with Member ( Finance ) DoT:-
Comrade Prahlad Rai GS and Comrade Kishan Singh ji President
met with Member( Finance) DoT and invited him as Chief Guest
to attend CWC meeting on 6th August-2022. Member (Finance)
assured to make it convenient to attend the meeting . We
also requested to give finance clearance to the proposal of
pension revision of BSNL pensioners moved by DoT Estt cell.
We apprised him that two days before Estt. cell has sent the
file to the DDG Finance DoT clarifying their queries
received from PSU cell. Member Finance assured to discuss
the matter with DDG Finance Forman early clearance. (b)
Submission of documents by BSNL pensioners to respective
CCAs to complete KYP and preparing ID cards. We further
explained that all the necessary information are available
in the PPO book of pensioners and from there necessary
information can be taken by respective CCAs instead of
calling pensioners in CCA offices. Member Finance assured to
discuss the matter with Pr CCA Delhi for its settlement. |
29.06.2022 Meeting
with DDG Accounts and DDG Finance DoT:-
Comrade Prahlad Rai GS AIRBSNLEA
and Comrade Koshan Singh Ji President met DDGs Accounts and
Finance and requested for early clearance of the Estt cell
proposal on pension revision of BSNL pensioners. DDG
Accounts Shri Rajeev Kumar ji mentioned that pension
revision issue is being dealt by DDG Finance only.
Immediately we met DDG Finance Shri Rajeev Kandpal ji and
requested him for the early clearance of the proposal. He
immediately called Director Finance cell and asked him out
up the proposal. He assured that within 3-days proposal will
be cleared from his good office .He mentioned that you
senior citizens should not take this much of trouble to
visit DoT on this issue. We extended thanks to him for his
positive concern.

29.06.2022 Meeting
with Director Estt. DoT:-
Comrade GS and President met
Director Estt. DoT and enquired about the status of pension
revision file in DoT. Director Estt. informed that after
receiving the file from PSU cell it has been sent to Finance
wing of DoT for clearance two days before. He also mentioned
that after the clearance of Finance wing the proposal will
be sent to DoP&W for comments.

Director (HR), Sr GM Esst and GM Admn BSNL also. |

Circle Conference of AIRBSNLEWA Gujarat at Ahmedabad

First Circle Conference of
AIRBSNLEWA Gujarat commenced. Comrade Prahlad Rai, General
Secretary AIRBSNLEWA-CHQ Comrade S Rama Murthy Chief Petron
AIRBSNLEWA, Maharashtra Circle attended and addressed the
said meeting. Comrade S R Mishra, Circle President welcomed
the members and special guests. He also explained that due
to Covid-19 Pandemic situation the said Circle Conference
could not be conducted for the last two years. During his
Presidential speech he covered so many issues of members
which are already resolved by his efforts during last 4
years.
Today he also told that: We are happy that on a short notice
our beloved General Secretary and Chief Patron
AIRBSNLEWA-Maharashra Circle are available with us in this
meeting. Comrade Amalendu Guha Circle Secretary in his key
note address explained the organizational activities,
membership strength. Comrade Amalendu Guha Circle Secretary
also apprised in detail the status of various District
Branches and the issues being taken up at Circle level.
Comrade Prahlad Rai,
General Secretary in his address explained in detail the the
status of All India level issues e.i court cases on Pension
Revision Revision, DA arear case of 78.2 percent fitment
benefit w.e.f.01-01-2007 instead of June -2013 , CGHS
migration system, Pending Medical Claims etc. The Hall was
packed and more than 160 Members attended the said Meeting.
Comrade S R Mishra Circle President AIRBSNLEWA, Gujarat
extended vote of thanks. Delicious Lunch was also served to
the Members. The said Meeting was conducted very nicely.
All the queries of
the members were replied by Comrade Prahlad Rai ji, General
Secretary, AIRBSNLEWA CHQ satisfactorily.

of pension revision case of BSNL pensioners in DoT:-
Comrade Prahlad Rai GS AIRBSNLEA
today discussed the matter with the concerned Officers of
Estt. cell of DoT and found out the status of pension
revision case. It is informed that the file from PSU cell of
DoT has been received in Estt. cell with a comment that pay
scales of BSNL- MTNL employees have not been notified due to
affordability clause of 3rd PRC. Now Estt. cell will further
send the matter to internal finance of DoT for
consideration. Estt .cell has processed 4-5 proposals on
pension revision eg. on CDA pay scales, IDA pay scales
anomalies issues etc. Comrade GS will meet the DoT concerned
Officers including Member (Services) and Member (Finance)
after returning form Gujarat Circle conference and Udaipur
District Conference Rajasthan Circle. |

18.06.2022 Opening
of CGHS migration window second time from BSNL MRS by BSNL
CO ND:-
Comrade Prahlad Rai GS AIRBSNLEWA
yesterday discussed with GM Admn BSNL CO regarding opening
of CGHS migration window second time from BSNL MRS. We
explained that BSNL CO is allotting funds to Circles for the
one time payment of CGHS reimbursement but the Circles are
not reimbursing the dues. GM Admn BSNL CO appreciated our
concerns and mentioned that Admn cell of BSNL CO is moving a
proposal to open migration window from BSNL MRS to CGHS
second time wherein BSNL pensioners may give options to
migrate from BSNL MRS to CGHS facility upto 31st July-2022
.After the approval of the competent authorities the
necessary orders will be issued immediately. He advised that
now remaining BSNL pensioners should give options to migrate
from BSNL MRS to CGHS. The one time Payment paid will be
reimbursed upto 31st August-2022 positively.

15.06.2022 Meeting
with Joint Secretary (Admn) DoT:-
Comrade Prahlad Rai along with
Comrade M K Bagchi, Chief Patron and Comrade A K Kaushik
Legal Adviser CHQ met with Jt Secy Admn, DoT Shri
S K Vermaji welcomed him on joining the high office of J
S Admn DoT and requested him to reply the queries made
by internal finance wing of DoT on pension revision of
BSNL pensioners. We apprised him regarding finance
queries wherein it has been asked from PSU wing that
when the notification of 3rd PRC pay scales in BSNL and
MTNL are being issued, without the notification of pay
scales the pension contributions on revised pay scales
can not be done.We explained that pension revision
should be considered on the basis of 7th CPC pension
revision formula since 3rd PRC donot have any pension
revision formula. After detailed discussions J S Admn
assured to look into the matter. |

with Director (Esst) DoT:-
Director Esst DoT informed that
the queries made by Internal Finance of DoT has been
sent PSU section to clarify. Director Esst mentioned
that as soon the reply from PSU unit is received it will
be sent Finance wing and thereafter to DoP&W for
clearance of the proposal

with Director (HR) BSNL Board:-
Comrade Prahlad Rai GS AIRBSNLEWA,
Comrade M K Bagchi met Director (BSNL) Board and
discussed regarding Pension revision of BSNL pensioners.
Director HR informed that there were discussions in DoT
with the Concern Officers wherein BSNL has suggested the
formula to avoid anomalies in the pension of post
retired employees after 01-01-2017 by fixing pay on
notional basis wef 1-1-2017 and actual on the day of
retirement. But DoT finance wing has agree with the
proposal. (b) Payment of pending medical claims of BSNL
pensioners: We expressed our serious concern against the
non payment of long pending medical claims .Director HR
appreciated our concerns and mentioned that in
March-2022 Rs 56 carores were released on this account
and the pending medical claims upto December-2019 were
cleared. Now on receipt of more revenue
efforts will be made to clear
pending medical claims upto December-2021.At present the
revenue collection position is not good in BSNL.

the the same instructions like second wave of Covid -19
to clear the Covid treatment bills of first wave also.
GM Admn mentioned that already CGMs have been empowered
to clear such Bill's without the visit note of concern
BSNL Officer on the same pattern of Second wave
treatment bills. However, in case the cases are not
resolved at Circle level then may be sent to BSNL CO for
consideration. |

with Member (Services)DoT:-
Comrade Prahlad Rai along with
Comrade M K Bagchi, Chief Mentor and Comrade A K Kaushik,
Legal advisor CHQ met with Shri Nizamul Haq, Member
Services and discussed regarding pension revision of
BSNL pensioners. We requested for early reply to DoT
finance wing queries on pension revision issue. Also
explained the justification of pension revision by
de-linking from pay revision of BSNL employees. Member
Services have patient hearing to our pleadings and
assured to discuss the matter with the concern Officers
of DoT. We extended our sincere thanks to Members
Services for sparing his valuable time to understand the
issue and granting the meeting. Member Services
mentioned that Mr Prahlad Rai as AGM and DGM NWP CFA in
BSNL CO has worked under him and he is always available
to hear our issues.

