.
17.01.2019:  Time is running out and strike will become unavoidable - AUAB meeting decides to inform the government........
A meeting of the AUAB was held yesterday. Com.Chandeshwar Singh, GS, NFTE & Chairman, AUAB, presided over the meeting. Com.P.Abhimanyu, GS, BSNLEU & Convener, AUAB, welcomed everyone and presented the agenda item to be discussed in the meeting. General Secretaries / Representatives of BSNLEU, NFTE, SNEA, AIBSNLEA, AIGETOA, BSNL MS and BSNL OA, were present in the meeting. The meeting reviewed the progress in the settlement of the demands of the AUAB. The meeting assessed that reasonable progress is made on the demands of 4G spectrum and payment of pension contribution on actual basic pay.

However, the meeting came to the conclusion that, no substantial progress has come on the issues of 3rd Pay Revision and Pension Revision. The meeting also came to the assessment that the time available for the settlement of demands is only upto February, 2019 and that the announcement for Parliament elections may come any time in March, 2019. Once the elections are announced, the Code of Discipline will also come into effect and no demand could be settled thereafter.

In view of the above reasons, the meeting decided to convey to the government that, the AUAB would be compelled to give call for the strike. The meeting also decided that the AUAB should meet the Additional Secretary, Telecom, in person, and communicate this.

14.01.2019:   Meeting of the Committee for Periodic Interaction (Institutional Mechanism)  and meeting between the AUAB and the Addl.Secretary(T), DoT:

A meeting of the Committee for Periodic Interaction (Institutional Mechanism) was held in the Sanchar Bhawan yesterday the 10-01-2019. From the AUAB, Com.P.Abhimanyu, GS, BSNLEU & Convener, Com. Chandeswar Singh, GS, NFTE & Chairman, Com.K.Sebastin, GS, SNEA and Com.Prahlad Rai, GS, AIBSNLEA participated. Shri.R.K.Kandelwal, Joint Secretary(Admn.) - Convener Committee, Shri S.K.Jain, DDG(Estt.), Sh. Rajeev Kumar DDG(Budget), Sh. Sanjay Agarwal, Director(Estt.), Sh. Pawan Gupta, Director(PSU), from DoT side and Ms.Sujata Ray, Director(HR) and ShriA.M.Gupta, GM(SR) from BSNL side were present in the meeting.
It may be remembered that the AUAB strongly demanded that this Committee should be chaired by the Addl. Secretary(T), and that no result would be achieved if it is presided over by the Joint Secretary level officer. Whatever we predicted, has proved to be correct. The Joint Secretary(Admn.) and the DDG(Estt.) were not able to give any worthwhile information about the status of the issues, viz., 3rd Pay Revision, Allotment of 4G spectrum, Payment of Pension Contribution on actual basic pay and Pension Revision. Both the officers are completely negative on our issues. No worth mentioning outcome came from this meeting.
Hence, after this meeting, the AUAB leaders went and met Shri Anshu Prakash, Addl. Secretary(T) and expressed their total dissatisfaction about the outcome of the meeting. Shri R.K.Kandelwal, Joint Secretary (Admn.), Ms. Sujata Ray, Director (HR) and Shri A.M.Gupta, GM(SR) were also present. Thereafter, full fledged discussion took place with the Addl.Secretary(T).

3rd Pay Revision :
Detailed discussion took place. The Addl. Secretary(T) told that the DoT is ready to settle the 3rd Pay Revision. But, he categorically told that it will be very difficult for the DoT to get the approval of the Cabinet for 15% fitment, since BSNL’s financial position does not allow payment of such high salary. He requested the AUAB and the BSNL Management to discuss and take viable decision and bring to DoT immediately so that this can be taken in next Digital Commission scheduled to be held in the first week of Feb., 2019.

4G spectrum to BSNL:
As regards the allotment of 4G spectrum to BSNL, the Addl. Secretary(T) confidently told that the DoT would do it’s best to get the Cabinet approval for the allotment of 4G spectrum to BSNL. He expressed hope that the Digital Commission meeting to be held in the 1st week of February would give the necessary clearance, after which it would go for the Cabinet approval.

Payment of Pension Contribution on actual basic pay:
As regards the issue of Payment of Pension Contribution on actual basic pay, the Addl. Secretary(T) told that the Department of Expenditure (DoE) has sought certain details and that the DoT has already written to the BSNL in this regard. The Director (HR) replied that within 1 or 2 days, BSNL would send a reply to the DoT. The Addl. Secretary(T) assured that thereafter prompt action would be taken to get the approval of the DoE.

Pension Revision:
On this issue, the AUAB representatives expressed their dissatisfaction and demanded that prompt action should be taken by the DoT. Thereafter, detailed discussion took place with regards to the fitment, etc. Finally, the Addl. Secretary(T) requested Director(HR) to provide with copies of relevant documents like Govt. orders related to the earlier pension revision documents to the employees, etc.
 

Left out items of 2nd PRC :At the end of the meeting, the Addl. Secretary(T), DoT suggested that the AUAB representatives could again meet him next week. In addition to that left out items of 2nd PRC, Director(HR) BSNL informed that the BSNL Management is taking necessary action to enhance the superannuation benefits from 5% to 8%. 

14.01.2019:    MEETING WITH CGM CTD ON MEDICAL ISSUE
Circle Secretary West Bengal Met CGM CTD and GM HR CTD and discussed about the ongoing problem of pensioners on settlement of their medical claims. One ;etter handed over to them. Both of them assured positive action. <<READ>>  
14.01.2019:   G B MEETING OF NASHIK BRANCH 
The G. B. Meeting of our Nashik branch was held  on 27/12/2018 under the president ship of com Y. E. Saindane.  The meeting was started with observing two minutes silence to pay homage to departed soul late  S. N. Kulkarni. There was felicitation of Com. M. M. Lele for completion of 75 years of age. Circle Organiser com S. S. Dhangar briefed regarding current issue of de-linking and CGHS medical scheme. The dist Sec com M. L. Deore briefed the issue of accepting either 7th CPC or 3rd PRC. The house  unanimously decided to go for 7 th CPC. DS also briefed regarding the issue of pension arrears court case and reason for its delay. The issue of delay for medical bills payment was discussed. The total 14 delegates were decided to attend the 3rd All India conference at Vijayawada. The sutrasanchalan was done by com A. S. OA 1812/2018 alongwith MA 2021/2018 came up for hearing on 07-01-2019 at court no 2 of PCAT New Delhi. DOT advocate asked two more weeks to reply and BSNL advocate told that he has not received the notice. Next date of hearing is 05-04-2019.

Hyderabad Branch of AP&TS cir has conducted it's GB meeting ON 03-01-2019. More than 150 members have attended and the hall was jampacked .Com Jayram AGS addressed the meet and updated on the present status of court cases, 
pension delinking, forth coming aic ,launch of SAMPANN and organisational issues. 
GB has felicitated 18 com's on their completion of 75 years and it also elected delegates for the aic .
08.01.2019:  AIRBSNLEWA OPENS ITS FIRST BRANCH IN KARNATAKA         

The meeting of Retired Executives’ of AIBSNLEA was arranged in Elders Citizen Council Hall, J.L.Puram, Mysore on 17-12-2018 at 14.00 hrs. Around 15-20 members were present in the meeting and Com Prahlad Rai, General Secretary, AIBSNLEA CHQ and chief mentor AIRBSNLEWA addressed the house and appealed the retired members to form an association. The first branch of AIRBSNLEWA, Mysore TD in Karnataka Circle has been formed with the following office bearers of the association in the presence of General Secretary, AIBSNLEA CHQ New-Delhi.

 18.12.2018:     PENSION REVISION OF BSNL PENSIONERS AS PER 7 th CPC
                                         - A PERMANENT SOLUTION TO PENSION REVISION PROBLEM  

Presently a serious discussion is going on amongst the pensioners that after de-linking of pension revision from pay revision, which is more beneficial 7th CPC recommendation or 3rd PRC recommendation. We request all pensioners to go through the following points and decide for themselves which is beneficial.
 
1) It is being told that CPC recommendations are only for those who retired with CDA pay scales, then how out of total 11 CPC recommendations, 9 are implemented for BSNL IDA pensioners also ? They are Gratuity, Leave encashment, Pension Calculation, Minimum service for full pension, Commutation table, Enhancement of pension with age etc. These 9 recommendation of CPCs are traditionally being implemented for BSNL IDA pensioners on their IDA pay/pension only. Then what is the difficulty if the CPC recommendation on pension revision i.e. 32% fitment on basic pension is implemented for BSNL pensioners also on their IDA pension as on 1-1-2017?
 
2) If pension is revised as per 7th cpc then multiplication factor will be 2.515 and if 3rd prc 15% is applied then MF will be 2.524 i.e .009 more. Is it not wise at this stage on the part of the pensioners to accept CPC even by suffering .009 loss in MF for future security and stability on pension revision on 2027, 2037, 2047 and so on? Otherwise for every 10 years pensioners have to struggle for the pension revision. In 2007 the struggle was lasted for 4 years, now in 2017 it is already 2 years, and in future also the same instability will continue.
 
3) When all have agreed for de-linking of pension revision from pay revision. then how it is logical in demanding one of the pay revision formula of PRC for pension revision. Pl note that PRC is having three recommendation only for pay revision for PSUs 15%,10%,&5% and has no recommendation on pension or on pension revision. After de-linking on what logic Govt. will follow only 15% pay revision for our pension revision. Instead is it not more logical that after de-linking the pension revision recommendation of 7th CPC is applied for IDA pension revision of BSNL pensioners, the way other CPC recommendations are implemented for them on not only their IDA pay but IDA DA also.
 
4) If we decide to follow the principle of PRC, who doesn't have any recommendations on pension or its revision, then kindly visualize a situation in 2037 when no absorbee employees will be their in BSNL. If we do not come out of PRC for pension revision purpose, it will be extremely difficult situation then.

                        DOT  TAKES A DECISION TO DELINK THE PENSION REVISION OF BSNL PENSIONERS FROM PAY REVISION OF EMPLOYEES AND REVISE THE PENSION AS PER 7TH CPC ORDER.
CONGRATULATIONS: Here is the good news for which all the BSNL pensioners are waiting for. It is reliably learnt that DOT has taken a policy decision to delink the pension revision of BSNL Pensioners from Pay Revision of BSNL Employees. They have also decided to revise the pension as per 7th CPC recommendation. The proposal is already under process with DOP&PW. More clear picture is expected today after meeting with MOSC which is scheduled at 10-00 hrs,

AIRBSNLEWA has been striving hard since last 2 years to achieve this vital issue for BSNL Pensioners. We have written number of letters to Prime Minister, Minister of Communication, Secretary DOT and other officers demanding our pension revision as per 7th CPC and DOP&PW order dated 4th August 2016 . Number of RTI applications were filed with DOT and DOP&PW asking applicability of para 2 and para 7a of the said order dated 4th August 2016 for BSNL/MTNL pensioners. All such activities has been uploaded in our website from time to time.

Recently we have submitted a letter to MOC and DOT with detailed analysis of 7th CPC recommendations for pensioners and claimed that when all the recommendations except pension revision and minimum pension has already been implemented for BSNL pensioners, why pension revision also will not be done as per 7th CPC recommendations, We have submitted memorandum to at least six  MPs with all such details. We are grateful that the MPs also in turn has realized our demand and wrote to the MOSC recommending our pension revision as per 7th CPC. This has also been uploaded in our website from time to time.

The recently formed Committee of BSNL/MTNL Pensioners Associations has also submitted a joint letter to Secretary DOT on the same line and organised hunger strike on 22nd Nov at New Delhi and many other places. This initiative was taken mainly by AIBSNLPWA and its GS Com P Gangadhara Rao and other eminent leaders. RTOWA (Pensioner Association of MTNL) is also very much after this demand. We sincerely expect that once it is finally settled for BSNL the same will also be applied to MTNL pensioners also.

 We are also thankful to AUAB. But for their strike notice the issue could have been dragged by DOT for years. Their strike notice has certainly added to the pressure on DOT in taking this vital policy decision.

Finally we are extremely grateful to AIBSNLEA and its GS Com Prahlad Rai who is also our Chief Mentor. They have all along supported this vital issue and made constant negotiations.

Now let us wait for the final order. We have uploaded this Flash news with all details, just to recapitulate the actions taken so far.
 

02.12.2018:   Secy(T), DoT Meeting with AUAB held today : Talks between the AUAB and the Secretary (T), DoT were held today the 02nd Dec., 2018. Improvements are there in the issues of 4G Spectrum, Pension Revision and pension contribution. However, dead lock in prevailing in the issue of 3rd Pay Revision. With a view to ensure discussion with the Hon'ble MOS(C) on this issue, the AUAB decides to defer the strike for one week. If fruitful outcome does not come in the meeting with the Hon'ble MOS(C), the strike will start from 00.00 Hrs.  on 10th Dec., 2018.

CMD BSNL talk with AUAB Failed: Today, A/N 12.00 Hrs. CMD BSNL called all the General Secretaries for  Discussion on the AUAB demands and ongoing Agitation. CMD BSNL and Director(HR) further apprised the representatives regarding the developments taking place in DoT with respect to the demands AUAB and Indefinite Strike with effect from 3rd December 2018. CMD appealed that since the DoT Administration is now taking steps for the settlement of some of the demands, AUAB should withdraw the agitation. After detailed discussions AUAB Leaders expressed their serious concern against not honouring the Commitments given by the Hon'ble MOSC (I/C) to AUAB Leaders in the meeting held on 24.02.2018, after a lapse of 9 months and the Secretary (T) meeting held on 2.11.2018. AUAB Leaders categorically told the CMD, if the competent authority should give written assurance for the settlement of demands in bound manner, thereafter only AUAB can review its decision.