Special General Body meeting of All India Retired BSNL
Executives Welfare Association was held on 28th
May 2022 at 15.00 hours in the Kalabrahma Auditorium,
Telephone Exchange Building, Kalatalav, Kalyan West, with an
Open Session.

MMR-Kalyan Branch in his welcome address briefly narrated
about the history of formation of AIRBSNLEWA MH Circle body.
The meeting was attended and addressed by many distinguished
guests including Three Great stalwart General Secretaries of
Retired employees associations, addressing the CEC by 3 GS
was one of the unique and rare attraction, members got their
knowledge and information updated by great informative
speeches by all stalwarts, prominent personalities who

Session started with “Deep Prajawalan” and Ganesh Vandana by
distinguished guests, thereafter observing 2 minute silence
in the memory of our departed comrades. All the
distinguished guest on the dias were felicitated by
presenting with Flower bouquet and Shawls. All the
leaders of other union/associations and prominent senior
comrades and senior officers were also felicitated by
presenting the bouquet.
Keeping alive the glorious tradition of Kalyan alive,
District secretaries of SNEA, AIBSNLEA, BSNLEU and NFTE who
were prominently present in the meeting had also felicitated

Manani.
In the opening remarks by Circle President Com C.M Saste
highlighted about the pending issues of the retired
Executives’/non executives of BSNL viz. revision of pension,
issued of PPOs at Circle Level, settlement of Long pending
Medical Bills, revision of CGHS rates etc.
Com A R Manani
CS submitted his detailed report on organizational matters
of Circle Branch of AIRBSLEWA along with district-wise
membership details.
He in
report has elaborated about his efforts in settlement of
cases of discrepancies in pension. He also mentioned about
216 individual cases were resolved amicably by this
association mainly related with CCA MH such as: individuals
Pension mismatch, EPPO not generated, corrections in EPPO
particulars, Family, Spouse, nomination related issues,
correction in Bank account, change of branch, DLC related,
Excessive Income tax deducted, delay in Gratuity payment
delay in final payment of GPD accumulations, non issue of
pension slips, form 16 etc.
He
also mentioned about the issues raised with CGM MH circle
reg: Quarter retention behind 8 months, pending medical
claims including payment of FMA of Rs 1000 since 2019,
claims pending, TA bills, Furnishing allowance, etc pending
since 2018. CS also highlighted about pending vigilance
case in MH, which are still not completed even after
completion of more than 2 years, most burning issue of the
present pending issue of about 212 MH retirees belonging to
ST category who had still not received their any of
retirement benefits which are held up illegally on the
pretext of getting validated their Caste certificate. He
mentioned that after lot of correspondence about 12 letters
at CGM and at BSNL CO level where GS had also took his
efforts by meeting almost every competent level and
highlighting this issue, now after 28 months long wait,
ultimately this issue is on the verge of settlement, but
still we are watchful as not a single division still had
released payments. He also mentioned about issue of
Identity card for pensioners which still not released by
many divisions citing short of funds and short of staff.
He mentioned that during the period Association had written
total about 59 letters to CCA MH,CGM MH, GM HR,CGM WTR/WTP,
PGM Kalyan, PGM Nashik, GM Jalgaon, A/D CGHS & to GS
AIRBSNLEWA.,
CS
also briefed about various meeting held with A/D CGHS for
opening of new wellness centre at Nashik, Aurangabad and
either at Kalyan/Dombivali/Panvel. He appreciated the
efforts taken by Com M.L.Deore, for getting the CGHS
wellness centre at Nasik, which finally succeeded in last
year and CGHS wellness centre has also been opened at Nashik
and now waiting to get it opened at Aurangabad and Thakurli
( in between Kalyan-Dombivali).
One of
the most burning issue of today for pensioners is issue of
PENSION REVISION: CS requested GS to elaborate in
detail about status of this case and negotiation going on in
DoT, BSNL, DPE on this matter, CS also raised issue of
increase in Medical reimbursement ceiling for OPD as
recently BSNL instead of increasing this ceiling had
reduced it from 15 to 12 days , Exploring the
possibility of making tie up with Mediclaim insurance
companies for pensioners just like recently BSNL had
launched for its working employees, that may be for all
BSNL MRS card holders or even for CGHS card holders.
Empanelment of more & more Hospitals under BSNL MRS and CGHS
too. Inordinate delay in clearing CGHS Payment to
PVT hospitals , because of which many reputed hospitals are
not coming voluntarily for empanelment, beside there is
short of supply of essential routine medicines, even quality
of some medicines is very poor, expiry day is very near,
means may expire within days of supply to the CGHS
beneficiaries.

addressed the house in his unique style, he expressed
satisfaction that association under Shri Prahlad Rai is
doing good things for pensioners of all castes, creeds and
has great experience of so many years behind him, he
requested GS to look into one recent letter from Ministry of
Personnel, public grievances & Pension DoP & Pensioners
welfare letter dated 20-05-2022 for granting some facilities
and financial support to welfare associations of
Pensioners. He
emphasized the need of coming all Associations of Pensioners
into a common forum to achieve common interest of revision
of pension & pay revision etc.

Yadav GS RTOWA MTNL Mumbai
has
informed that
Smt. Vibha Govil Mishra has taken over the charge of CCA
Maharashtra & Goa who is very positive and transparent
approach in attending and settling the grievances of the
pensioners and advised to take benefit of her positive
approach and settle all the pending issues of pensioners of
Maharashtra Circle. He mentioned that in MTNL
they had
brought transparency in CCA working and all complaints
booked are available on portal with status report. He
expressed his
happiness that BSNL & MTNL are fighting unitedly for the
common cause of revision of Pension and other related
matters.
Finally
eagerness of everybody was over when name of Com.Prahlad
Rai GS AIRBSNLEWA was announced as next speaker, under
thundering applauses he started his marathon speech
expressing thanks to organizers by organizing such a grand
well attended meeting of pensioners he had rarely seen, he
reminded everyone with the timing of formation of BSNL in
2000 and preconditions, he narrated each and every step
right from the formation of BSNL days to present BSNL, He
assured to take care of all the issues raised by MH comrades
through CS report.
GS Comrade Prahlad Rai
spoke elaborately regarding the formation of AIRBSNLEWA
association in 2010 and thereafter association’s continuous
in perusing & settlement of issues of retired employees of
BSNL. With regard to issue of Pension Revision w.e.f.
01.01.2017 he explained that the latest developments are
being updated to all our members through website and
whatsapp messages. He reiterated that the DOT has to accept
our demands, as the Govt has already clarified that the
payment of pension to retired BSNL Employees is the
liability of DOT and since DOT has already implemented the 2nd
PRC recommendations by revising pension to BSNL pensioners
retired between 1-10-2000 to 31-12-2006.
While interacting with the
members Com Prahlad Rai clarified that:.
Once
case of pension for the pensioners retired upto 31-12-2016
is settled, Govt has to accept the revision of pension for
the employees retired on or after 1.1.2017 and on the basis
of notional pay (as per 2ndPRC) pension at par
with the pensioners retired upto 31.12.2016 ( i.e. 50%of
notional pay + fitment benefit at par with the pensioners
retired upto 31-12-2016) he told as per 7th CPC
now there is PRC to settle our pension revision case,
association along with other likeminded associations is
fighting this case legally at Delhi PBCAT for which we
require legal funds. Hence an appeal was made to all to
contribute at least Rs.1000/- as Legal fund to fight the
case to its logical end and simultaneously pressurize Govt
to agree on delinking of Pension revision of retired
employees with grant of Pay fixation of working employees,
there should not be any affordability clause for retired
employees as BSNL had already paid the pension contribution
on highest of pay scale to the Govt..
Regarding payment of pending medical bills and other TA
related bills by BSNL he assured that, he will strongly
pursue the cases of payments by Ministry of Health to CGHS-Empanelled
hospitals, revision of CGHS rates etc, vigorously with the
senior officers of health ministry