In view of this, it is requested to all the Circle/ District Secretaries to ensure for the successful implementation of the indefinite strike

27.11.2018:   OUR PENSION ARREAR CASE IS FACING MOST UNWANTED INTRUSION  
 
We are sorry to inform that the Pension Arrear Case (OA/2260/2017), which was listed for final hearing on 26-11-2018 is now facing most unexpected and unwanted intrusion from another case filed by the Armchair Association. After being denied by Supreme Court and Delhi High Court finally that association has ultimately filed a petition (OA 2853/2018) in PCAT ND. On 22-10-2018 that case came up for admission hearing. During hearing it was pointed out to the Judge that a similar case (our OA/2260/2017) is already pending before PCAT and the Judge while admitting the case ordered it to be listed next along with our case. <<view the order>>

This came to our notice and we took necessary precautions. On 24th Nov. we find that in the list of proceedings for 26th Nov. only our case is listed. There was no mention of their case (OA 2853/2018) in the list. But surprisingly during hearing the advocate of DOT has pointed out and placed a copy of the order dated 22-10-18 before the court. Court also took a cognizance of the order and posted our case for next hearing on 23 Jan. 2019. Unfortunately our regular lawyer could not attend the case and send a proxy advocate to attend as she was engaged in Supreme Court for some other case. Now we are waiting for exact text of the court order dated 26-11-2018 for deciding our future course of action.

As mentioned in the PCAT mischievously, The OA filed by the Armchair people is not similar to our case. They have challenged both the DOT orders dated 10-06-2013 and 18-07-2016 while in our case we asked only a modification of DOT order dated 18-07-2016. They have asked pay arrears also from 1-1-2007 along with pension arrears but we prayed only for pension arrears. We made only DOT and BSNL respondents but their case have 5 respondents, DOT, BSNL, DOP&PW, DPE & DOE. The argument and justification of their OA and our OA is also completely different. Moreover Our OA has completed the reply and rejoinder episodes, where as there OA is just admitted.

As is apparent from above, according to our view their OA will consume more time as now 5 respondents have to submit their reply then rejoinders have to be submitted for all five replies, This itself will take years. Then as because pay arrears also have been prayed which is to be paid by BSNL and for which the existing serving employees are also eligible, it will not be easy for the court to decide the issue and may invite more arguments which will again consume more time. Whereas our case now is now listed for final hearing that is only final arguments and Judgment is pending. Incidentally in this OA they have 118 applicants in which pensioners retired after 10-06-2013 is also there only for pay arrears <<List>>. The advocate of DOT, who was sure of loosing our OA, now deliberately wanted to tag it with their case so that our case also gets stuck up with them and face uncertainty.

It is irony of fate that once they called our case "The Height of Absurdity" and now are desperate to tag their case with our "Absurd" case and thereby spoil our case along with them, But we shall ensure that their game plan is nipped in the bud.

27.11.2018:   FORMATION OF COMMITTEE OF BSNL/MTNL PENSIONERS ASSOCIATIONS    
On 21-11-2018 a meeting of the pensioners associations of BSNL and MTNL was held at Room No 556 Kidwai Bhavan New Delhi. Representatives of AIBSNLPWA, AIRBSNLEWA and  RTOWA MTNL-ND and other two Associations of MTNL were present. Specific request were made to AIBDPA and BDPA to be present in the meeting but they refused to join for their own reasons. In the meeting
COMMITTEE OF BSNL/MTNL PENSIONERS ASSOCIATIONS was formed. Com Gangadhara Rao GS AIBSNLPWA is the convener of the committee. At present the committee will deal only the pension revision issue of BSNL/MTNL pensioners as per 7th CPC recommendation. <<<Minutes>>. 27.11.2018:    Special General Body meeting of UP (East) Circle:

Marvelous  and well organized  Special General body meeting  of  “ALL INDIA RETIRED BSNL EXECUTIVES’ WELFARE ASSOCIATION” UP(East)  Circle  was held on 23rd November 2018  at Committee Hall , Telecom Officers Colony Chandralok  Lucknow  in presence of our chief guest of the day Com Amit Gupta AGS, Com Pradip Goyel AGS & Com D.N.Verma CHQ Org. Secy. Hundreds of BSNL pensioners  from Lucknow district , Faizabad & Hardoi has attended the meeting which lasted for more than 05 hours. The Committee Hall was jam packed.

Two minutes silence was observed to pay homage to late Comrade A.K.Singh than Circle Secretary AIBSNLEA UP(East) Circle.

Meeting started with the opening remark of Com S.M.Abbas  Circle President and he welcomed our CHQ leaders, Guest & Mentor Com A.K.Verma Circle Secretary AIBSNLEA UP(East) Circle & all members of Association.

Com Pallab Bose Circle Secretary apprised the members that “AIRBSNLEWA” is the only Association who had sincerely pursued the 60:40 pensions sharing with BSNL, and 78.2% IDA merger issues of retired executives of BSNL at CHQ level. He told that only our Association AIRBSNLEWA had initially raised 60:40 pensions sharing issues.

After continuous struggle of AIBSNLEA and AIRBSNLEWA, the 60:40 sharing provision from pension Rule has also been withdrawn after great efforts. It has strengthened the way for future pension revision of BSNL Pensioners. It is a great achievement of AIBSNLEA & AIRBSNLEWA.

Pallab Bose Circle Secretary conveyed gratitude to Com Kishan Singh GS & Com Amit Gupta AGS for their foresightedness and bringing into light the 60:40 cabinet decision through series of RTIs.

 Com. Amit Gupta AGS apprised the House in detail about CHQ activities regarding ;

1. Pension revision as per 7th CPC.

               2.Change in Pension Payment system of BSNL retirees by DOT.

               3.Delay in Medical Bill Reimbursement for the pensioners.

4. Present status of the court cases

Com. Amit Gupta further apprised the house in details the collective efforts of AIBSNLEA and AIRBSNLEWA in settling the burning problems of BSNL Pensioners and assured to continue the efforts for actual payment of 78.2% fitment benefit w.e.f. 01.01.2007 on actual basis. 

Com A.K.Verma Circle Secretary AIBSNLEA UP(East) Circle apprised the house regarding 3rd PRC  and forthcoming Agitational programme w.e.f. 3rd December 2018. Com. Verma assured that AIBSNLEA will extend its full support to our Association AIRBSNLEWA UP East Circle.

18.11.2018:    NEW PENSION PAYMENT SYSTEM-- LATEST REPLY FROM DOT  
DOT is all set to introduce new pension payment system (CPMS) where pension will be paid directly by the CCAs through PFMS (Public Financial Management System) to the Bank accounts of the pensioners. To understand the new system our AGS Com Gupta asked some questions under RTI which was replied by DOT unsatisfactorily.  <<Read Earlier Reply>> Com Gupta submitted a review petition and now DOT has come with more details of the scheme. 02.11.2018:  Meeting between the Secretary, Telecom and the AUAB:

A meeting between Ms.Aruna Sundararajan, Secretary, Telecom and the All Unions and Associations of BSNL(AUAB) was held today.

Com.P.Abhimanyu, GS/BSNLEU, Com.Chandeswar Singh, GS/NFTE, Com.K.Sebastin, GS/SNEA, Com. Prahlad Rai,GS/AIBSNLEA, Com. Ravi Shil Verma, GS/, AIGETOA, Com. Suresh Kumar,GS/BSNL MS, Com. Revti Prasad, AGS/BSNL ATM, Com. Rashid Khan, AGS/TEPU and Com.H.P.Singh, Dy.GS/BSNL OA participated in the talks on behalf of the AUAB.

From the DoT, Ms. Anuradha Mitra/Member(Finance), Shri Ravi Kant/ Member(Services), Shri.N.Sivasailam/Special Secretary and Shri R. K. Khandelwal/ Joint Secretary(Admn) Shri Pawan Gupta,Director (PSU),Shri Sanjay Agarwal,Director(Esst) of participated.

From the BSNL Management side, Shri Anupam Shrivastava/CMD BSNL, Ms. Sujata Ray/ Director(HR), Shri Saurab Tyagi/Sr.GM(Estt) , Shri. A.M.Gupta/ GM(SR) and Shri Sheo Shankar Prasad/DGM(Estt.) participated.

At the outset, the representatives of the AUAB pointed out that DoT failed to take appropriate action to implement the assurances given by the Hon'ble MoS(C) in the meeting held on 24-02-2018, in view of which the AUAB has been compelled to go on agitational programme. On the 3rd Pay Revision issue, the Secretary, Telecom assured that the Cabinet Note, for getting the approval of the Cabinet, would be sent at the earliest. The AUAB pointed out that within three months the Pay Revision issue has to be settled fully, otherwise, Parliament elections would be announced; settlement of Pay Revision would become difficult. Secretary informed that some queries are there from IFD, it will be raised by DoT to BSNL in a week and BSNL assured to reply all the queries within one week time ,As and when BSNL replies and after the discussion with CMD BSNL it will be processed. AUAB demanded the formalities of Cabinet memo to be completed before this month. Secretary, Telecom assured to act fast.

On the issues of allotment of 4G spectrum, Payment of Pension Contribution on the actual basic pay and Pension Revision issues, very useful discussion took place. On the 4G issue, the Cabinet Note has been sent for inter-ministerial consultation, and at the earliest it will be sent for the approval of the Cabinet. On the issue of Payment of Pension Contribution on actual basic pay instead of maximum of the pay scale , the matter is being recommended for the approval of the Department of Expenditure, with a positive note of the DoT, by next week. On the Pension Revision of BSNL retirees, the Secretary Telecom appeared to be convinced with the arguments of the AUAB, that it should not be linked with the Pay Revision of the serving employees. She directed the Member (Services) to immediately discuss the issue with her. On the 30% Superannuation benefits for the Directly Recruited employees, the Secretary Telecom said that it should be settled by the BSNL. Thereafter CMD assured to examine another 2%.
After the meeting with the Secretary, Telecom, the meeting of the AUAB was held. The meeting expressed it's satisfaction about the discussions on the issues of Allotment of 4G spectrum, Payment of Pension Contribution and Pension Revision. However, the meeting viewed that there is no improvement in the matter of 3rd Pay Revision. Hence, the meeting decided to go ahead with the agitational programme of Rally on 14.11.2018. The meeting called upon the employees to effectively organise the rallies on 14-11-2018. It is decided that the AUAB will again meet on 14-11-2018, to review the situation.
In addition to the above issues Com GS discussed the issue of replacement of E-1 by E-2,E2A by E-3 and upgradation of subsequent pay scales E-3byE-4,E-4 byE-5,E-5 by E-6 and E-6 by E-7 as per the proposal of BSNL sent on 6-6-2016 .He pleaded that downgrading of the pay scales from E-1A to E-1 and E-2Ato E-2 has degraded the caders Secy(T) directed SST to re look in to the matter. Com GS also apprised Secy(T) that despite the assistance given by Hon' ble MOSC a writ petition has been filed by DoT in tn the Hon'ble High court Delhi against the PBCAT ND judgement in withdrawal of the additional increments in the same pay scale under EPP.Secy(T) assoured to look into the matter.During discussions Com GS AIBSNLEA actively participated along with other General Secretaries.
Organisational decisions of the AUAB:
Prior to the meeting with the Secretary, Telecom, a meeting of the AUAB was held at NFTE's office, under the chairmanship of Com. Chandeswar Singh, GS, NFTE BSNL. After finalising the strategy to be adopted in the meeting with the Secretary, Telecom, the meeting discussed about the ways and means to strengthen the unity of the AUAB and its functioning. After detailed discussion, the following decisions are taken unanimously:-
(1) Com.Chandeswar Singh, GS, NFTE BSNL, is elected as the Chairman of the AUAB.
(2) Com.P.Abhimanyu, GS, BSNLEU, is elected as the Convenor of the AUAB.
(3) Notices for struggles will go with the signatures of all the General Secretaries of the constituents.
(4) All other letters / communications to the BSNL Management/ DoT / Government, will be signed by the Chairman and the Convenor.
(5) AUAB should immediately be formed at all circles and districts, wherever it is not formed so far. As regards the posts of Chairman and Convenor, the pattern adopted at the All India level should be adopted at the circle and district levels also.

28.10.2018:  Proposed AUAB Meeting with Secy(T), DoT: Today morning at 10.30 AM Secy(T), DoT hold a meeting with CMD BSNL, Director(HR) & GM(SR) wherein Secy(T) wanted to discuss the demands of AUAB with General Secretaries of AUAB but all the GSs were not available at Delhi  thus the next meeting is fixed upon 2nd Nov., 2018 at 17.00Hrs in DoT with Secy(T), DoT.

In today’s meeting Secy(T) mentioned that DoT is seriously implementing all the assurances given by Hon’ble MOSC (l/C) to AYUB Leaders in the meeting held on 24th Feb., 2018. Secy(T) DoT further informed that before 2nd Nov., 2018 Cabinet Note on 3rd PRC implementation in BSNL and 4G Spectrum allocation to BSNL will be ready for further necessary action.

DoT recommendations on payment of pension contributions on actual basic pay of BSNL employees will be send to DOE for clearance shortly. Pension revision of BSNL pensioners is also under active consideration. Secy(T) DoT  advised CMD BSNL &  Director(HR), BSNL Board to inform this status to all the leaders of AUAB. 28.10.2018:  Shree Ajay Nishad MP writes to MOSC(I/C) again on Pension Revision
As we have reported earlier on 26-07-2018 that DOT while replying RTI of our AGS mentioned that pension revision will follow pay revision only. DOT have also attached a DO letter written BY MOSC(I/C) to Sh Ajay Nishad MP wherein the said decision was communicated. <<Read >>
Our members of Muzaffarpur (Bihar), the constituency of Sh Ajay Nishad Ji,  subsequently met him and apprised him the actual position and submitted a memorandum explaining the justification of 7th CPC recommendation for BSNL Pensioners also.

GB Meeting Of Delhi Circle

A well organized GB Meeting of Delhi Circle of AIRBSNLEWA was held on 24-10-2018 at Kidwai Bhawan under the chairmanship of Com. A K Nandi V. P. Com. Shiv Kumar President and Com. Prahlad Rai GS,  AIBSNLEA and our Chief Mentor were the guests. Com. Kishan Singh GS apprised the House about CHQ activities regarding:-

1.     1)Pension revision as per 7th CPC.

       2)Change in Pension Payment system of BSNL retirees by DOT.

3.     3)Delay in Medical Bill Reimbursement for the pensioners.

Com GS also informed the house that AIRBSNLEWA has written to other Pensioner Associations on above issues and requested them to join in a common platform of pensioners. AIBSNLPWA has responded and a joint meeting is being organized on 21st Nov at New Delhi. It is expected that other associations will also respond and join the meeting to have a broad based unity amongst pensioners. He also asked the members to join the Hunger Strike at BSNL CO on 22nd Nov being organized by AIBSNLPWA and RTOWA ND.

Com. Shiv Kumar in his address informed house that he along with Com. Prahlad Rai GS and Kishan Singh have met M (F), M(S), DDG(Estt.) and Dir(SU) for settlement of pay revision & pension revision. President & GS AIBSNLEA had also met MOSC for in connection with pay and pension revision and other related issues a few days Back. MOSC assured to look in to the case very soon. 

Com. Prahlad Rai addressed the house and informed in details how sincerely Pay & Pension revision issues are being perused in DoT by him. He also told the imitational program of AUAB from 30/10/2018 onward and appealed all members to join hands in these activities in maximum numbers and assured to continue his support in future.

23.10.2018:  Meeting with Director (PSU) DOT:

GS & President AIBSNLEA met Director (PSU), DOT and discussed regarding

A) Implementation of 3rd PRC in BSNL:  Director (PSU) confirmed that the BSNL proposal for 3rd PRC with 15% fitment benefit is being returned to BSNL for re-examination on the basis of the queries made by the Internal Finance of DOT. He further mentioned that this proposal will be sent back to BSNL within this week only.

23.10.2018:   Meeting with DDG (Estt)   DOT:

GS & President AIBSNLEA met DDG (Estt), DOT and discussed regarding

A) Pension Revision: They requested the DDG (Estt), DOT for the Pension Revision of BSNL Pensioners by delinking the Pay Revision as the Pension of BSNL Pensioners is also being paid under CCS (CCA) Pension Rules 1972 as Govt. Pension. DDG (Estt) mentioned that the BSNL Pensioners Pension is being paid as per the CCS (CCA) Pension Rules 1972 but there is no mention about the Pension Revision. Govt. Pensioners Pension is being revised along with the Pay Revision as the practice. Similarly the BSNL Pensioners Pension Revision was also made along with the Pay Revision of BSNL Employees on implementation of 2nd PRC. At present 3rd PRC implementation in BSNL is under consideration in DOT and after the Pay Revision only the Pension can be revised. This stand has been taken by the Establishment Cell of DOT.

B) Payment of Pension contribution on Actual basic pay instead of Maximum of the Pay:  DDG (Estt) informed that n the meeting held on 17.10.2018, Hon'ble MOSC(IC) has directed the Member (Finance) to look in to the matter. Thus some early decision is expected in this regard.

C) CGHS Medical Facilities to BSNL Pensioners: They appraised the DDG (Estt) that in some Circles where the BSNL Pensioners have applied to switch over to CGHS Medical facility from BSNL MRS are not being allowed by the respective Circle Medical Authorities on the pretext that the Head of Account has not been mentioned in the PPO. The same has been clarified by the respective Circle CCAs and the Head of Accounts is also given but the Medical Authorities wants a copy of the letter of DOT Budget Cell. We requested DDG (Estt) to settle the issue. DDG (Estt) advised us to give a letter in this regard for necessary action. We will submit the Letter shortly. 

22.10.2018  Com Prahlad Rai and his office bearers of AIBSNLEA met CMD and Dir HR BSNL on
Implementation of 3rd PRC in BSNL, Pension Revision, Payment of Pension Contribution on actual basic:
 
Meeting with CMD:
They apprised CMD regarding meeting with Hon'ble MOSC(I/C)  and meetings in DOT. They requested CMD BSNL to use his good office in DoT/MOSC office for getting implementation of 3rd PRC in BSNL and settlement of other issues. CMD, BSNL mentioned that he will discuss the matter with Hon’ble MOSC(I/C) and will try to arrange a meeting on 29.10.2018
 
Meeting with Dir HR:
They requested DIR(HR) to use her good office in DOT for the settlement of 3rd PRC in BSNL, Pension Revision, Payment of Pension Contribution on actual basic and Allotment of  4G Spectrum etc. *Dir (HR) informed that in last week i.e.on 17.10.2018 she attended a meeting with Hon’ble MOSC(IC) in the presence of Secretary (Telecom ), Member (Finance), SST and other Senior Officers of DOT  with reference to revival of BSNL wherein she pleaded that BSNL should be allowed to take Loan from Banks with the Letter of Comfort to meet the OPEX.During discussion DOT Officers informed that the 3rd PRC proposal approved by the BSNL Board will be returning back to BSNL for their own consideration. But without the settlement of excess payment towards the Pension contribution and allowing BSNL to take Loans from Banks how this issue can be settled by the BSNL.
 
Thus she advised to further take up the matter with the Hon’ble MOSC(IC) only to settle these issues at DOT level itself because these are under the purview of DOT only.

22.10.2018:  Meeting with PGM (Admn.) BSNL CO:  

Com Prahlad Rai and GS, FS of AIRBSNLEWA met PGM (Admn.) BSNL C.O. ND and discussed to issue correct eligibility criterion order of BSNL Pensioners for medical claim by considering April -2018 IDA instead of April -2016. After April -2016 the necessary order for eligibility of medical claim for BSNL Pensioners has not been issued by BSNL CO. As a result in ERP the limit for with voucher cases are calculated with April 2016 IDA only. PGM (Admn) after some discussions assured to look into the matter.

(b) Allotment of funds to settle the medical claims of BSNL serving employees and Pensioners:  We expressed our concern against the non- reimbursement   of medical claims of BSNL serving employees and BSNL Pensioners. PGM (Admn) mentioned that due to the financial constraints the funds have not been released. However, the matter is expected to  be resolved in the next month as Dir Finance is making all out effort to avail loan from Bank on the basis of Letter of Comfort to be obtained from DOT.

I  told the house regarding the present status of payment of with/without voucher medical bills and views of CHQ on 3rd PRC. The audited expenditure for the period 22/09/2017 to 08/10/2018 was placed before house by com. G. B. Jorvekar and it was unanimously passed by house with one voice. We have sent quota for 110 members (life membership) to CHQ Delhi and further it is decided to send 30 members quota. Our senior leader com S. S. Dhangar was nominated as election officer. 09.10.2018AIBSNLEA Meeting with Shri Manoj Sinha Ji, Hon'ble Minister of State for Communications (I/C), Govt. Of India:  GS, President, AGS (Fin) and AGS(DR) met with  Hon'ble MOSC (IC) Shri Manoj Sinha Ji for early settlement of various issues viz. (i)   Implementation of 3rd PRC with 15% fitment benefit in BSNL(ii) Revision of pension of BSNL Pensioners (iii) Payment of pension contribution on actual basic Pay (iv) Allocation of 4G spectrum to BSNL (v) Payment of pension through  existing Banking CPCs instead of CCA

Hon'ble Minister  mentioned that BSNL should have serious approach towards Its Revival. BSNL has to grab the opportunity through "BSNL Wings" and FTTH connections and increase its revenue as finally burden will come only on BSNL. BSNL should increase its CFA customer base from 1 crore to 1.5 crore during next 8 months to increase its revenue. In mobile segment there is stiff competition.   We insisted that about 20 lakhs people dependent on BSNL and are watching with hope towards Hon'ble Minister. We requested that Hon'ble Minister can only decide the fate of these 20 lakh people as approach of Bureaucracy is always as per line of rule book.

After detailed discussions, Hon'ble Minister assured that after arrival of Secretary (T) from US tour on 14.10.2018, he will hold a meeting with Secretary (T) and CMD, BSNL. Unions and Associations   may also be invited for aforesaid meeting and try to resolve issues at earliest. On our pleading Hon'ble Minister assured to give good news within this month itself.

We provided all  the letters addressed to Hon'ble MOSC (IC) on above issues which he marked to Shri Saket Kumar , PS, (IAS) to conduct above meeting .

21.09.2018              NEW SYSTEN OF PENSION PAYMENT
We were getting information from the circles that the CCAs are unofficially informing the pensioners that very soon they will start disbursing the pension directly to the pensioners bank account instead of present system in which Banks or Post Offices calculate and deposit pension to our accounts. We have met the officers of DOT to know the actual position but they avoided us by saying it is their internal matter and pensioners need not bother as they will continue to get the pension in their Bank Account.

Not satisfied with the reply our AGS submitted a RTI application on 9th July 2018. Following is the reply received after 2 months on 20-9-2018      <<RTI Reply>>

1 Whether DOT is proposing any change in the present system of pension disbursement ? YES
2 If the answer of question 1 is ‘yes’, then whether in the new system the pension will be disbursed directly by CCAs to pensioners account  through RTGS or NEFT or any other system . In that event where pensioner will submit their life certificates. What is the proposed date of launching the new system.

The disbursement shall be made using PFMS. However details shall be shared on finalization of software

Life certificate can be submitted on line in form of Digital Life Certificate. Also conventional Life certificate can also be sent by post to CCAs. Other modes to facilitate pensioners are also being explored. The date of launching of the new system is not yet finalized.

3 kindly furnish copies of all relevant papers describing the new scheme  and its roadmap for implementation The road map has not been finalized as of now. Once the CPMS is in final form, then further details will be put in public domain.

Thus it can be seen that DOT is in process of changing the pension payment system but not ready to disclose the information even under RTI. But from the reply it is clear that once the software PFMS or CPMS is implemented, pension will be disbursed by CCAs and life certificates are also to be submitted to CCAs. It is mentioned that the Life certificates may be sent by post but in our opinion this is a casual reply as we know very well that it can never be sent by post for authenticity. Further DOT has taken such decision without discussion with any of the pensioners Associations. In our opinion the pensioners will be put into following difficulties in the new system.

  • 1) All pensioners have to attend CCA offices or camp offices for submitting the life certificates. Presently we are submitting the same to the banks of our vicinity leisurely during whole month of November. Bank officers even visit our places where pensioners are bed ridden on our request. In the new system such convenience will surely be un available. The CCA offices are in the capital cities. what will happen to the pensioners settled in villages, districts etc.

2) Our experience about the behavior of the employees are not comfortable. They took months and years to settle the issues. Whereas in Banks we get prompt reply if posted to their customer cells. For 78.2 IDA fixation case even today cases are pending with CCA offices. Our IDA is being revised every quarterly. At present Banks are implementing it on the same month. But if CCAs disburse our pension, then it is sure that every time we have to struggle for implementation. Furthermore for all such persuasions, pensioners have to travel to the CCA offices and they will be attended if the concerned official is available and in a good mood to hear the problem.

Present system of Pension Payment is stable system and developed over the years. We don't find it necessary to change it. We shall protest the proposed change and request all to protest. Pensioners submitting KYP forms to CCAs must mention that they want pension from Banks or POs and not from CCAs.

Yesterday the Case (OA 2260/2017) came up for final hearing along with MA 202/2018 (filed by BSNL).
in court no 5 of Principal Bench CAT New Delhi. Advocate of DOT pleaded that this case cannot be heard in single bench court as it relates to pay revision, in his opinion it should be transferred to division bench. Our advocate protested and pointed out that this case is not a pay revision case but relates to date of effect of pension revision ony. The judge ruled that the case will be heard in single bench court only. Next date of hearing given as 26-11-2018. 14.09.2018    Meeting with Smt Sujata T Roy Director (Fin & HR) at Kolkata.
 
Our AGS Com Amit Kumar Gupta met Director (HR & Fin) BSNL board and discussed the issue of abnormal delay in medical bill payment of pensioners. He mentioned that in all the circles huge no of bills are pending for want of fund. In some circles TDS have been deducted and paid to I Tax dept but the bills are not paid although in AS26 the bills are shown as paid. This may create serious problem while submitting TAX return.
 
Director madam informed that BSNL is undergoing serious fund problem. Govt has imposed restriction to take bank loan for OPEX (operational expeditie) purpose. If BSNL don't get Bank Loan for OPEX then our medical bills cannot be paid. She further suggested that the pensioners should immediately opt for CGHS by paying the requisite contribution. We pointed out other than few cities CGHS facility is not good and in many places it is practically non existant. She did not comment on that and expressed her helplessness. She said sorry to us and also advised to communicate the situation to all pensioners.
 
Therefore there is no possibility that our pending medical bills will be paid in near future.<<Glimpses>>

06.09.2018Status of 3rd PRC implementation with 15% fitment benefit in BSNL: GS, President, AGS(DR) AIBSNLEA met the concerned authorities in DoT and discussed regarding implementation of 3rd PRD in BSNL. It is learnt that the BSNL’s Board proposal is still pending in the Internal Finance of DoT for clearance. It is expected that proposal may be cleared by Member (Finance) DoT in the next week after her joining from leave. However, the nodal section of DoT has already prepared the Cabinet Note in this regard. After the clearance of Internal Finance wing & approval of the Hon’ble MOSC(I/C), it will be sent to Nodal Ministries for comments i.e. DoP&W, DPE, DOE, Law Ministry & DoP&T. It is also learnt that the comments of all these ministries are ready available in DoT on the earlier references made by DoT. Now, the whole matter depends on the approval of Internal Finance of DoT.

It is reminded in the letter that DOT has committed Govt SCHEME of Pension at the time of absorption. 29.08.2018 Meeting with Advisor Finance, DoT: Com Prahlad Rai met Advisor Finance DOT and discussed regarding denial of First time bound promotion received by BSNL executives of CTD after 5 years by office of Pr CCA, Kolkata causing reduction of pension and pensionary benefits of retired BSNL executives. After going through our letter advisor finance immediate spoke with Pr CCA Kolkata and advised her to consider the representation given by the association on the basis of EPP provisions. Pr CCA Kolkata assured an early action in this regard.