Prahlad Rai praised the efforts of AIRBSNLEWA MH Circle in
settlement of cases of pension discrepancies and other
related matters. He appealed all the members for increasing
the membership and supporting the CHQ by raising funds for
legal expenses for the pending court cases. He expressed his
heartfelt thanks to MH Circle of AIRBSNLEWA for inviting him
and conducting the function in a befitting manner.
Finally Chief guest Hon’ble GMT Kalyan Shri Hariom Solanki,
praised the AIRBSNLEWA MH Circle for its efforts in welfare
of retired employees of BSNL. He told that he never kept any
retired employee or members of Association waiting in front
of his office and always ready to meet them at any point of
time. He expressed his readiness to solve our pending issues
at the earliest. He mentioned how the issues given by
association through its CS were resolved immediately, even
service book of 6 employees has been brought back from CCA
and their pay will be fixed now as per new guidelines.
Regarding ID card he told already his AGM Admn applied for
advance to get ID cards printed at SSA level in phased
manner. He asked help from retired employees to support
BSNL by becoming its channel partner, DSA, franchisee and
brand ambassador and to increase its revenue.
The meeting ended
at 1900 hours with vote of thanks by Com. S Rama Murthy

Meeting with Member ((Finance)
DoT:- Comrade Prahlad Rai GS,
Comrade A K Kaushik, Legal Advisor CHQ and Comrade K M Goyal,
FS Delhi Circle AIRBSNLEWA met with Shri Dilip Padheyji,
Member(Finance ) DoT and requested to Member Finance to
kindly give early Clearance to the proposals send by DoT
Establishment on pension revision of BSNL pensioners. Member
Finance DoT mentioned that the matter is being examined by
the DDG Account DoT and today he is on leave otherwise he
could have find out the status. He also mentioned that at
present they are extremely busy in 5G spectrum allocation
business. However he assured that within 8-10 days Finance
wing opinion will be given to the Establishment cell of DoT.
We further requested to settle long pending pension revision
case of BSNL pensioners. Member Finance DoT assured to look
into the matter personally.
(b) Payment of pension to BSNL
pensioners through SAMPAN software.
We extended thanks for bringing all the BSNL pensioners
under SAMPAN for pension payments but explained some
difficulties in completing KYP demanded by respective CCAs
to verify the details. It has become difficult for all the
senior Citizens to visit CCA offices to long distances. We
explained that since all the required information are
available in the PPO book then why this exercise is being
done again. Member Finance DoT explained that it a
very good software through which 95000 VRS optees retirement
benefits were immediately paid and pension payments were
made by next month itself. Now all the pensioners are being
brought under this software for pension payments. Regarding
difficulties being faced by pensioners in its implementation
he will find out the status and will try to ease the system
so that pensioners need not to run the CCA offices. He
assured an early action in this regard. |

Meeting with Member (Services)
DoT:- Comrade Prahlad Rai GS,
Comrade A K Kaushik, Legal Advisor CHQ and Comrade K M Goyal,
FS Delhi Circle AIRBSNLEWA met with Shri Nizamul Haq ,
Member(Services) DoT Congratulated and welcomed him on
assuming the high office of Member(Services) DoT. We
requested to Member Services to kindly settle long pending
pension revision case of BSNL pensioners wef 01-01-2017.
Member Services assured to look into the matter and advice
us to further discuss the matter when he is free. At present
he was busy in some meeting with DoT senior officers. |

Meeting with our Senior Advocate
on pension revision case:--
Comrade Prahlad Rai GS, Com A K Kaushik, Legal Advisor CHQ ,
Comrade K M Goyal, FS AIRBSNLEWA, Delhi Circle, Comrade G L
Jogi, GS SNPWA and Comrade Mudgil, AGS RTWOA MTNL Delhi met
Shri Rajshekher Rao, Senior Advocate wherein our Advocate on
record Ms Gauri Puri was also present in the meeting. We
expressed our serious concern regarding non hearing of
Pension Revision case in the PBCAT New Delhi for the last
two years. Every time case is being listed at the last and
due to not hearing being deferred on the next dates. Senior
Advocate explained that for the last two years only Virtual
hearings were taking place and only 10-12 cases of urgent
nature were being heard. Now the physical hearings have
started but the cases pending for the year-2012 and
thereafter are being heard. Even today we can't expect
hearing before October or Nov-2022. After detail discussions
our Advocate on record Ms Gauri Puri suggested to file an
application for early hearing. On this Senior Advocate
opined that even after this hearing it may not take place
but effort can be taken up. Now our advocate will file an
application for an early hearing. Senior counselor also
opined that if the matter is resolved through negotiations
will be time saving and best approach. In this direction
AIRBSNLEWA CHQ is already making best efforts to get
resolved the issue through Political and administrative
channel. |

Payment
of pending medical Claims/ FMA of Rs 1000 PM against BSNL
MRS without Voucher option / LTC/Transfer TA/Furnishing

AIRBSNLEWA Faizabad District Secretary Comrade S S Shuklaji
Submitted a Memorandum duly signed by GS for pension
revision of BSNL pensioners, along with Shri P N Varma DE
Retd (who is also our mentor & patron), to Faizabad MP Shri
Lalloo Singhji on 14-05-22. He was kind enough to
accept our Memorandum & immediately forwarded the same to
the Hon'ble Prime Minister of India. We are extremely
thankful the Hon'ble MP Faizabad (Ayodhya) for his kind
concern and immediate action.

Status of IDA Arrears Court Case:
The above captioned matter was listed on 12.05.2022 as item
no. 25 in Division Bench -VII comprising HMJ. Najmi Waziri
and HMJ Swarana Kanta Sharma at Delhi High Court for
arguments.
Due to paucity of time, the matter could not be taken up and
was adjourned to 05.07.2022 for arguments. |

AIRBSNLEWA submitted Memorandum to Hon'ble Prime Minister
regarding Pension Revision:-
A delegation of AIRBSNLEWA UP(East) Circle led by Shri D.K.
Biswzas District Vice President Varanasi and Shri
L.B.Tripathi D S Varanasi on the behalf of Comrade GS and CS
Shri Pallab Bose, met Respected Shri Neelkanth Tiwary
PRO/MLA UP assembly Varanasi south earlier today on
13-05-2022 at Prime Minister Parliamentary Office Varanasi (Jansampark
Karyalay Varanasi). They submitted the memorandum addressed
to
Shri Narendra Modi ji Hon"ble Prime Minister of India,
address by AIRBSNLEWA GS Shri Prahalad Rai for pension
revision.
The memorandum was regarding Pension Revision of BSNL
Pensioners having combined service of DoT & BSNL w.e.f.
01-01-2017.
Hon'ble Shri Neelkanth Tiwary ji PRO/MLA Uttar Pradesh
assembly has given a positive response and has assured for
affirmative action.
We are thankful to Respected Shri Neelkanth Tiwary ji for
his positive response.

Payment of pending medical claims of BSNL pensioners:-
Comrade Prahlad Rai GS AIRBSNLEWA discussed with Sr GM
Budget BSNL CO New Delhi regarding payment of pending
medical claims of BSNL pensioners and requested for early
payment. Sr GM Budget BSNL CO Shri P C Bhatt Ji mentioned
that as per the assurances given by CMD BSNL to our
Association Rs 65 Crores were released in the month of
March-2022 on this account and the pending medical claims of
BSNL pensioners upto December- 2019 have been cleared. At
present funds collections are not that much, thus
immediately funds cannot be released. However efforts will
be made to release some funds in the month of August or
September-2022.The present liability towards pending medical
claims of BSNL pensioners is about Rs 350/- Crores. He
appreciated our concern and assured to release some funds in
case funds position permits. |

Discussions with Member(Finance) DOT on the issue of
Revision of pension of BSNL pensioners:-
Comrade Prahlad Rai GS AIRBSNLEWA discussed with Member
(Finance), DoT regarding Revision of pension of BSNL
pensioners and requested for its early settlement. Shri
Dilip Padhey Ji, Member Finance DoT informed that recently
DoT Establishment cell has sent four proposals in the
Finance wing of DoT which are being examined by internal
Finance of DoT. He assured that within one or two weeks the
proposals will be examined and cleared. He gave a positive
assurance in this regard and further assured that he will
immediately inform us after its clearance. Comrade GS
extended sincere gratitude and thanks to Member (Finance),
DoT for his positive attitude and response towards the
settlement of this important long pending issue. |

Very sad news..........Late Comrade Darbara Singh Ji is the
Circle Secretary of our AIRBSNLEWA Haryana Circle and Circle
Secretary of AIBSNLEA. We worked to gather more than 12
years.....Comrade Darbara Singh Ji was a dedicated and true
leader of our Associations......his contributions in
Harryana circle will always be remembered........I have lost
a well wisher and committed solder of our
Associations...........we convey our heartfelt condolences
to the bereaved family of Late Comrade Darbara Singh Ji on
his sad demise........we pray almighty God to rest soul in

AIRBSNLEWA, Jaipur Rajasthan circle meeting held on 16th
April-2022:- AIRBSNLEWA Jaipur,
Rajasthan Circle Get together programme was arranged on 16th
April 2022 at Jaipur in Vimal Villas, Jaipur. Comrade T R
Nanda District President welcomed the guests on dias and
esteemed members. Comrade K K Barser, District Secretary in
his address apprised the local problems mainly non payment
of medical claims of BSNL pensioners by BSNL and pension
revision case etc. He assured to increase the members.
Comrade M L Ostwal CS Rajasthan Circle in his address
explained the status of Organisational activities and
assoured to open New branches at all District Headquarters.
Comrade D K Kalyan Sr Vice President empress upon increasing
organisational activities since the Covid-19 restrictions
are relaxed. Comrade Prahlad Rai GS AIRBSNLEWA in his
address explained the status of the All India level issues
e.g. reimbursement of long pending medical claims of BSNL
pensioners, Problems being faced by BSNL pensioners in CGHS
health centres and their settlement through Association. The
Court case on pension revision of BSNL pensioners and the
efforts through administrative/ ministerial channel for its
settlement etc. He advised CS to open branches at all the
District Headquarters before AIC. Comrade K G Arora, Circle
President assured to to strengthen the organisation in
Rajasthan Circle. During interactive session Comrade GS
replied all the quarries raised by the members to their
satisfaction. Comrade D K Kalyan, Sr Vice President extended
Vote of thanks. The meeting was arranged in a Nice manner.

Extended CEC Meeting of AIRBSNLEWA UP(East) held at Lucknow
on 13th April-2022:- Comrade
Prahlad Rai GS and Comrade Pallab Bose AGS &CS attended and
address the Extended Circle Executive Committee Meeting of
AIRBSNLEWA UP East circle at Lucknow on 13th April-2022
organised in Apollo Hospital Auditorium, Lucknow. The CEC
Meeting was organised in a grand manner. Comrade Abbash
Circle President welcomed all the members and guests on the
dias. Comrade GS Prahlad Rai was welcomed and felicitated on
the occasion. Comrade Pallab Bose AGS/CS apprised in detail
the organisational activities of UP East circle and
discussed the problems being faced by the members due to non
payment of long pending medical claims of BSNL pensioners,
non empanelment of important hospitals of Lucknow under CGHS
and revision of pension of BSNL pensioners etc. Comrade
Prahlad Rai GS AIRBSNLEWA in his address explained the
status of the Court cases on pension revision of BSNL
pensioners, IDA increase as per 78.2 percentage basis from
1-1-2007 filed by AIRBSNLEWA in the Hon'ble PBCAT New Delhi
and Hon'ble High Court Delhi. He apprised that pension
revision case in PBCAT New Delhi has been listed for hearing
on 19th May-2022 and 78.2 fitment benefit case Writ Petition
on 12-5-2022. Since the physical hearings have started, We
may expect hearings on these dates. He explained that
despite the assurances given by CMD BSNL the required funds
have not been released by BSNL CO to clear long pending
medical claims of BSNL pensioners. We will further discuss
the matter with CMD BSNL and Director HR BSNL Board New
Delhi to settle the long pending medical claims of BSNL
pensioners. He assured to discuss the matter of granting
notional increment to the employees who completed one year
service on the day of their retirement as the Judgement of
Hon'ble High Court in our CWC meeting for taking further
legal course of action. He requested to propose for
conducting CWC meeting or AIC at Lucknow etc. In the
interactive session comrade GS replied all the quarries
raised by the members to their satisfaction. He appreciated
the functioning of UP East circle and advised to enroll more
members. After the interactive session a special session of
medical awareness was conducted by the team of Eminent
Doctors of Apollo Hospital on Cardiology and Orthopaedic
problems. The veteran members of the age of 75-Years were
felicitated by the CEC Meeting. The Auditorium and food
arrangements were sponsored by the Apolo Hospital, Lucknow.
The Auditorium was jam packed. CHQ congratulate the UP
Circle for the successful CEC Meeting.

thus Senior Citizens are finding difficulty in climbing
stairs and opening of two more dispensary in Jodhpur town
etc. Com Prahlad Rai GS AIRBSNLEWA apprised the status of
All India issues mainly the Court cases on pension revision,
DA arrear court case, payment of pending medical claims of
BSNL pensioners, reimbursement of CGHS contribution paid by
BSNL pensioners as one time measure etc. Comrade GS
requested to open the branches at all the District Head
Quarters. He also replied the queries of Members. Comrade A
K Tiwari OS West requested to regularise the District Adhoc
body and accordingly the District Body was regularised. OS
West also told that Dist rict body at Bikaner and Pali
Marwar Districts will be opened shortly. Comrade Kishore