Implementation of 3rd PRC with 15% benefit, payment of pension contribution on actual basic and revisions of pension of BSNL pensioners. we also informed that BSNL Board's proposal on implementation of 3rd PRC is under consideration with DDG (Fin .), DoT.  Advisor Finance during discussions mentioned that he will discuss the matter with DDG (Fin) for an early clearance but there is feeling among the DOT officers that pension of BSNL pensioners should not be more than pension of DOT pension. Otherwise there was no use of absorption of DOT employees of BSNL. We pleaded that BSNL employees after technical resignation joined BSNL under the assurance of Govt. Pension under Rule 37 A.

29.08.2018 Meeting with Member ( Services) , DoT: Com Prahlad Rai met Shri Ravikant Member service on courtesy call and greeted him on assuming of the High Office of Member Services .

Member services has fixed up the meeting with AIBSNLEA on 4th September 2018 to discuss regarding payment of pension contribution on actual basic on BSNL pensioners and revision of pension of BSNL pensioners. 

29.08.2018 Meeting with Shri A N Rai Advisor to Hon'ble MOSC (I/C):  Com Prahlad Rai met Advisor to to Hon'ble MOSC(I/C) and requested to use his good office to support in resolution of issues of BSNL employees i.e. implementation of 3rd PRC with 15% benefit , payment of pension contribution on actual basic and revisions of pension of BSNL pensioners. After detailed discussions on these issues , Advisor to Hon'ble MOSC(I/C)   mentioned that tomorrow Hon'ble MOSC(I/C)   is holding review meeting of BSNL which was schedule today .In this meeting assured to extend his support . Regarding BSNL's viability advisor opined that BSNL should concentrate on giving more and more FTTH connections to retain and attract the customers.

Com Amit Kumar Gupta our AGS in his RTI application dated 9-7-18 asked for the documents/orders/note sheets where Govt has decided that the memo dated 4-8-16 is applicable to only those absorbee pensioners who retired from CDA scale and drawing PRO-RATA pension.  <<<RTI dated 9-7-18>>

DOP&PW vide diary no 260/IFC/2018 dated 27-07-2018 transfered the RTI application to DOT for compliance. Which obviously proves that DOP&PW do not have any such document which can prove its pension revision order is only for CDA retirees and not for IDA retirees.  30.07.2018        General Body meeting of UP (East) Circle:

Marvelous  and well organized General body meeting  of  “ALL INDIA RETIRED BSNL EXECUTIVES’ WELFARE ASSOCIATION” UP(East)  Circle  was held on 27th July 2018  at “HOTEL  SILVETE” Lucknow  in presence of our AGS Com. Pradip Goyel & CHQ Organizing Secy. Com D.N.Verma,  Hundreds of BSNL pensioners  from Lucknow district has attended the meeting which lasted for more than four hours.

Meeting started with the opening remark of Com S.M.Abbas. Circle President and he welcomed all members of Association. Com Pallab Bose Circle Secretary apprised the members that “AIRBSNLEWA” is the only Association who had sincerely pursued the 60:40 pensions sharing with BSNL, and 78.2% IDA merger issues of retired executives of BSNL at CHQ level. He told that only our Association AIRBSNLEWA had initially raised 60:40 pensions sharing issues. He mentioned that today many associations are claiming the credit of achieving the demands but in reality they did nothing about it.

After continuous struggle of AIBSNLEA and AIRBSNLEWA, the 60:40 sharing provision from pension Rule has also been withdrawn after great efforts. It has strengthened the way for future pension revision of BSNL Pensioners. It is a great achievement of AIBSNLEA & AIRBSNLEWA.

On behalf of AIRBSNLEWA UP (East) Circle we conveyed our gratitude to Com Kishan Singh GS & CHQ specially Com Amit Gupta AGS for his foresightedness and bringing into light the 60:40 cabinet decision through series of RTIs.

Com Bose further told that after the implementation of 78.2% fitment formula, not a single working employees association (including those of non-executives) protested for non-payment of pay arrears between 1st January, 2007 and 12th June, 2013, let alone seek for legal help.

AIRBSNLEWA, too, followed this principle and avoided this portion of pay arrears while seeking legal help through Principal CAT and 9th August 2018 has been fixed for Final Judgment hearing.

But, strangely, other retired executives association also included this in their plea for justice on non-payment of arrears. After being shown door by both Supreme Court and High Court, now they are dejected, perplexed and wandering aimlessly.

Com Bose informed that DOT has confirmed in writing to our AGS Com AMIT GUPTA in reference to his RTI enquiry that there will be no pension revision before 3RD PRC implementation in BSNL/MTNL. 

Circle Secretary told that after consistent persuasions by our CHQ , “Grievance Redressal Cell” for BSNL has been formed and he requested all PENSIONERS OF BSNL to avail the facility and  REGISTER all their GRIEVANCES FOR REDRESSAL. Success of this endeavor depends entirely on them. He further told that a link to this form is provided on the home page of www.intranet.bsnl.co.in  and our Association AIRBSNLEWA  has also provided a link at the top of our CHQ Web site page permanently in red color.

 Com S.M.Abbas Circle president explained the present status of the court cases and informed the house that the judgment of 1st case is expected by  9th August' 2018. Com Pradip Goyel AGS AIRBSNLEWA addressed the house. All present developments related to pensioners were explained in detail by AGS.  Com Goyel. He apprised the house with details the collective efforts of AIBSNLEA and AIRBSNLEWA in settling the burning problems of BSNL Pensioners and assured the members that AIRBSNLEWA CHQ will take appropriate action for Pension Revision at the correct moment. He also clarified other issues like 3rd PRC, Medical issues , KYC issue in CCA, and explained the actions being taken by AIRBSNLEWA.

26.07.2018  NO PENSION REVISION BEFORE 3RD PRC IMPLEMENTATION IN BSNL/MTNL
                                      ---- DOT INFORMS OFFICIALLY IN WRITING
While complying the order of Information Commissioner in respect of the RTI made by Com Amit Kumar Gupta our AGS, DOP&PW vide their no 4/1/2018-P&PW(D) dated 4th July2018, asked DOT to inform "the action taken, if any, for revision of pension of BSNL/MTNL absorbee pensioners after 7th Central Pay Commision".

In response DOT vide 47-35/2014-Pen(T) dated 13th July 2018 informs "..case of pension revision of the permanent absorbees to BSNL/MTNL will be taken up as and when 3rd PRC is implemented in BSNL/MTNL." DOT has expressed this opinion earlier verbally but this time they came out officially. (Earlier communication dated 21-02-2018 in this regard was subsequently cancelled). Further DOT has enclosed the DO letters of MOC written to two MPs with the present reply dated 13th July and thus made those letters also part of RTI document which can be produced before court as documents.

The fresh RTIs made by Com Gupta on 09-07-2018 asking the copies of the related documents/orders/note sheets which can establish the DOP&PW memo dated 04-08-2016 is applicable only to the pensioners retired from CDA pay scale and drawing Pro-Rata pension as being claimed by DOT and DOP&PW in their communications, is yet to be replied by DOT and DOP&PW.   <<< READ DOT Reply and Related DOP&PW letter >>>

held on 21-07-18 at 10.00 hrs at Basavi Club Auditorium. Com Prahlad Rai our Chief Mentor  and GS AIBSNLEA was the chief guest. Com. Amit Kumar Gupta AGS, Com. Jairam, AGS, AIRBSNLEWA attended and addressed the Spl. G.B. Meeting. Com B S Reddy AGS (Engg) and Com E Saya Goud CS Telangana AIBSNLEA were also present. Com. E. Shivaramadu, District President, AIRBSNLEWA presided over the meeting Com. Panduranga Rao Circle Secretary , AIRBSNLEWA, Com. Koteswar Rao Circle President, Com. K. Dakhsinamurthy, Distt. Secy. HTD and Com. Shivcharan, District Secy. Circle office Branch, AIRBSNLEWA welcomed all the guests. Com. BSNL CO has issued orders for medical claims yearly limit for with and without voucher. The yearly limit will be 23days 78.2% IDA merged basic pay plus IDA of the current year for with voucher claims and 25% percent of the annual limit subject to minimum of Rs 12000 per annum for without voucher claims.

09-07-2018      Court Case for Pension Arrears

Both the cases (OA 2260/2017 and 1812/2018 came up for hearing today. Our advocate tried to combine both the cases for listing for final hearing. But since for OA 1812 DOT has not submitted reply court has not agreed to join both the cases. Now OA 2260/2017 is listed for final hearing on 9th August 2018 and OA 1812/2018 is listed for next hearing on 3rd October 2018.

We request the applicants of 2nd case (OA 1812) not to get disheartened as our attempt for joining the case with old case (OA 2260), which was filed in June 2017, failed. Before next hearing i.e. on 3rd October we shall get the judgment of old case which shall certainly help early decision of the 2nd case also.

05-07-2018                    MEETING WITH DIR (Estt) DOT
Com Kishan Singh GS went to DOT to meet DDG(Estt) regarding our pension revision status but he was on leave. Then he along with sh.Abdul Majid  met Dir(Estt).It is informed that pension revision will be after pay revision of BSNL employees. I asked that it will be better if cabinet notes for both are moved together. He informed that pension revision will be as per pay revision fitment formula and Govt. decision on fitment formula is not yet known .hence cabinet note for pension revision can not be moved -along with pay revision.

Shri Ajay Nishad MP and Shri Gopal Shetty MP wrote DO letter to Hon'ble Manoj Sinha MOC on revision of pension in BSNL and MTNL respectively. Pl see the reply of MoC to them which clearly describes the mindset of DOT on this issue. 27-06-2018       RTI on Applicability of 7th CPC for BSNL Pensioners

Readers may recollect that our AGS Com Amit Kumar Gupta submitted an application asking some information on applicability of DOP&PW order dated 04-08-2016 on 7th CPC implementation for pensioners  of BSNL/MTNL. DOP&PW has avoided to furnish the information and forwarded the case to DOT. Being aggrieved Com Gupta appealed to the Chief Information Commissioner on 14-03-2017. After a gap of more than one year the appeal came up for oral hearing through video conferencing on 19-06-2018. The Information Commissioner after the hearing ordered DOP&PW to submit proper reply within 15 days.

24.06.2018  G.B. Meeting of Nasik Branch :  There was general body meeting of our Nashik branch on 18/06/2018. There were 80 members present for the meeting. The meeting was started with observing two minutes silence to give tribute to departed soul of late Shrotriya sir , late K. T. Pohare , late mother of com. N. B. Patil. The status of third PRC was discussed. The abnormal delay of payment of without voucher medical claim and with voucher medical claim was discussed. The data entry of DOT/BSNL pensioners for PDA (Pension Disbursing Authority ) was discussed.  Com. S. S. Dhangar briefed the issue in the house. It was decided not to hurry and wait for getting authentic communication from the concerned authority. The meeting was concluded with vote of thanks.  

G B Meeting of Kannur SSA Kerala : GB meeting held on 19-06-2018, About 60 members were present. All the issues related to pensioners discussed in the meeting. Members expressed their frustration for abnormal delay of payment of medical bills which is about 6 months.

14.06.2018     MEETING WITH DIR (HR) BSNL AT KOLKATA

Smt Sujata Ray Director(HR) BSNL is on official tour to Kolkata. Today (14-06-2018) she granted a meeting with AIRBSNLEWA at 12-30 hours. From our side Com Amit Gupta AGS/CHQ and Com D Roy Org Secy WB represented. They felicitated her with flower bouquet and Bengali sweets. Following points were discussed:
1) Opening of Pensioners Grievance Cell: They thanked her on behalf of the entire BSNL pensioners community for this historic decision of opening the grievance cell accepting our suggestion and request. For further improvement of the system we requested to introduce acknowledging the grievances by sending SMS and to provide an arrangement to view the status of the grievance. A letter was also handed over to her. She highly appreciated the suggestions and assured to implement the same within short time.
2) Inordinate delay in settlement of medical claims of pensioners: They pointed out that in all circles of India average delay for settlement of outdoor claims is minimum 4 months and that for indoor claims it is one year and for maximum delay there is no limit. Director (HR) enquired whether it is pan India picture, We requested her to enquire in any circle of her choice. Everywhere pensioners are left to the mercy of the concerned officials and officers.She then informed that the preparation of "Bill Tracking Module" is now being done by ITPC unit and expected to be ready by next 2 months. We requested to have the field trial of the module at Kolkata and at Andhra Pradesh. Director agreed to consider the proposal.
3) Proposed meeting with all pensioner Associations: They reminded her that the proposed meeting has not been arranged although promised. There are small small problems which can be resolved through this meeting. Director (HR) mentioned that on the inauguration day of "Bill Tracking Module" the said meeting will be arranged/

Thereafter she opined that BSNL is planning to open a mentor group with retired executives who are conversant with the rules and regulations mainly on finance and accounts and HR administration. Their job will be to guide the new less experienced officers. Our representatives reacted positively and assured to help the management for any need including the proposed mentor group. They also offered to extend their help for sales and marketing jobs in the circles. The meeting lasted for about 20 minutes and in very cordial terms.  <<<LETTERS>>>   <<<Glimpses>>>

07.06.2018     MEETING WITH DOT OFFICERS
 

Meeting with Member (Finance), Telecom Commission:

GS AIBSNLEA and GS, AIRBSNLEWA met Member (F), Telecom Commission and discussed:

A Implementation of 3rd PRC report with 15% fitment benefits in BSNL: They requested Member (F) for giving her clearance to the BSNL Board approval on 3rd PRC implementation in BSNL and as per the reply received from DPE. Member (F) mentioned that she has not received any proposal in her office in this regard. We informed her that the file is pending with DDG (EF), DoT. She immediately spoke with DDG (EF) and inquired about the status of file. DDG (EF) informed that he has returned the file to the Director (PSU) for clarifying some queries. Member (F) directed him to submit the file to her after receiving the reply from the concerned section. Member (F) further mentioned that she is in favour of implementation of 3rd PRC in BSNL.

B Revision of Pension: They requested for revising the pension of BSNL pensioners by de-linking from the pay revision of the serving employees. Member (F) mentioned that this matter is being dealt by Member (S) and on receipt of the case she will consider favourably.