OPEN SESSION OF 7TH AIC OF AIBSNLEA:-
Com. Prahlad Rai, GS AIRBENLEWA
addressed the Open Session of AIBSNLEA on 12th March 2022 at
RGM TTC, Chennai on the eve of its 7th AIC. Shri Shanmugham,
Hon. MP was the Chief Guest.
As Chairman of AIBSNLEA, he welcomed the Chief Guest, Guest
of Honour and other prominent Trade union leader for the
Open Session. As GS AIRBSNLEWA, he has expressed his
gratitude to GS & President of AIBSNLEA for inviting him as
GS AIRBSNLEWA for the open session of the 7th AIC of
AIBSNLEA and giving him an opportunity to address the
gathering.
He has explained how the BSNL was killed by the management
in a calculated way slowly slowly put in losses. He
mentioned that the present financial condition of the BSNL
is not due to any lapse on the part of its employees, but is
due to the wrong policies of the Govt. of India and the
failure on the part of the BSNL management.
In the year of 2004-05 BSNL had made a profit of more than
10000 crores and the strength of the employees were more
than 3 to 3.25 lakhs. Slowly the profit was reduced and in
the year of 2008-09 it came to 400 crores and subsequently
it started making losses. BSNL was being paid ADC charges of
4000 to 5000 crores as compensation towards the service
rendered in the rural areas on reduced rental. But, later,
on the basis of the recommendation of the TRAI, Govt. of
India stopped paying the ADC charges and BSNL was forced to
continue to serve the rural areas with reduced rental.
It is evident from the fact that after introduction of
revival package and VRS of about 78600 employees, the
financial position has not been improved which clearly
indicates that the employees are not responsible for the
loss of BSNL. Even now, the salaries are not paid in time to
the remaining employees. Only VRS has been implemented and
other assurances of revival package like 4G, Land
monetization, etc has not been given inspite of the lapse of
2 and half years after announcing the revival package. He
has also detailed about the land and properties arbitrarily
taken over by the DoT from the BSNL. He also mentioned that
at the time of formation of BSNL, assets and liabilities
were given and only assets are being taken over by the DoT
and liabilities are left to the BSNL and its employees.
As per the recommendation the pay of BSNL employees are to
be revised, whereas on the pretext of loss, the pay revision
and arbitrarily stopped by the Govt. and the pension
revision of the retired pensioners are also held up.
He mentioned that AIRBSNLEWA is fighting the pension
revision in the court of law against the pension revision,
as 5 years had already been passed from the date of last
pension revision. The pension revision was due as on
1.1.2017 on completion of 10 years and the same has not been
done by linking the pension revision of the retired
pensioners with the pay revision of the working employees.
He also mentioned about the recent meeting he had with
Secretary Telecom, wherein he has submitted a memorandum
citing the detailed report with full justification for the
pension revision and the indifferent attitude of DoT
Officers dealing with the cases. He also mentioned that the
BSNL pensioners are drawing the pension from the
consolidated fund of Govt. of India and the pension
contribution of these pensioners have already been paid on
the maximum of the scale as against the minimum of the
scale, as per the provision of Rule 37-A of pension Rules
1972.
He mentioned that the pension revision of BSNL pensioners
and the pay revision of the BSNL employees have no relation
whatsoever in so far as the combined service of BSNL
pensioners are concerned, since these pensioners have no
role in the financial status of the BSNL, since they do not
and cannot contribute to the financial growth of BSNL. He
mentioned that it is a conspiracy against the BSNL employees
those who have retired and those who are retiring by the DoT
officers.
He also mentioned that the employees of BSNL are at the
execution level and the policy decisions are being taken by
the ITS officers arbitrarily occupied the posts in the BSNL
without owning any responsibility of the organization. But,
these ITS officers working on deputation in BSNL are
enjoying all the benefits of 7th CPC.
He also stated that after the pension revision, the minimum
pension of a Group D employees retired from Govt. service is
Rs.9000/-, whereas, the minimum pension of a Group D
employee retired from BSNL is Rs.3500/-, due to
non-implementation of pension revision of BSNL pensioners.
He also mentioned about an another long pending issue of
BSNL pensioners where, as per the order of DPE regarding
78.2% IDA fitment benefits is due to BSNL pensioners w.e.f.
1.1.2007. but, it has been paid to the BSNL pensioners from
June 2013 onwards only.
He also pointed out that BSNL pensioners are getting notice
under section 154 of Income Tax Act, 1961 from Income Tax
department having combined service in DoT and BSNL for the
leave encashment payment received by the against the leave
earned during their service in DoT period.
He also mentioned that E1A and E2A pay scale has been
arbitrarily downgraded in BSNL to E1 and E2, whereas in MTNL
equivalent cadre employees are getting E2 and E3. He also
mentioned that 30% superannuation benefits should be given
to the Director Recruit JTOs and JAOs of BSNL, whereas as
per the 2nd PRC recommendation, it is not available. He also
mentioned that after 2nd PRC 2007 and 2010 batch parallel
recruited JAOs pay scale is 10000 less than that of the
others. This was not settled intentionally which shows the
attitude of the BSNL management. Now, there is no promotions
happening and our executives are being de-motivated in all
levels by the BSNL management.
He also mentioned that agreement is being signed by the
unions and associations with BSNL management and pensioners
have not signed any agreement and why the pensioners should
suffer. The medical bills of BSNL pensioners are pending for
more than 3 years for re-imbursement. CGHS are not available
in all the cities.
He appealed the serving unions and associations to extend
their support and help in resolving the heart burning issues
of BSNL pensioners who are all senior citizens. He also
mentioned that we pensioners have worked together with all
of you and requested to understand the problems and
difficulties faced by the pensioners and support to resolve
the same.
He extended all sorts of support to the associations and
unions for any call given for the viability of BSNL and
assured their personal presence at any given time.
He thanked one and all for
patient hearing and wished the AIC of AIBSNLEA become a
great success.

Meeting
of AIRBSNLEWA with Secretary( Telecom ):- Comrade Prahlad Rai
GS, Comrade Kishan Singh Ji, President CHQ and Comrade A J
Ram, CS Delhi Circle met Secretary DoT and while submitting
the Memorandum discussed the following;-
Pension revision of BSNL pensioners
w.e.f. 1.1.2017. While welcoming the Secretary
Telecom, we discussed the memorandum in detail mainly the
pension revision of BSNL pensioners with effect from
1.1.2017. we explained that before 1.10.2000, we were DoT
employees and after formation of BSNL w.e.f. 1.10.2000, we
exercised our option for absorption in BSNL with the
assurance of Govt. of India for the Government pension after
incorporating the 37-A in the CCS Pension Rules 1972.
Accordingly BSNL pensioners are drawing pension from DoT/
consolidated fund of Govt. of India. Earlier, the Pension
revision of BSNL pensioners was done wef 01-01-2007 and was
further due for revision w.e.f. 1.1.2017 after 10 years.
Whereas the counterpart pensioners of DoT, are getting
revised pension as per 7th CPC w.e.f. 1.1.2016 after 10
years from 1.1.2006. But for BSNL pensioners, the pension
has not been revised even after 15 years on the pretext of
non-revision of Pay of the working employees of BSNL due to
its continuous loss making.
We further explained to Secretary Telecom that we BSNL
pensioners are not playing any role in the profit and loss
of BSNL. Our pension contribution has already been paid to
the DoT on the maximum of pay scale during our services, as
per Rule 37-A CCS Pension Rule 1972 provisions. Thus, the
linking of Pension revision of retired persons with the pay
revision of working employees is not at all justified. It
is experienced that some DoT officers dealing with the
pension revision issue are quite indifferent with the
absorbed employees of BSNL and with their over jealous
attitude, they are linking pension revision with pay
revision to avoid the revision and settle their score with
the absorbed employees of BSNL. Whereas these DoT officers
are serving in BSNL /MTNL on deputation and are enjoying the
pay revision with all other benefits of 7th CPC
at par with their counter parts in the DoT and they are also
enjoying revised pension after their retirement from BSNL
as per 7th CPC. We further explained that a
group ‘D’ employees of BSNL is drawing Rs.3500/- per month
pension after their retirement from BSNL, whereas a group
‘D’ retired from DoT is drawing Rs.9000/- per month
pension. But this fact has never been appreciated by the
establishment section of DoT. We also explained that 9
recommendations of the 7th CPC has already been
implemented for the BSNL pensioners by the DoT, except the
Pension revision of BSNL pensioners on flimsy ground.
We also discussed about payment
of arrears of 78.2% IDA fitment benefit w.e.f. 1.1.2007
instead of June 2013 as per DPE order to BSNL Pensioners &
also regarding the notices under section 154 of Income Tax
Act, 1961 being received by many BSNL pensioners from
Income Tax department having combined service in DoT and
BSNL for payment of income tax for the leave encashment
received for the service rendered in DoT.
The Secretary Telecom patiently heard our submissions and
after some discussions on the above issues assured that he
will get it examined shortly.
We extended our sincere gratitude and thanks to the Secretary
Telecom for giving us a patient hearing for more than half
an hour and his kind consideration and for the assurance
for examining issues raised by us.