 

Meeting with Member (S), Telecom Commission:

GS, President, OS (West) AIBSNLEA and GS AIRBSNLEWA met Member (S), Telecom Commission and discussed regarding pension revision of BSNL pensioners. Member (S) advised them to provide a brief note to DDG (Estt), DoT on the anomaly which may take place amongst the pensioners on revision of pension of the pensioners prior to 01.01.2017 and the pensioners who retired or retiring after 01.01.2017 with or without implementation of 3rd PRC.

07.06.2018   ON LINE GRIEVANCE REGISTRATION FORM   
As reported by us on 22-05-2018, after formation of Grievance Redressal Cell for BSNL pensioners, SE Cell has now introduced an on line Grievance Registration Form for on line entry of the Grivances. We have been negotiating on this issue with Director (HR) since last one year. We are extremely thankful to her for accepting our request for the benefit of the pensioners. We are thankful to GM(SR) also for nicely designing the form. Some improvement is required which we shall be communicating with him.

NOW ALL PENSIONERS OF BSNL ARE REQUESTED TO AVAIL THE FACILITY AND REGISTER ALL THEIR GRIEVANCES FOR REDRESSAL. SUCCESS OF THIS ENDEAVOR DEPENDS ENTIRELY  WITH THEM.

01.06.2018          BLAME OTHER TO HIDE YOUR INEFFICIENCY

When AIRBSNLEWA was preparing for the court case and collecting signature from the pensioners to make each of them 'Applicant' for the case, one association criticized us bitterly and announced that they will move to appropriate court at the appropriate time on 'Representative Capacity' so that all pensioners get the benefit hence there is no need for individuals to become applicant.

Subsequently they moved to Supreme Court, where their petition was not accepted and disposed off with leave and liberty. Ironically there were 439 petitioners for the case contrary to the claim of becoming representative of all pensioners. Next they moved to Delhi High Court. There also the case is disposed off on first hearing. After that they issued a circular (see below) blaming AIRBSNLEWA. They tried to establish that as because we have filed case in Principal CAT New Delhi , Delhi HC did not accept their petition. Now pl go through the order of Delhi HC (see below). In the last para the court said

                          Since the JURISDICTION of such case is with Central Administrative Tribunals,
                          the case is relegated (downgraded) to CAT.

This we are aware since beginning. That is why we approached to Principal Bench CAT New Delhi and not misguided the pensioners saying loud words like Supreme Court, High Court etc.

They also mentioned several other points which according to them is our wrong action in handling the court case and will harm pensioner's interest. As because this may create confusion among pensioners we are explaining below our stand on the issues raised by them. 

1) We have not challenged the DOT order dated 10-06-2013 :  Yes we have not, because that order has got nothing to do with the pensioners retired prior to that date. That order was for the serving employees as on 10-6-13 only. The order for merger of 78.2% IDA for pensioners was issues on 18-07-2016, in our petition we asked only modification of the paragraph where with holding of pension arrears is mentioned. Therefore why should we challenge an order which is not related.

2)We have not asked for pay arrears for the pensioners retired after 1-1-2007 but before 10-6-2013 : Yes we have not asked. The pay arrears from 1-1-2007 to 10-06-2013 is denied not only to the pensioners but to all serving employees numbering more than 2.5 lakhs. We thought that raising the pay arrear issue will make the case complicated and longer time consuming, because all the serving employees are related and this has to be paid by BSNL. Moreover like pension arrears there is no protection from Supreme Court for pay arrears. Therefore we decided to separate out both the issues. After achieving pension arrears depending on the situation we shall fight for pay arrears also. We have to remember that there are many many instances where pay fixation is done from some date but paid from some other prospective date.

3)The Notional issue : We fail to understand why they are unnecessary harping over the word notional again and again. This word is used rightly by DOT in their order dated 18-7-16. There are two types of fixation Actual and Notional. As per dictionary when fixation is done from some date but payment is effected from a prospective date the fiction is notional. Therefore the fixation of 78.2% IDA merger from 1-1-2007 and actual payment from 10-6-13 is certainly notional which is rightly mentioned in DOT's order dated 18-7-16. The word 'Notional' is mentioned in DOT's order dated 18-07-16 three times to describe the fixation of both pay and pension.

Our case is progressing in right direction and we are confident of winning it. All such attempt to find loopholes in our petition is only an attempt to help DOT to damage our case and also a futile attempt to hide the inefficiency in filing their case in Supreme Court and Delhi High Court.

Most remarkable point is this association has now started a hush-hush campaign to malign us. In public domain they are silent on the court case issue but internally they are active. When someone avoids to be transparent, there is always some misdeed behind.

These people all along blamed us for going to PCAT and said they will show how to fight a case and bring justice to all the pensioners, but today see their pitiable condition. God is really Great. <<Circular>> << HC Order>>

16.05.2018   GREAT ACHIEVEMENT BY AIRBSNLEWA FOR PENSIONERS
Our Association has been requesting the BSNL management for opening of Pensioners Relation (PR) cell at Corporate and Circle level for the benefit of pensioners as at present there is no designated officer to look after the issues of pensioners. We have written number of letters and requested Dir HR many times. Finally during the inaugural function of AIBSNLEA CHQ office at BSNL CO, Com Kishan Singh in his deliberation requested Dir HR again to take decision on this issue which was reciprocated positively by the Dir HR. Accordingly the decision has been taken to open the PR Cell under GM (SR) at Corporate level. The necessary order is under issue. Today Com GS went to thank the Director HR and requested to open such cells in circles also. Dir HR agreed to that and instructed immediately to the concerned officers for taking action.

This will certainly extend benefit the pensioners for redressing their grievances. AIRBSNLEWA will continue to strive hard for the real welfare of the pensioners without any gimmick.

16.05.2018 Meeting with CMD BSNL: GS, President, AGS (HQ), AGS (Finance) and AGS (DR) AIBSNLEA met CMD BSNL and discussed regarding.
Implementation of 3rd PRC in BSNL with 15% fitment benefit: They apprised CMD BSNL regarding our discussions held with Secy. Telecom. & Member (Finance) DoT in the informal meeting held on 11.05.2018 regarding implementation of 3rd PRC in BSNL, payment of pension contribution on actual basis instead of maximum of the pay scale and pension revision. CMD confirmed that now there is a move in DoT to draft the Cabinet Note on relaxation in the affordability clause of 3rd PRC report w.r.t. BSNL. CMD also mentioned that we will strict for 15% fitment benefits. He further mentioned that our efforts are yielding the results now.

a) Creation of separate cell for BSNL pensioners under the control of GM (SR): We extended our sincere thanks for creation of a separate cell exclusively for BSNL Pensioners under the control of GM (SR) as a single window service and requested to open such single window service to BSNL pensioners at Circle level also. Dir (HR) mentioned that this issue was raised by AIBSNLEA & AIRBSNLEWA  in the inaugural function of AIBSNLEA CHQ office wherein she had assured an early action. Accordingly, this step has been taken and she directed GM (SR) to take similar action at all Circle levels also as requested by us.

b) Extension of BSNL MRS facility to the BSNL pensioners after 01.04.2018: We requested to issue necessary orders for extending BSNL MRS facility to the BSNL pensioners after 01.04.2018 w.r.t. their outdoor treatment. Dir (HR) directed GM (SR) to issue necessary directions to PGM (Admn) for issuing necessary orders in this regard at the earliest.

c) Implementation of 3rd PRC in BSNL with 15% fitment benefit: We apprised Dir (HR) BSNL Board regarding our discussions held on 11.05.2018 with Secretary (Telecom) & Member (Finance) DoT regarding implementation of 3rd PRC in BSNL, payment of pension contribution on actual basis instead of maximum of the pay scale and pension revision of BSNL Pensioners. Dir (HR) mentioned that yesterday Member (Finance) DoT has called her over telephone and advised her to have discussions on preparation of the Cabinet Note on 3rd PRC implementation in BSNL. Accordingly, she will be going to DoT to discuss the matter with Member (Finance). She confirmed that now there is a move in DoT to draft the cabinet note on relaxation in the affordability clause of 3rd PRC report w.r.t. BSNL. Director (HR) further mentioned that it is a good sign for implementation of 3rd PRC in BSNL since the  DoT has allowed BSNL to start Wage Negotiation with Non-Executive Unions.

Regarding payment of pension contribution on actual basis, Director (HR) mentioned that she has also spoken with the senior officers of DoT Finance who informed that no such case has been put up to them from Establishment Cell of DoT. In view of this, she directed GM (SR) to discuss the matter with DDG (Estt), DoT for submitting the case to the Internal Finance of DoT for comments as desired by DoE.

On the issue pension revision of BSNL Pensioners, Director (HR) mentioned that she has also discussed the matter with Member (Finance) and the Member (Finance) is also of the opinion that Pension revision will take place after the revision of pay scales of BSNL serving employees.

10.05.2018 Meeting with Dir(PSU) DoT:- GS, President, AGS (DR) AIBSNLEA met Dir(PSU) DoT and discussed regarding.
 Implementation of 3rd PRC in BSNL with 15% fitment benefit: They requested Dir(PSU) for the implementation of 3rd PRC in BSNL with 15% fitment benefit as recommended by BSNL Board. They also pleaded that administrative ministry can consider implementation of 3rd PRC in BSNL as per its recommendations on affordability clause. However, the reply from DPE in this regard has also been received in DoT long before. Dir(PSU) mentioned that the DPE reply has been given cognizance by all the Sr. Officers in DoT but further action is yet to be taken. It seems that the work regarding preparation of Cabinet note for relaxation in the affordability clause has not yet started in DoT. This a serious situation and all the Unions and Associations of BSNL Should immediately decide their strategies to impress upon DoT for the settlement of this issue otherwise the issue will linger on in DoT.

10.05.2018Meeting with DDG (Estt.) DoT:- GS, President, AGS(DR) met DDG(Estt.) DoT and discussed regarding.
Revision of pension of BSNL pensioners: They requested DDG(Estt.) DoT to take necessary steps to revise the pension of BSNL pensioners after 3rd PRC report. DDG (Estt.) mentioned that the matter has been examined and DoT administration is of the opinion that pension revision of BSNL pensioners will take place only after their pay revision. They further pleaded that BSNL pensioners are not playing any role in the affordability of BSNL, thus their pension revision should be delinked with the pay revision and as per the BSNL reply to DoT that at present the pension liability of BSNL pensioners is about Rs. 4200 Crores and after the revision of pension with 15% fitment benefit it will increase Rs. 4800 Crores. DDG (Estt.) lastly told that he will further discuss the matter with the concern officers of Estt. Cell of DoT.

08.05.2018     SECOND CASE FOR PENSION ARREARS ADMITTED IN PCAT NEW DELHI

The second court case prepared by AIRBSNLEWA was filed in Principal Bench CAT New Delhi on 16-04-2018. This time 500 members signed the Vakalatnama as applicants. As because the first petition was filed by the Association as first petitioner along with 1199 other applicants , this case is filed by individual pensioners only and Com Subhash Chander of Delhi is the first petitioner. First petition was filed on 01-06-2017 i.e. almost one year back. By this time the case came up for hearing  7 times and finally DOT has submitted its reply sometimes back. We are now preparing for a befitting rejoinder of DOT'S reply and the case is listed for next hearing on 9 th July 2018.

Therefore it was our endeavor to make good the delay and tag the second case with the first one so that both are heard together and  and final judgment is given for both the cases simultaneously. The petition for second case prepared in that way and finally we are successful in our planning. Today the second case (OA/1812/2018) came up for admission hearing and after admission it is listed for next hearing on 9th July 2018 along with First case (OA/2260/2017). Both the MAs for condonation of delay and considering 500 applicants as single case are also allowed. Thanks to our learned Advocate Madam.

We are very transparent and clear in our functioning and handling the court case. When we appealed to our members to contribute a meager amount towards the cost of the expenditure for the court case, we have been bitterly and unethically criticised by other pensioner associations. Some called us cheat and asked pensioners to be aware, some criticised for going to PCAT instead of higher courts and commented about our prudence. They said that there is no need for individuals to sign the papers and they will show how to bring justice for all.

Today let us see the status. The Armchair Man is successful in collecting more than 19 lakh for fighting the case but the case is rejected by Supreme Court and now it is learnt that Delhi high court also refused to accept the case under 226 of the constitution. Their website and e journal is silent over the issue since last 2 months. The fate of Rs 19 lakh collected is going to be same as of the old Association's money and Building they are still holding illegally. Another Association has taken a long root. Although they have collected lakhs from their huge members but they filed the case at Ernakulam CAT with some applicants only with a promise to others that they will be accommodated when the case will finally reach to Supreme Court !!!!. If it is so then money from them could have been collected that time only, Remaining two Associations although collected thousands from each of their members have no plan to fight in the court for denied pension arrears.

AIRBSNLEWA with its limited capacity is determined to bring justice for the BSNL pensioners and moving firmly towards that direction. It is committed to ensure the rights of the BSNL pensioners i.e. Pension and Medical.

 21.04.2018            REPORT FROM GS Com KISHAN SINGH

A spacious Office accommodation was allotted to AIBSNLEA CHQ at BSNL Corporate Office. Dir (HR) Smt. Sujata Ray along with GM(SR) & OSD to Dir HR inaugurated the New CHQ office of AIBSNLEA in IR Hall. on 20/04/2018. Com Prahlad Rai invited AIRBSNLEWA along with all other Unions and Associations. It was a well managed programme attended by all BSNL unions and Associations and also MTNL Association. During my deliberation I highlight the following problems of BSNL absorbed retirees in the notice of Dir(HR), following is the gist of my deliberation.—

1.     Without Voucher medical Reimbursement for Outdoor treatment to BSNL pensioners--  This option was given to pensioners during 2017-18 for six months and payment has also been made up to Sept. 2017. After that orders has not been issued for continuation/discontinuation of this without Voucher Facility. Although financial year 2017-18 is over. Our pensioners are in doubt whether payment of medical bill reimbursement will be made for last two quarters or not. Financial year 2018-19 is already started but nothing is clear about the without voucher medical bill reimbursement facility. I request you Madam to issue necessary orders whatsoever may be BSNL Managements decision.