meeting with Member (Finance) DoT :-
Comrade Prahlad Rai GS, Comrade Kishan Singh Ji, President
CHQ and Comrade A J Ram, CS Delhi Circle met with Member
Finance DoT and discussed the Memorandum submitted to the
Secretary DoT. We apprised him in detail our discussions
with Secretary Telecom and his concern to understand the
matter mainly regarding the pension revision of BSNL
pensioners wef 01-01-2017.
We also discussed about payment of arrears of 78.2% IDA
fitment benefit w.e.f. 1.1.2007 instead of June 2013 as per
DPE order to BSNL Pensioners and also regarding the notices
under section 154 of Income Tax Act, 1961 being received
by many BSNL pensioners from Income Tax department having
combined service in DoT and BSNL for payment of income tax
for the leave encashment received for the service rendered
in DoT.
The Member Finance DoT patiently heard our submissions and
after some discussions on the above issues assured that he
is aware of the issues and will certainly discuss at the
appropriate level and time.

giving us a patient hearing and positive response .

25.02.2022 Meeting
with our Advocate Ms Gauri Puri at New Delhi on 22nd
February-2022:- Comrade Prahlad
Rai GS AIRBSNLEWA met and discussed with Ms Gauri Puri our
Advocate at New Delhi on 22nd February 2022.(a) Regarding
Pension Revision case we requested to our Advocate for
making efforts for early listing of the case. Advocate
explained that I virtual hearings only 7-8 cases are being
heard in a day and listing of the case is being done in the
Registrar Office where no body can influence. Now the
physical hearings are expected shortly then only we may
expect our case hearing. (b) Regarding DA arrear court case
in the Hon'ble High Court Delhi the rejoinder has been filed
by DoT. Now the case has been posted for hearing on
28-02-2022 (c) Income tax department notices for TDS
deduction on Leave Encashment amount of DoT period was
discussed and after detailed discussions our Advocate
suggested that the individuals should first try through
administrative channel thereafter they may go for appeal in
the Income tax Tribunal locally. Even after the matter is
not resolved then Association may file Writ Petition in the
Hon'ble High Court Delhi seeking All India relief. |
24.02.2022 Meeting
with Member Finance DoT:-
Comrade Prahlad Rai GS AIRBSNLEWA met Member Finance DoT and
discussed regarding Pension Revision of pension of BSNL
pensioners. Member Finance DoT mentioned that matter is
under consideration to DoT but final view is yet to be
taken. |

Discussed regarding Pension Revision

to mention that Pension Revision of pension of BSNL
pensioners can't take place without the pay revision of BSNL
employees. In case the pension revision of BSNL pensioners
is considered without the pay revision then an anamoly will
be created to the post retiring employees after
01-01-2017.We further mentioned that as per the 7th CPC
pension revision formula our Pension Revision may be
considered notionally wef 01-01-2017 and actual on the last
pay drawn which will avoid anomaly and BSNL need not pay the
arrears. DDG Esst DoT after detailed discussions assured to
look into the matter . Our suggestion was appreciated by
other senior officers of DoT. However, AIRBSNLEWA will
discuss the matter with Secretary Telecom and Hon'ble MOC
shortly. Regarding BSNLs viability it was confirmed by DoT
officers that Govt is considering to give a financial
package of amounting more than one lac Carores for its
revival. |
24.02.2022 Meeting
with PGM Pers BSNL CO;- we
requested PGM Pers BSNL CO for true implementation of the
Hon'ble Supreme court judgement on Rule206. PGM Pers further
mentioned that court judgement on Rule206 has been
implemented and review DPCs have been conducted. However, he
mentioned that existing Ers of SDEs are going to be revised
wherein JTO to SDE promotion will be there after 12 years on
functional basis not depending on availability of SDE posts. |
21.02.2022 Meeting
with CMD BSNL:- Comrade Prahlad
Rai GS AIRBSNLEWA met CMD BSNL and discussed regarding
payment of pending medical claims of BSNL pensioners pending
for the last two years. We requested CMD BSNL for the
clearance of all the pending medical claims of BSNL
pensioners before 31-03-2022 as assured by him to our
Association also extended thanks to him for releasing Rs 50
Crores to clear pending medical claims of BSNL pensioners in
the month of December-2021 as assured by him to our
Association. CMD BSNL appreciated our concern and mentioned
that in December-2021 he has released Rs 50 Crores on this
account and will further try to release some funds in the
month of March-2022 in case the sufficient funds are
collected.
(b) Reimbursement of CGHS
contribution paid by BSNL pensioners as one time measure:-
We extended sincere thanks to CMD BSNL for releasing orders
to clear all the claims of reimbursement of CGHS
contribution paid by BSNL pensioners as one time measure
within one month time for those BSNL pensioners who have
opted for CGHS facility by 31-03-2022. |
21.02.2022 Meeting
with Sr GM Budget BSNL CO :-
Regarding Payment of pending medical claims of BSNL
pensioners:- We requested Sr GM Budget BSNL CO regarding
Payment of pending medical claims of BSNL pensioners by
31-03-2022 as assured by CMD BSNL. Sr GM Budget BSNL CO
mentioned that Rs 50 Crores were released in the month of
December-2021 on this account and will further release some
funds in the month of March- 2022 depending on the revenue
collections. We extended thanks to him for his positive
response. |

with GM Admn BSNL CO ND :-
Regarding reimbursement of CGHS contribution paid by BSNL
pensioners as one time measure. G.M Admn mentioned that
there were several Complaints for delay in reimbursement of
CGHS contribution paid by BSNL pensioners as one time
measure in some Circles. In view of this CMD has directed to
issue the order for reimbursement of CGHS contribution paid
by BSNL pensioners as one time measure within one month time
thus now BSNL pensioners should switch over to CGHS
immediately since BSNL is finding difficulty in releasing
funds. |

their parents will be reimbursed within one month time. The
necessary order in this regard will be issued today itself.
Thus BSNL pensioners should switch over to CGHS immediately
and their reimbursement of CGHS contribution paid by BSNL
pensioners is ensured within one month time. Earlier also
CMD BSNL assured that CGHS contribution paid by BSNL
pensioners as one time measure will be cleared on priority
and he fulfilled his commitment. |

our serious concern against the non payment of long pending
medical claims of BSNL pensioners for the last three
years.CMD BSNL appreciated our concern and assured that in
this Financial year all the pending medical claims of BSNL
pensioners will be cleared. He also mentioned that the
problem is genuine but due to shortage of funds the medical
claims of BSNL pensioners couldn't be cleared.
(b) Pension Revision of BSNL
pensioners:- We requested CMD BSNL to use his
good office in the Settlement of pension revision of BSNL
pensioners by explaining to Secretary DoT and Hon'ble MOC.
CMD BSNL mentioned that matter is under consideration in DoT
but we people should also convince the DoT administration
and Hon'ble MOC.
Meeting with Sr GM Budget BSNL CO:-

AIRBSNLEWA discussed with Sr. GM Budget BSNL CO regarding
Payment of long pending medical claims of BSNL pensioners.
We expressed our concern against the non payment of medical
claims of BSNL pensioners for the last three years where as
the medical claims of BSNL employees are being paid
regularly. Sr. GM Budget confirmed and mentioned that about
Rs 200/- Crores liability is there in this regard and at
present the funds collection condition is not good but in
the month of March-2022 revenue collection will be more and
funds will be allotted on this account thus all the pending
medical claims of BSNL pensioners will be
cleared.
Meeting with
Sr. GM Estt. BSNL CO New Delhi:-
Comrade Prahlad Rai GS
AIRBSNLEWA discussed with Sr. GM Estt. BSNL CO regarding
(1) Notional increment benefit
to the employees who retired on superannuation on 31st May
as per the Judgement of Hon'ble Supreme court.
Sr. GM Estt. BSNL CO further mentioned that DoP&T has
already clarified that the Hon'ble Supreme court judgement
is applicable only for the individual and can't be
generalized. Against this DoP&T order many employees have
further filed the SLP in the Hon'ble Supreme court and after
the outcome of the court case it may be generalized.
(2) Pay fixation to officiating
JTOs under FR 22(1) a (i) in all the Circles:- We
requested Sr. GM Esst. BSNL CO for issuing a general order
for the implementation of FR 22 (1) a(i) in the Circles. Sr.
GM Esst. BSNL CO mentioned that some Offg. JTOs of Kerala
circle has filed SLP in the Hon'ble Supreme court on this
issue and after the out of the Judgement of Hon'ble Supreme
court the decision will be taken in this regard. Regarding
recovery of offg JTOs due to BSNL CO pay fixation order,
Sr. GM Estt. BSNL mentioned that Head of the Circle are
empowered to wave of the recovery of circle cadres. The
matter may be taken up with the concern CGMs.
Meeting with Member Finance DoT:-
Comrade Prahlad Rai GS
AIRBSNLEWA along with Comrade Kishan Singh Ji, President and
Comrade A K Jain FS met Member Finance DoT and Felicitated
him assuming the high office of Member Finance DoT.
(1) We requested him to help the
BSNL pensioners for their pension revision case.
We explained the justification for the pension revision of
BSNL pensioners by delinking from pay revision of BSNL
employees. Member Finance DoT after some discussions
assoured that he will discuss the matter with Member
Services DoT for the settlement of this issue.
(2) Portability of PPO from
one Circle to another Circle after change of station on
retirement. We requested Member Finance DoT to
consider the request for allowing portability of PPO from
one Circle to another Circle on change of station on
retirement. Member Finance DoT mentioned that matter is
under consideration and one time option will be given to
such pensioners. This decision may take two or three months
time.
Meeting with DDG Esst. DoT:-

AIRBSNLEWA CHQ met DDG Estt. DoT and discussed regarding
Pension Revision of BSNL pensioners:- We
explained to DDG Estt. DoT the justification of pension
revision of BSNL pensioners by delinking from pay revision
of BSNL employees. DDG Estt. DoT mentioned regarding anomaly
in the pension of post retiring employees after 1-1-2017 in
case it is implemented without the pay revision of BSNL
employees. We explained that we have already provided the
formula to avoid pension anomaly. DDG Estt. DoT advised us
to further submit the proposal. We will further provide the
proposal.

DDG PM informed that matter is under consideration to

requested to PGM Pers for the correct implementation of Rule
206 as per the Judgement of Hon'ble Supreme court for SDEs
seniority. PGM Pers. BSNL CO mentioned that BSNL CO has
contacted review DPCs and re-casted the SDEs seniority .We
explained that re-casted SDE seniority is not in the true
sprite of Hon'ble Supreme court judgement. |

We expressed our concern against the recovery being made by
Gujarat circle of Officiating JTOs against the FR 22(1) a(i)
pay fixation on their regular promotion. Sr GM Estt after
some discussions mentioned that no instructions have been
issued from BSNL CO New Delhi for any recovery. However such
case can be taken up in BSNL CO for clarification. We advise
our CP Gujarat circle for sending a letter by enumerating
the facts.
(b) Notional increment benefit to the employees who retired
on superannuation on 31st July on completion of 365 days
service.
Sr GM Esst BSNL CO New Delhi informed that DoP&T has already
clarified that no benefit of one increment will be granted
in such cases. The court judgement on this issue has been
implemented for an individual case but not generalise. Thus
the matter can be taken up with DoP&T for clarification . |

OF MEETING OF CHQ OBs, CSs OF AIRBSNLEWA HELD ON 8.8.2021:-
A meeting of the CHQ Office Bearers
and Circle Secretaries of AIRBSNLEWA was held through Google
Meet on Sunday, 8.8.2021 at 19.00 hours to discuss about
various matters related to the Pensioners and the
organization activities. Over all 39 participants attended
the meeting.Comrade Kishan Singhji, President in his welcome
address explained the status of our pending issues and the
efforts taken by the association for their settlement. He
requested all the members to discuss the issues and
organisational matters in brief due to shortage of time and
coprate.
G.S. Com. Prahlad Rai briefed the grievances of the
pensioners like Payment of pending medical claims of BSNL
pensioners, reimbursement of CGHS contribution paid by BSNL
pensioners as one time measure by BSNL, health insurance
scheme for BSNL pensioners, Reimbursement of BSNL pensioners
residential telephone bills of Delhi and Mumbai area,
Rejoinder submitted by BSNL on pension revision case in the
PBCAT New Delhi for delition of their name, Status of
pension revision of BSNL pensioners court case in the
Hon'ble PBCAT New Delhi , Court case on 78.2 -/. IDA pension
arear payment wef 1-1-2007 instead of 1-6-12013 in the
Hon'ble High Court Delhi and regarding other court cases and
its present status, IDA restoration, etc. He categorically
mentioned that the decision on the court cases are expected
only after resuming the physical hearing and the delay in
the final outcome of the court cases are only due to the
absence of physical hearing and due to pandemic only online
hearings of the cases are taken place. The final decisions
are delivered by the judiciary only in the cases of urgent
nature and the service matters are not treated as urgent. He
also mentioned that there is no lapse in pursuing the court
cases from the Association Side.
GS also mentioned that there are already instructions from
BSNL CO for creating liability of the pending payments of
the medical bills by the SSAs / Circles. He has requested
all the Circle Secretaries to taken up the matter with the
respective circles with the said order copy and he assured
that once the liability is created against the pending
bills, the payment of such bills are rest assured, even if
it gets delayed also.
All the Circle Secretaries had briefed about the
organizational matters in their respective circles, status
of the remittance of legal funds, pending issues with a
request to pursue the same at CHQ level. GS assured to
pursue all the issues raised by the Circle Secretaries and
CHQ Office Bearers.
Participants has requested the GS to further pursue the
matters of pending payment of TA bills of the VRS 2019
optees, enhancement of concession on the FTTH connections to
the retirees, Health insurance to all the retirees, Non
issuance of Form-16 by the BSNL as well as DoT for the
Pensions as well as for the ex-gratia payment, displaying
the pending medical and telephone bills in the portal by the
Circles / SSA to avoid corruption in clearing the pending
medical / telephone bills of the retirees by favoritism,
final issue of PPO in the cases of Provisional pension
cases, issue of Caste verification of ST candidates of VRS
optees and settlement of their pension, payment of interest
for the delayed GPF payments, Pay fixation case of
Officiating JTOs who has taken VRS, notional increment case,
Various difficulties faced by the CGHS card holders in the
day to day activities while taking treatment from CGHS like
repeated visits to CGHS for references and signatures at
multiple times were also brought to the notice of the GS and
requested to take up with the Director of CGHS, New Delhi,
Com. Prahlad Rai requested all the participants to
concentrate on forming the circle and branches at District
level, wherever it does not exist and strengthen the
organization by increasing the membership. He also requested
all to concentrate on collection of legal fund and its
timely remittance to ensure that the payments to the
advocates are not delayed for want of fund to ensure smooth
pursuance of the multiple court cases and for its final
outcome in our favour.
Com. Bagchi, veteran leader of MTNL Retired Association and
our Chief Pateron also attended the meeting as a special
guest and addressed the meeting. He has appreciated the G.S.
Com. Prahlad Rai in keeping the enthusiasm and team spirit
continuing after retirement also and expressed his happiness
to see all the old friends and leaders.
It was also decided to hold such meetings with an interval
of 2 months till the pandemic is ended and physical CWC is
held by the CHQ.