2.     I reminded Dir(HR) about her discussion with our A.G.S Shri. Amit kumar gupta on 22/09/2017 while she was on tour to Kolkata. Madam, you assured our AGS to call for a meeting of all pensioner Association and unions representatives to redresses the pensioners grievances. I also wrote a letter to you on 27/09/2017 giving reference of Kolkata discussion for early date of meeting with pensioner’s representatives. But we are still awaiting, Madam we are not having any opportunity to meet and tell you the difficulties being faced by pensioners in getting medical bill reimbursement etc.

3.     I have also requested in writing in Aug 2017 to open a PR cell (Pensioners relation) cell under GM(SR) in corporate office and Circle offices so that pensioners may approach at one officer instead of roaming from one officer/section to other officer/section. But that decision is still awaited.

4.     Lastly I requested Dir(HR) and sh. Prahlad Rai our mentor to allow us to sit in their new CHQ office room of AIBSNLEA and do some Association work whenever we happen to be in BSNL corporate office.

5.     Dir (HR) appreciated our concern on all the above 3 points relating to pensioner. She asked GM(SR) to note down these points and remind her in her office.

 

19.04.2018  DPE replies DoT on 3rd PRC implementation in BSNL:

 GS and President AIBSNLEA met DPE officers and extended thanks for replying DoT with respect to the proposal of BSNL for implementation of 3rd PRC by relaxing affordability criteria. DPE in their letter has replied that “BSNL does not fall under the category mentioned in para 5 of DPE’s OM dated 03.08.2017 on 2017 pay revision. Further, it is mentioned that DPE has issued guidelines for 2017 pay revision which, inter-alia, includes an affordability clause, based on the recommendations of Committee of Secretaries (CoS) on the report of 3rd PRC. Any relaxation in the extant guidelines would require the approval of the Cabinet for which DoT may examine the issue at its end for necessary action.”

Now, we have to pursue the matter in DoT for the preparation of the Cabinet Note.

19.04.2018  Meeting with JS (Admn) DoT and the Govt. nominee Director in BSNL Board:

GS, President and AGS (HQ) met JS (Admn) DoT and the Govt. nominee Director in BSNL Board and discussed regarding:

 Implementation of 3rd PRC report in BSNL: We requested JS (Admn) that since the DPE has replied the DoT for taking approval of the Union Cabinet to relax the affordability Clause of the 3rd PRC report, DoT should take immediate necessary actions in this regard. JS (Admn) mentioned that this reply was expected from DPE and now necessary action will be taken in this regard.

28.03.2018    Meeting with the officers of DPE:

Com Prahlad Rai along with the GS/FNTO Shri Jai Prakash and AGS/SNEA Shri Dahia met Joint Secretary (DPE), Director (DPE) and Assistant Director (DPE). We requested Jt. Secretary (DPE) to reply DoT regarding the relaxation in the affordability Clause of 3rd PRC recommendations to BSNL as the relaxation has been granted to some PSUs like FCI & others. We also requested to consider the recommendations of the BSNL Board for implementation of 3rd PRC with 15% fitment benefits in BSNL. Jt. Secretary (DPE) after detailed discussions assured to reply DoT at the earliest.

 

He also mentioned that DoT being the Administrative Ministry of BSNL should take up the matter with Union Cabinet for relaxation based on the recommendations given by the BSNL Board for relaxation in the affordability clause.

 

He assured that the reply will be given to DoT with the approval of Hon’ble Minister of Heavy Industries so that he may be aware of the issue when it is taken up in the Union Cabinet.

Com Prahlad Rai GS AIBSNLEA and Chief Mentor AIRBSNLEWA held series of meeting with DOT officers today

1)  DDG (Estt), DoT and discussed regarding:

 Pension revision of BSNL pensioners:  He requested DDG (Estt) to initiate the proposal of pension revision of BSNL pensioners as assured by the Hon’ble MOSC (I/C) in the meeting held with All Unions and Associations of BSNL on 24.02.2018. In this connection DDG (Estt) appreciated the letter dated 16.03.2018. However, he mentioned that the financial implications to Govt. on revision of pension need to be worked out by DoT before initiating the proposal as directed by the Secretary (T). He advised us to submit some concrete information about executives and non-executives with examples in the higher scale i.e. E3, E4, E5 and NE9 to NE12 and % increase on revision of pension by minimum and maximum fixation. He assured him to provide the same with examples.

 

2) Meeting with Director (PSU), DoT

3rd PRC implementation in BSNL: On his query regarding DoT efforts for implementation of 3rd PRC in BSNL as assured by Hon’ble MOSC (I/C) in the meeting held with All Unions and Associations of BSNL on 24.02.2018. Director (PSU) informed that Secretary (T) has already discussed the matter with Secretary (DPE) and the recommendations of DoT on BSNL’s proposal has been sent to DPE to seek the opinion for further action in this regard.

 

3)Meeting with Joint Secretary (Admn):

3rd PRC implementation in BSNL: On his query regarding DoT efforts for implementation of 3rd PRC in BSNL as assured by Hon’ble MOSC (I/C) in the meeting held with All Unions and Associations of BSNL on 24.02.2018. JS (Admn) confirmed that the recommendations of DoT on BSNL’s proposal has been sent to DPE to seek the opinion for further action in this regard. He opined that DPE will advise to go to the Union Cabinet for getting the relaxation in the affordability Clause of 3rd PRC for BSNL. Thereafter, further action will be taken.

13.03.2018  Meeting with DDG (Estt), DoT, New Delhi
 

GS, President AIBSNLEA and the GS AIRBSNLEWA met DDG (Estt), DoT and discussed regarding:
 

A Pension revision of BSNL Pensioners: We requested DDG (Estt) to initiate the proposal of Pension revision of BSNL Pensioners. DDG (Estt) mentioned that after the meeting held with Hon’ble MOSC (I/C) Secretary (T) has asked to provide the information on the financial implementation on the revision of Pension, if any. Now, the efforts are being made to collect the required information in DoT. He further mentioned that in the year 2016-17 the total Pension liability for BSNL Pensioners was around 8,000 Crore. Now it has to be seen that after revision of the pension of BSNL Pensioners the total amount will increase 10% or 15%. We explained that total financial implication will not be more than 10%. He advised us to submit some information regarding the existing pension being drawn and % increase on revision of the Pension. We assured him to provide the same with examples within the next week.

B Implementation of Hon’ble PB CAT New Delhi judgment related to the DoT order dated 05.07.2017: We requested DDG (Estt) to issue necessary orders to withdraw the DoT order dated 05.07.2017 by implementing the Hon’ble PB CAT New Delhi judgment related to the additional increment being given in the same scale on post based promotion under the EPP. DDG (Estt) mentioned that the PBCAT judgment has been submitted to the Secretary (T) through the Internal Finance of DoT. After, the decision further action will be taken to file an appeal or not.

13.03.2018  Meeting with CMD BSNL:
 

GS, President and AGS (HQ) AIBSNLEA met CMD BSNL and discussed regarding:

A Implementation of 3rd PRC recommendations in BSNL: We extended our sincere thanks to CMD BSNL for arranging a meeting of all the Unions and Associations of BSNL with Hon’ble MOSC (I/C) on 24.02.2018. CMD appreciated our concern and mentioned that the meeting was very good and beyond the expectations wherein Hon’ble MOSC (I/C) has shown his positive response on the demands. He explained that now Secretary (T) has to take up the matter with Secretary (DPE) to process the proposal to the Cabinet and Hon’ble MOSC (I/C) will take up the matter for favourable settlement. Payment of pension contribution on the actual basic pay as per the Govt. orders, which was agreed by the Hon’ble MOSC (I/C) was a very good achievement for BSNL. He assured to continuously pursue the matter.

B Implementation of the Hon’ble Supreme Court orders on TES Gr “B” seniority issues: We requested for early implementation of the Hon’ble Supreme Court judgments on TES Gr “B” seniority cases. CMD assured to look into the matter.

08.03.2018  COURT CASE FOR PENSION ARREARS  
The case OA 2260/2017 came for hearing on 7-3-2017 (7th hearing). The arguement took place on BSNL application  (MA 202/2018) to remove its name from list of Respondents. Our Advocate objected to it for which affidavit was already filed. Advocate for DOT also objected and asked two weeks time for filing the objection. Court allowed 2 weeks as a last opportunity. 24.02.2018  Meeting between Shri Manoj Sinha, Hon’ble Minister of State for Communications and the All Unions and Associations of BSNL - A historical meeting:

A meeting is held at the Sanchar Bhawan today the 24.02.2018, between Shri Manoj Sinha, Hon’ble Minister of State for Communications and the All Unions and Associations of BSNL (AUAB). Together with the Minister, Secretary, DoT, Special Secretary, DoT, Joint Secretary (Admn.), DoT, DDG (Esst), DoT, Shri Anand Kumar, OSD to the Hon’ble Minister, CMD BSNL and Director (HR) BSNL were present. From the All Unions and Associations of BSNL, Com. P. Abhimanyu, GS, Com. Chandeswar Singh, GS, NFTE, Com. K. Sebastin, GS, SNEA, Com. Prahlad Rai, GS, AIBSNLEA, Com. K. Jayaprakash, GS, FNTO, Com. N.D. Ram, GS, SEWA BSNL, Com. Ravi Shil Verma, GS, AIGETOA, Com. Mallikarjuna, President, BSNL MS and Com. S.D. Sharma, GS, BSNL ATM, participated in the discussions. The representatives of the AUAB heartily thanked the Hon’ble Minister for taking out time to meet them. Detailed discussions took place on the memorandum submitted to the Hon’ble Minister, the details of which are as follows:-

 

(1)               3rd Pay Revision.

So far, the DoT has been maintaining that BSNL employees are not eligible for 3rd Pay Revision. In today’s meeting the Hon’ble Minister agreed that the issue of 3rd Pay Revision of BSNL employees would be processed and would be taken for the approval of the DPE and the Cabinet. This is a great achievement. We have broken the stalemate that prevailed in the Pay Revision issue. At the same time we have to be vigilant, till the final approval is given by the Cabinet.

 

(2)               Formation of Subsidiary Tower Company.

The AUAB representatives expressed their apprehension that in the name of formation of the Tower Company, the 66,000 mobile towers of BSNL are being snatched away from BSNL. They also pointed out that the decision of the Cabinet that, the Subsidiary Tower Company would remain under the control of BSNL Management, has been violated, through the appointment of an IAS officer as the CMD of Subsidiary Tower Company. They further pointed out that even BSNL Management was not taken in to confidence in the appointment of an IAS officer as the CMD of the Subsidiary Tower Company, which clearly shows that the Subsidiary Tower Company would not be under the control of BSNL Management. The reply given by the Hon’ble Minister in this regard is not satisfactory. The AUAB has to find ways and means to ensure the rolling back of the Subsidiary Tower Company.

 

During the discussions on the issue, GS AIBSNLEA raised the issue of additional increment on post based promotions under the provisions of executive promotion policy provisions which has been denounced by DoT vide letter dated 05.07.2017 and lakhs of rupees recoveries are taking place of BSNL executives and BSNL pensioners. He instantly submitted Hon’ble PB CAT judgment copy to Hon’ble MOSC (I/C) wherein the DoT order dated 05.07.2017 has been quashed. Hon’ble MOSC (I/C) immediately directed DoT administration to look into the matter.  Now, we can expect that DoT may not go for appeal against the PBCAT order in this regard after this meeting.

 

(3)               Pension Revision.

The representatives of AUAB strongly argued that pension revision should be done to the BSNL pensioners. It was pointed out that the BSNL pensioners and the Central Government pensioners are covered by the same rules. They argued that when pension revision is settled for the Central Government pensioners, the same should not be denied to the BSNL pensioners. The Hon’ble Minister assured that needful action would be taken to settle this issue. 

 

(4)               Calculation of Pension Contribution.

It was strongly argued that pension contribution in respect of BSNL employees cannot be calculated on the basis of maximum of the pay scale, when the same is calculated on the basis of actual basic pay, in the case of Central Government employees. It was pointed out that as per the DoP&T order issued in 2006, pension contribution of the Central Government employees is being deducted on the basis of actual pay only. The Hon’ble Minister directed the Secretary, DoT, that this issue should be settled as per Government orders.

 

(5)               Allotment of 4G spectrum to BSNL.

The AUAB representatives pointed out that it will be extremely difficult for BSNL to compete with the private operators, without providing 4G service. They strongly argued that the proposal of the BSNL Management, for the allotment of 4G spectrum by the Government, should be accepted. The Hon’ble Minister replied in the positive and assured that needful action would be taken.

 

(6)               Reduction of retirement age from 60 to 58.

The AUAB representatives strongly argued that the retirement age of the BSNL employees should not be reduced from 60 to 58, as a measure for the revival of BSNL. The Hon’ble Minister told that the government is not having any proposal to reduce the retirement age from 60 to 58.

 

(7)               Left out issues of the 2nd PRC.

The AUAB representatives pointed out that this issue is lingering on very long time and needs to be settled. The Hon’ble Minister stated that this issue would be looked into by the Secretary, DoT.

 

At the end of the meeting, the Hon’ble Minister stated that the representatives of AUAB could meet him again, as well as the Secretary, DoT, in continuation of today’s meeting. The representatives of AUAB heartily thanked the Minister for his positive response to most of the issues.

 

After the meeting with the Hon’ble Minister, a meeting of the AUAB was held in the FNTO’s office. All the General Secretaries expressed their satisfaction with regards to the progress in the issues. They also expressed the view that all these have happened only because of the united struggles and massive mobilization by the entire Non-Executives and Executives, for which they deserve appreciation

23.02.2018  DoT today withdrawn its earlier letter No. 24-1/2018-SR dated 21.02.2018 vide which latest status on the charter of demands of Unions and Associations was intimated denying all the demands.

21.02.2018   MEDICAL ALLOWENCE FOR PENSIONERS     
Order for Continuation of Medical Allowance Without Voucher for remaining 2 quarter of this financial year is held up in Budget Section of BSNL CO for allotment of necessary fund. It is reliably learnt that the Budget Section may propose reduction of annual limit from present 23 days to 15 days and also may recommend discontinuation of  without voucher system.

21.02.2018    DOT REJECTS ALL DEMANDS FOR PAY AND PENSION REVISION
DoT vide letter number 24-1/2018/SR  DATED 21-02-2018 communicated CMD, BSNL with respect to the agitation notice by All Unions and Associations of BSNL - Massive March to Sanchar Bhawan on 23.02.2018. Through this letter DoT has apprised the status of demands wherein all the demands have been denied which is the most frustrating situation. DoT instead of settling the issues in the interest of BSNL's viability and its employees denying the settlement of the legitimate demands.

With profound grief we are informing the sad demise of our CHQ President Rakesh Srivastava Ji. Today suddenly he was sick and expired on way to Hospital at 12.30 Hours. 13.02.2018                    COURT CASE FOR PENSION ARREARS   
The Court Case for Pension Arrears from 1-1-2007 to 9-6-2013 and pensionary benefit Arrears (OA 2260/2017) came up for hearing today at court no 4 of PCAT New Delhi. This was the sixth hearing. After some arguments on the MA filed by BSNL asking BSNL to remove from the list of Respondents the case is adjourned for 7th March 2018.    <<<<ORDER>>>>
11-02-2018: Followed by our post on 6th Feb, the retired association has come out with a six page explanation which is a useless attempt aimed mainly to convince their members and save their faces as the misdeeds are exposed. They alleged us about misquoting the judgment by not publishing a part of it. We updated on 6 th Feb Morning from Supremecourtofindia.nic.in ->case satatus -> case number. Even now the same information is available today as we uploaded on 6th, not a word more. the full order which is now available at Supremecourtofindia.nic.in ->case status -> free text -> is uploaded two days after the judgment. As we wanted to upload the list of the applicants which they were hiding we uploaded the relevant area. The Full Order is as follows

Yes, there may be exchange of 2 or 3 sentences but the ultimate status as we uploaded remains same. And in spite of emphatic attempt to cover the misdeeds by a long six page write up but the following questions still remain unanswered:                                                                                                                                                             1) They uploaded on 5th Feb
"The Court felt that the Petitioner may move High Court first and accordingly has given liberty to the Petitioner to do so." Now in the above order where is the feeling of the court ? It is also not clear what made the lawyer  "seek leave to withdraw the writ petition" immediately on mention of the case ? the court granted the leave to withdraw as asked and also liberty legal meaning of which is :  liberty - Legal Definition. n. Freedom from government or private interference or constraints. The ability to exercise the rights enumerated by a constitution or available or under natural law. : Then why there is an attempt to give different meaning to a standard legal phrase "Leave and Liberty" used for any such case where the petition is withdrawn ?
2) A long explanation is given to cover the secret action of including 339 special pensioners as applicants leaving behind thousand of other pensioners who also contributed. One explanation is that it is done to include 3 diff group of pensioners. Has it been so then 3 other pensioners would have been sufficient, why 339 ? The other alibi given is to cover all parts of India even then why more than one from one state ? and what about the pensioner of those states from where there is not even one name? Most importantly why they have not disclosed it earlier in their website. Does the pensioners who contributed not deserve the right to know everything?
3) Now they are planning to go to Delhi High Court whose jurisdiction is Delhi NCR only. What will happen to these existing 339 pensioners many of whom are out of Delhi region?
However we extend our sincere good wishes to their attempt and pray almighty that their case be admitted in Delhi HC under article 226 and again they need not step one stage down to PCAT.
PS: We thought it unnecessary to reply the other bullshits they uttered against us in the write up.
 
06.02.2018              LERAN FROM THEM HOW TO CHEAT THE PENSIONERS
 When AIRBSNLEWA was preparing for the court case for pension arrears and was collecting signatures from individual pensioners, they have been bitterly criticised by one of the Pensioners Association. They claimed that there is no need for individual pensioners to sign the petition and they shall move to court as representative of all pensioners. They also named AIRBSNLEWA as cheat for collecting Rs 200/- as court fee and called upon the pensioners not to fall on their "pray".
Subsequently they started collecting Rs 500/ or more from the pensioners and collected more than 10 lakh rupees. There after they managed to file a writ petition in Supreme Court which has been disposed off yesterday. After that they posted following in their website.

"The Writ Petition filed by AIBSNLREA in Supreme Court on pay and pension arrears issue came up for hearing for admission to-day in the bench of Justice Madan B Lokur and Justice Deepak Gupta. The Court felt that the Petitioner may move High Court first and accordingly has given liberty to the Petitioner to do so. The Association will take the Petition to Delhi High Court shortly"

As if the case was heard in the court and the Honble Supreme Court advised them to go to Delhi high court first and given them liberty to do so. Now Read below what is uploaded in Supreme court website.

Why to fool and cheat the the pensioners ??  Further the petitioner of the case is 439 other pensioners apart from the GS of the Association. The case came up for admission hearing today in court no 4. The case is not admitted and disposed off. We produce below an extract from supreme court site. It may be interesting to note that inspite of claiming to file the case on representative capacity, there are so many applicants perhaps only the leaders and their close associates.. It is known to all that the Judgements of such cases are coming in favour of applicants only. And here the leaders and associates have secured their position leaving behind the mass from whom they collected more than 10 lakhs of rupees.*
 
*It is therefore established that the legal path taken by AIRBSNLEWA is the correct one where they have made every Pensioners , who contributed , an applicant.*

05.02.2018                  *Meeting with CGM WBTC on Medical issues*
Today afternoon we met on a pre scheduled meeting with Sh Shyam Narayan CGM WBTC. PGM (Fin) & GM (HR) were also present. The problem of medical facilities to Pensioners were discussed. 
We pointed out that payment of without voucher cases are pending in almost all SSAs for the Pensioners retired before August 2014 i.e. implementation date of ERP in WBTC. With voucher cases are pending for last one year throughout the circle. The main problem is entering personal data of Pensioners in ERP system. 
CGM after detail discussion has instructed to issue necessary office order to expedite the job in all SSAs. We requested to fix up a target date for disposal of the pending load. CGM agreed to examine it.
We further discussed the issue of empanelment of Hospitals for cash basis treatment as per CGHS rates in all SSAs in accordance with BSNL CO order. CGM informed that in kolkata DESUN and IRIS has been Empanelled for treatment at CGHS rate on Cash Basis and effort being made to empanel more Hospitals. The order of BSNL CO will be endorsed to all SSAs with the instructions to empanel Hospitals there.

We also met GM(HR) CTD and requested him to complete the empanelment work of 55 more Hospitals in the list of 233 Hospitals. We requested to take a drive to empanel as many as Hospitals possible for cash basis treatment at CGHS rates. We request to issue suitable letters for both the cases and assured our co operation for the same. GM called the SDE HCU and instructed him accordingly
31.01.2018    FIRST MEETING OF HYDERABAD DISTRICT BODY 

Good evening Friends Today  we have successfully conducted our first E. C meeting of HYD branch at BSNL Bhavan. Our meeting addressed by Circle president, Secretary& AGS. we have compelled to co-opt Sri V.Divakara Rao as Treasurer&Y.v.b SuryaprakashRao as Assistant Treasurer due to back out of Elected office bearers. Sri P.Satyanarayana co-optd as Organising Secretary. E.c formd  Sri M.N.Rao as convener, Y.v.b Suryaprakash &K.L.N NageswaraRao  to. co-ordinate  Court cases. New body also met PGM HTD, GM Finance &H.R of HTD as courtesy call. Regarding Medical bills I.T matter under persuasion by circle Secretary. 19 members along with circle body attended. All participated actively. Opening of bank account &Streamlining membership is primary task for new body. We have got strong backup from CHQ .pl try to bring back all Executives to our Assn. Which only can serve better in the prevailing circumstances. I once again Seek all your co-operation to Strengthen our Assn.Thank you All..

26.01.2018      MERGER MEETING AT HYDERABAD  
The biannual conference of Retired Excutives’ Welfare Association (REWA) BSNL HYD was held on 08/01/2018 at Vasavi Club, Lakdika pool, Hyderabad- TS under the president ship of Com.N Koteswara Rao. REWA   is a  registered body has no CHQ/CIRCLE bodies and was functioning  at Hyderabad with around 250 members from all disciplines of BSNL executives . The meeting was attended in large number and on the invitation to CHQ Com. Amit Kumar Gupta AGS AIRBSNLEWA and Com Jairam K   AGS who is also VP in REWA have attended and addressed the gathering. Conveyed  congratulations  and  best wishes to the conference. Secretary Com Pandurangarao presented secretaries report briefing the activities carried out during the period. In his report he has mentioned the necessity of merger of REWA BSNL HYD with AIRBSNLEWA and thanked the General Members for having decided to aligen with all india association and with AIRBSNLEWA in particular. He also thanked the Com. Kishan Singh and his team for readily accepting our proposal. Com. Padma Reddy VP also addressed the GB.
Com. Jairam K   AGS(S) has covered various issues tackled by the REWA sply the 78.2 DA merger for pensioners and medical bills etc., He also elaborated on the merger of REWA with AIRBSNLEWA and thanked all members for taking a constructive decision in the interest of welfare of the members. Com. Amit Kumar Gupta AGS has congratulated the office bearers of REWA for deciding to merge with AIRBSNLEWA and thanked for inviting to be at the historic conference of REWA and also welcomed members of REWA to AIRBSNLEWA which is lead  by GS Com. Kishan Singh under the guidance of chief mentor & GS AIBSNLEA Com. Prahalad Rai. Com. Amit K Guopta has enlightened the house on important issues like pending court case on getting pensionnary benefits based on 78.2 DA merger, 3rd PRC,medical reimbursement etc., he had interactive session with the members and clarified the doubts expressed by the members on various issues. 
The meeting started with self introduction, paying tributes to the departed com's, opening remarks of president com. N Koteswararao, Secretary Com.Pandurangarao's report, Treasurer's report, address by Com Jairam as a AGS & Com.Amit Kumar Gupta AGS of AIRBSNLEWA, felicitations to Sr com's who are at 75 or going to be 75 years by this year end among these com's veteran com's  Thanareddy & Padmareddy were also there. Reassembled the house after lunch break and completed leftover agenda. The important point was merger of REWA BSNL HYD with the AIl India Retired BSNL Executive's Welfare Association (AIRBSNLEWA)  which was approved by the GB. The merger was announced by AGS Com Gupta on behalf of CHQ and declared as a  Adhoch Circle Body of both the States. The GB unanimously approved the continuance of the existing REWA office bearers till the new body is elected through its circle conference at later date. The GB also elected HYD Branch with Com Sivaramudu as a President, Com K Dakshina Murthy as Secretary & Com Mdm. Bharati as Treasurer along with other office bearers. The GB had interaction with Com.Amit Kumar Gupta on various pension related issues. On behalf of CHQ Com Jairam and Com Amit Kumar Gupta have congratulated the members and informed the CHQ quota formalities to be followed by the new circle. Later oath was administered to the office bearers of  HYD Branch .

23.01.2018                             Meeting With PGM(Fin) WBTC  
Today PGM{Fin) WBTC called all Pensioners Association for a meeting to discuss the ways means to recover the outstanding amount. Apart from our Association representative of AIBDPA and AIBSNLREA represented. We suggested that the database of the defaulters may be indexed addresswise and then may be assigned to the employees of that area to convince the customers to make payment. If the Pensioners of those areas are asked to assist they shall certainly extend help to recover the outstanding. It was pointed by all Associations that organizing collection drive exclusively by Pensioners is difficult without involvement of serving employees.
 We took this opportunity to discuss the ongoing burning medical issue of the Pensioners. GM appreciated the problem and decided to take remedial action.
 
 21.01.2018                           Special General Body meeting of UP (East) Circle*
 
A well organized General body meeting  of  “ALL INDIA RETIRED BSNL EXECUTIVES’ WELFARE ASSOCIATION” UP(East)  Circle  was held on 20th January 2018 at Laplace Hazratganj, Lucknow in the presence of our AGS & CHQ Organizing Secy. Hundreds of pensioners attended the meeting which lasted more than three hours.
The meeting started with the opening remark of Circle President Com S.M.Abbas. Following that, 10 new members were introduced by the Dist. body Lucknow.
Com Pallab Bose, Circle Secretary, in his address informed the house this is the only Pensioners Association which is actually fighting for all issues of pensioners irrespective of their executive or non executive status.. He further informed the members regarding the latest development of our court case pending in Principal CAT. 
He mentioned that 78.2% IDA payment & medical payment (without voucher) has been provided by the dept. to all pensioners in UP (E) till now. 
He further mentioned that the without voucher system will be continued and necessary orders will be issued next week. Those who want to change their opinions may do it in March every year.
He told that the association will try to protect the rights of pensioners at any cost.
Circle Secy. Bose told that he has learned through reliable inside sources that the MTNL board has sent their consent to DoT for merger of MTNL with BSNL. Our MOC has also been interested in merging MTNL with BSNL. He further told that Govt. of India is not favouring BSNL by all means. They are favouring certain PVT operators indirectly. The formation of tower company and appointment of an IAS officer as CMD is an alarming signal for BSNL & MTNL employees alike.

He mentioned that our association AIRBSNLEWA is the strength of BSNL Executives Pensioners.* He appreciated the AIRBSNLEWA UPE team for their consistent working & devotion towards pensioners specially Com Kishan Singh GS, Com Amit Gupta AGS, Com Pradeep Goyel AGS, Com D.N.Verma Org. *Chief Mentor AIRBSNLEWA Com Prahalad Rai in his address apprised the efforts in the formation of AIRBSNLEWA to protect the interest of BSNL pensioners and appreciated our efforts for pension revision, medical and other personal claims, etc. He also remarked that in true sense AIRBSNLEWA is safeguarding the interest of BSNL pensioners, by settling day to day problems related to BSNL pensioner
He told that, he along with General Secy. AIRBSNLEWA, Com Kishan Singh have discussed the issue regarding revision of pension for BSNL pensioners with concerned officers of DoT. He has requested to consider revision of BSNL pensioners and de-link it with the revision of pay scale of BSNL Employees, since, BSNL pensioners are in no way related with the profit and losses of the BSNL. The pension contribution has already been paid to DoT during their service, so now there is no justification of linking revision of pension with pay revision. He explained the reason behind the pension revision of BSNL pensioners before 3rd PRC implementation.  

 
*Com Prahalad Rai assured that his Association AIBSNLEWA will provide constant support to AIRBSNLEWA with all their issues related to pensioners, specially pension revision. He remarked, “3rd PRC ke pehle, pension revision jaroor hoga”.*

Com Prahlad Rai GS AIBSNLEA and chief mentor AIRBSNLEWA with  President AIBSNLEA met DDG (Estt.) DoT and

 
A) discussed regarding revision of pension for BSNL pensioners. They requested to consider revision of BSNL pensioners de-linking with the revision of pay scale of BSNL Employees since, BSNL pensioners are no way related with the profit and losses of the BSNL. The pension contribution has already been paid to DoT during their service, so now there is no justification of linking revision of pension with pay revision. DDG (Estt.) mentioned that they are waiting for the decision on pay revision of BSNL executives and thereafter pension revision of BSNL pensioners will be processed. He explained the reason that incase the pension of the BSNL pensioners is revised before 3rd PRC implementation  then the pension of the  pensioners retired after 01.01.2017 will be lesser which will create anomaly. We explained that some formula has to be evolve by DOT to revise the pension and to avoid such anomalies. DDG (Estt.) assured to look into the matter.

 
B) Delay in settlement of pensionary benefits of BSNL pensioners who retired after July-2017 on the pretext of DoT letter dated 05.07.2017. We explained that against DoT letter dated 05.07.2017 stay order has been granted by Hon'ble CAT Jaipur in favor of 28 applicants and Hon'ble PB CAT New Delhi has also allowed the OA filed by AIBSNLEA requesting to quash the said order of DoT dated 05.07.2017. DDG (Estt.) mentioned that a clarification is being issued to BSNL and CCAs to settle all the pension cases on the basis of DoT letter dated 05.07.2017 immediately and the cases of the applicants in the court may be decided subject to outcome of the court cases. He assured to issue this instruction in next week itself. The 28 applicants in Jaipur CAT Bench has filed contempt of Court which will be heard in the next week and the judgement in Hon'ble PB CAT New Delhi is expected to be delivered in the next week.

 
Afterwards they met Shri A.N. Rai OSD to Hon'ble MOSC (I/C) and discussed regarding implementation of 3rdPRC in BSNL and revision of pension. OSD to Hon'ble MOSC (I/C) after detailed discussions appreciated our concern and mentioned that he will discuss the matter with the concern officers in DoT for an early decision in the matter and will bring in the kind notice of Hon'ble MOSC (I/C).
08.01.2018  COURT CASE FOR PENSION ARREARS  
 
Court case no.2260/2017 for pension arrears came up In register court of Pr CAT. Resp no.1 DOT asked for more time. Our Advocate objected strongly that sufficient opportunity has been already given and further time not to be given. Resp 2 BSNL informed that MA is ready for deletion of its name from respondent list and will filed in a week. Register Court didn't allowe any time to respondent no 1 DOT. BSNL is given 1week time for submission of MA. The is now forwarded to regular Court in Pr.CAT for further hearing on13/02/2018. BSNL wanted to eliminate its name from respondents list as according to them they are not related to this case. We shall object to it in due time as the responsibility of paying leave encashment arrears lies with them only.

The procedure in Pr CAT New Delhi is, once a case is filed it is taken up in a regular bench and after admission it is transferred to Register Court for filing reply counter reply etc. Once that procedure is completed the case is transferred back to main bench for further hearing and direction.
 
Similarly our cases was also heard by court no 3 on the first day. In fact we have filed two cases. MA 2424/2017 and OA 2260/2017. First One for allowing all 1199 applicants as one application and second one for pension arrears. First application was allowed on first hearing and second one was sent to register court. Now the second case is transferred back to main bench and most likely it will heard by court no 3 on 13-2-18.

06.01.2018     YEARLY  FAMILY  PICNIC  OF WEST  BENGAL  CIRCLE     
As scheduled the yearly family Picnic of West Bengal Circle was arranged on 06-01-2018 at the bank of River Ganges. It was an old heritage building taken over by KMC and now used as pumping station. Total 255 members with their family participated out of which 90 were lady members. there was a day long fun , sports events, singing, recitation, music. All enjoyed the picnic. <<Glimpses>>
04.01.2018 GENERAL BODY MEETING OF NASHIK BRANCH   
The general body meeting of AIRBSNLEWA was held on 28/12/2017 in Hotel Gokul  under the president ship of com. S. N. Kulkarni. The meeting was started with giving tribute to departed members late A. B. Gadkari , A. K. Pathak , Shaikh AGM circle office. The branch secretary com. M. L. Deore welcomed the members and new members. The branch secretary briefed the house the status of 3rd PRC. The issue of 78.2 % IDA revised PPO. Very few cases i. e. 3-4 are pending and follow up is taken. The issue of without voucher medical claim was discussed. There is abnormal delay for the payment of without voucher medical claim. The issue was discussed with GMT Nashik in the last meeting and he issued necessary instructions to the concerned. Our WTR members also complained for non receipt of payment of w/o medical claim. Case will be taken with appropriate authority.
                Total 30 new members added in the last month. Our circle organiser com. S. S. Dhangar played very important role to increase the membership. We appreciate his concerned to work hard to  increase the strength of our association. The com president S. N. Kulkarni addressed the house. The branch secretary gave New Year wishes to the members

The Representations received so par by this Association to refund the deducted money at the time of retirement as per  Supreme Courts Order has been submitted to PGM(Estt) BSNL CO and also to respective CGMs for taking immediate action. <<LETTER>>
14.12.2017   Status update on the Rule 206 seniority issue of TES Gr. B Officers pending in the Hon'ble Supreme Court of India:

The captioned matter C.A. No. 4389/2010 and connected matters  were listed today as Item No. 101 in Court No. 11 before Hon'ble Justice A.K. Goel and Hon'ble Justice U.U. Lalit at the Hon'ble Supreme Court of India. This was consequent upon implementation of Hon'ble Supreme Court Order dated 21.01.2015 and recommendations of the Expert Committee and after hearing all the parties Hon'ble Supreme Court passed orders that no further orders are required after the recommendations of the expert committee.

However, the Hon'ble Court allowed the prayer of BSNL with regard to payment of arrears that nop arrears be paid but pay finalization with their seniority be re-fixed and be paid same from 01.01,.2018. It will also include pensionary benefits.

So far 45 SDEs promoted in 1993 are concerned, out of them 3 are in BSNL and 11 are in MTNL,  their promotions will not be disturbed since their promotions is already protected in earlier judgment.

14.12.2017                 *Meeting with Director (HR) at Kolkata.*
 
Sitanshu Sarkar our Circle Secretary West Bengal had a meeting with Smt Sujata Ray Director HR BSNL who is on official tour at Kolkata. He joined the AIBSNLEA team in the meeting and placed the problems of Pensioners.
Director HR was very anxious on the issue of 3rd PRC still he heard the problems of Pensioners and assured to do the best.
She met all the unions in phases and requested not to go on strike rather do something to make BSNL profitable so that 3rd PRC can be implemented.
It is understood that DOT has given two condition for 3rd PRC implementation. *Lower the retirement age to 58 or make the company profitable*. BSNL is not ready to lower the retirement age and going for the other option all-out.
13.12.2017    *Medical Allowance Without Voucher*
 
Today GS AIRBSNLEWA Com Kishan Singh Met GM(A) BSNL CO and discussed about continuation of without voucher system. GM (A) mentioned that the without voucher system will be continued and necessary orders will be issued next week. Those who want to change their opinions may do it in March every year.
 
[:                      *Pension Revision of BSNL Pensioners*
 
Today GS AIRBSNLEWA Com Kishan Singh Met DDG(Est) DOT and discussed about Pension Revision of BSNL Pensioners. DDG (ESTT) opined that unless pay is revised for BSNL employees , Pensioners pension will not be revised. Com GS stressed that BSNL Pensioners are getting all benefits as per CPC recommendation then why their pension will not be revised as per CPC formula. DDG (Est) mentioned that in that case there will be anamoly between the Pensioners retired before and after 2017. Therefore there is total uncertainty on our pension revision.

 07.12.2017    *Meeting with GM HR CTD on Medical and Hospital empanelment.*
Our office bearers OF West Bengal met and discussed the issues in details with GM HR today afternoon. We enlightened him about the harassment caused to the Pensioners. GM mentioned that he is aware about the harassment caused by some areas and in yesterday's CGM's meeting with areas , CGM has issued strict instructions to stop this harassment to the Pensioners and settle their dues immediately. However following are decided in the meeting.
 
1) GM HR will ask for detailed report from Areas on pending cases both with or without voucher. Names of the Pensioners with details and reasons also will be asked for with voucher cases. 
Newspaper notification will be issued to inform all Pensioners to submit KYC details as required in ERP system. Also Areas will be instructed to contact all the Pensioners for submission of the form.
 
2) 66 more Hospitals will be added in the list of 233 Empanelled Hospitals after verification. Private renowned Hospitals will be approached for extending treatment at CGHS rate and agreement will be made with willing Hospitals.
 
*Today we have observed a change in attitude of the CTD management. In earlier meetings, we were asked to site the examples of harassments but today we felt that the realisation of the Management on Pensioners issues.*

"23.11.2017     Meeting with Addl. Secretary (Telecom), DoT on 22/11/2017
:
GS Com Kishan Singh and President Com Rakesh Srivastava along with the GS and President of AIBSNLEA met Addl. Secretary (T), DoT and discussed regarding Revision of the Pension of BSNL Pensioners.
 
 We submitted a memorandum for  Revision of Pension w.e.f. 01/01/2017,  of  around 2 lakh  EX-DOT Employees, who opted for absorption in BSNL  w.e.f. 1/1/2000 &  retired as BSNL Pensioners  and are drawing pension on IDA scales based on 7th CPC recommendations/ fitment formula.
 
We requested AST to get the issue of  pension revision of BSNL Pensioners delinked  from the pay revision of BSNL Employees because we are in no way governed by affordability clause applicable to  BSNL.
 
AST understood and appreciated our point of view that Pension revision of Ex-DOT Employees retiring as BSNL Pensioners should be carried out and he shall get the modalities for the same examined and expedited. The view of DDG(Estt.), DOT was also discussed, who opined that   the revision of pension of BSNL pensioners shall be considered after the pay revision of BSNL serving employees on implementation of 3rd PRC recommendations otherwise, there will be a disparity in the pension of the BSNL pensioners who will retire later on. AST after giving patient hearing   marked our Memorandum  immediately to the concerned section for taking an early action to resolve this issue.   <<CLICK FOR MEMORANDUM>>
 
  17.11.2017    Meeting with Sh. A.N. Rai, Advisor to Hon'ble MOSC(I/C)*
 
GS, President AIBSNLEA & GS AIRBSNLEWA met Sh. A.N. Rai, Advisor to Hon'ble MOSC(I/C) on 16-11-17 & discussed regarding implementation of 3rd PRC in BSNL & revision of pension of BSNL Pensioners. They requested to use his good office in resolving these issues in DoT. Advisor to Hon'ble MOSC(I/C) immediately spoke to DDG(Estt.) DoT & discussed the matter that why there is a delay in revision of pension of BSNL Pensioners.
 
DDG(Estt.) DoT explained him that 3rd PRC implementation in BSNL is under consideration & till their is a decision in this regard, the pension revision is kept pending. Advisor to Hon'ble MOSC(I/C) assured him to atleast process the case. Advisor to Hon'ble MOSC(I/C) assured to arrange our meeting with Hon'ble MOSC(I/C) at the earliest to discuss the matter.
 
Then they met Sr. PPS to Secy(T), DoT & Addl. Secy(T), DoT & requested for grant of meeting to our Associations. *The Addl. Secy.(T) meeting time is fixed up on 22nd Nov., 2017 at 14.30 hrs. & with Secy(T), DoT at 17.00 Hrs. to discuss the pressing issues.*
 
Afterwards they also met with *Sh. Prabhas Kumar, Member (S), Telecom Commission, DoT* and discussed regarding implementation of 3rd PRC & revision of pension of BSNL pensioners. Member(S) after discussions assured to discuss the matter with DDG(Estt.) for an early action.
14.11.2017  DIGITAL LIFE CERTIFICATE   
The November Month is the month of submission of Life Certificates for the pensioners. This year in many Banks /CCA offices there is camp for collecting Digital Life Certificate (DLC). We have noted that there is a confusion amongst the pensioners on the method of functioning of the system and many pensioners are submitting both DLC and conventional life certificates. we are uploading following FAQs from the official portal https://jeevanpraman.gov.in and hope that the doubts of the pensioners will be cleared to a great extent and they will get a clear picture on the system.

02.11.2017  EMPANELMENT OF HOSPITAL FOR CASH BASIS TREATMENT AT CGHS RATE:
Due to consistent effort by AIRBSNLEWA ,Calcutta Telephones has finally notified one hospital (Desun Hospital) for Cash Basis Treatments at CGHS rate. After the treatment the beneficiary has to take a certificate from the Hospital that all rates taken are as per CGHS rates and also a certificate that the treatment was conservative or package indicating package name no as per CGHS list. This will ensure smooth reimbursement. This has marked the beginning of a new system where medical facilities will be extended to employees and pensioners without any hustle.
Our West Bengal Circle is negotiating on this issue since last one year. As in this system the expenditure incurred will be much less and will be fully reimbursable. They were expecting empanelment of more hospitals in this system. But due to some problem at present agreement is signed by Desun only. They are expecting that B M Birla Heart and Charnok Hospital will also be empanelled in this system very soon. R N Tagore has denied at the last moment as they want CGHS NABH rate although their NABH certificate has been expired. They are trying to agree some more private hospitals for extending treatment on cash basis at CGHS rates.  <<<ORDER>>>