Delhi Circle discussed with CMD BSNL regarding:-

Payment of pending medical claims of BSNL pensioners:-
we expressed our serious
concern against the non payment of medical claims of BSNL
pensioners for the last two years and requested to release
funds to settle the long pending medical claims of BSNL
pensioners .As the medical claims of BSNL employees are
being cleared regularly. CMD mentioned that about 70 Carores
were released on this account.We clarified that this amount
was paid to clear the dues of empenalled hospitals and the
pending online medical claims of BSNL pensioners retired on
VRS 2019 scheme but the other offline payment of pensioners
are still pending. CMD appreciated our concern and assured
to look into the matter to release some funds on this
account.
(b) Medical health insurance scheme
for BSNL pensioners also;- We
requested CMD BSNL to consider the medical health scheme for
BSNL pensioners also. CMD mentioned that the premium for
BSNL pensioners will be high and how the premium will be
paid.we clarified that scheme will be optional and optees
will make the payment through online. After some discussions
CMD assured that he will direct BSNL CO concern officers
team to negotiate with the insurance company and finalise a
medical insurance scheme for BSNL pensioners also. (c)
Reimbursement of BSNL pensioners residential telephone bills
of Delhi and Mumbai area;- we requested to direct the
concern officers of BSNL to settle the pending telephone
bills of Delhi and Mumbai area. CMD BSNL assured to look
into the matter. (d)Rejoinder submitted by BSNL and on
pension revision case in the PBCAT New Delhi:- We requested
CMD BSNL to kindly clarify the Hon'ble PBCAT New Delhi that
pension contributions of BSNL employees has been paid on the
maximum of the pay scale.Now DoT has to revise the pension.
CMD was non committal on this issue. |

with Director (HR) BSNL Board-
Comrade Prahlad Rai GS AIRBSNLEWA along with Com A.G. Ram,
CS AIRBSNLEA Delhi Circle met Director (HR) BSNL Board New
Delhi and discussed regarding
(a) Non- Payment of Medical claims
of BSNL Pensioners:- We
expressed our serious concern against the non-payment of
long pending medical claims of BSNL Pensioners whereas the
BSNL serving employees medical claims are being cleared
regularly. Director (HR) appreciated our concern and during
discussions we mentioned that even the Income Tax is being
deducted against the non- paid medical claims and shown as
income in the Form 26 AS. Director (HR) mentioned that he
will discuss the matter with the concern officers in BSNL
C.O. and will ensure that the medical claims are uploaded
online by BSNL Pensioners like BSNL employees and their
medical claims are paid online regularly along with the BSNL
employees medical claims. He assured that he will discuss
the matter with Director (F) to clear the pending medical
claims by releasing funds on this accounts.
(b) Health Insurance policy for BSNL
Pensioner: -
We appreciated the decision of BSNL
Management for a bringing Health Insurance policy for BSNL
employees and requested to bring the similar policy for the
BSNL Pensioners also. Director (HR) appreciated our concern
and explained some difficulties in bringing this policy for
BSNL Pensioners due to payment of Premium amount and its
mechanism etc. we clarified that decided premium will be
paid to BSNL by the pensioners who opt this policy and BSNL

with our Advocate to discuss the court Cases -
Comrade Prahlad Rai GS AIRBSNLEWA
along with Com G.L. Jogi GS SNPWA, Com Sebastin GS SNEA,
Com M.K. Bagchi, President RTWOA (MTNL) Com. S.S. Nanda GS
RTOWA (MTNL) and Com A.K. Kaushik our legal advisor met with
Mr. Rajshekhar Rao and Ms. Gauri Puri our counselors to
discuss the pension revision Court case and other pending
court cases- They apprised that pension revision Case for
BSNL is coming on hearing on 9th August 2021
wherein BSNL’s rejoinder to detach may be decide and it will
be linked with MTNL case to be heard jointly on 22nd
October 2021. Mr. Rajshekhar Rao mentioned that due to Covid
-19 , Pandemic situation the virtual hearings are taking
place and these cases may be properly heard in the physical
hearings only.
Rule- 206 Contempt Case:-
our Advocate apprised that against the mis- interpretation
of Hon’ble Supreme Court Judgement on Rules 206 contempt
case has been filled in the Hon’ble Supreme Court where in
the notices have been issued but the urgent cases are only
being heard at present . However, effects are being made for
early hearing on contempt petition.
78.2% IDA fitment Benefit w.e.f. 1.1.2007 instead of
1.6.2013 to BSNL Pensioners: -
The writ petition filed by AIRBSNLEWA in the Hon’ble High
Court Delhi against the Hon’ble PB CAT ND Judgement is
being heard on 10th August 2021 and may be
further posted for next date.

with PGM (Pers.) BSNL CO New Delhi -
Comrade Prahlad Rai GS AIRBSNLEWA met with PGM (Pers.) and
discussed regarding wrong implementation Rule -206 Hon’ble
Supreme Court Judgement for SDEs seniority by BSNL C.O.
PGM (Pers.) mentioned that BSNL C.O. has released two review
DPC lists and 3rd is being issued shortly. We
mentioned that against these review DPCs only contempt case
has been filed in the Hon’ble Supreme Court but due to Covid
-19 situation it is not being heard. He didn’t comment over
it. |
06.08.2021 Meeting
with GM (SR) and GM (Admin) BSNL CO New Delhi -
Comrade Prahlad Rai GS AIRBSNLEWA met on courtesy call to
the New GM (SR) and GM (Admin) and discussed the pending
issues of BSNL Pensioners i.e. non-settlement of long
pending medical claims, revalidation of BSNL MRS Card and
extension of its date, introduction Health insurance policy
for BSNL Pensioners etc. They assured to look into the
pending matters.

22.07.2021 Status
of our pension revision court case filed in PB CAT, New
Delhi :-
MTNL already filed an Application in PB CAT,praying for
removing MTNL from the list of Respondents on the same line
as BSNL
did earlier. Naturally it will be opposed by our Advocate
stating that MTNL can not be removed as one of the
Respondents on the same grounds as was advocated in case of
similar prayer from BSNL earlier. It was notified earlier
for this matter to come before PB CAT, New Delhi on
21/07/2021. But this was not happened so as the matter was
adjourned. Further date is still expected to be notified.
Earlier we were told earlier for the OA to come before PB
CAT on 08/08/2021. That is also now uncertain as per our
Advocate as the hearing of all such cases in PB CAT, are
being rescheduled.

Association vs. UOI & Ors:
Principal Bench CAT issued notice dated 27.04.2021 , wherein
the captioned matters stand adjourned to 15.06.2021. In view
of the surge in COVID-19 cases, the Ld. CAT is hearing
matters which are urgent, and both the parties have given
their willingness. Pleadings in the MTNL matter are yet to
be completed and in so far as BSNL is concerned, the MA for
deletion of BSNL is yet to be decided. Therefore, there is
no urgency in the matters and the request for hearing may
not be accepted. We will wait for the hearing on 15.06.2021
to decide the further course of action.
b.WP (C)- 13202/2019- All India Retired BSNL Executives
Welfare Association Vs Union of India & Ors.
The
captioned matter is listed on 27.05.2021.However, in view of
the surge of COVID-19 cases, the High Court of Delhi has

Comrade Prahlad Rai GS AIRBSNLEWA discussed with PGM Budget
BSNL CO New Delhi regarding reimbursement of long pending
medical claims of BSNL pensioners and PGM Budget informed
that he has already issued instructions to PGM ERP Gaziabad
to update all pending medical claims of BSNL pensioners and
PGM ERP has informed that he has already adviced Circles to
send the information of pending medical claims for
reimbursement .PGM Budget informed that Rs 60 Carores have
been released for the reimbursement of pending medical
claims of BSNL pensioners and last weak Rs 42 Carores have
been paid to empenalled hospital dues.He assured that within
two- three days medical claims of BSNL pensioners will be
reimbursed. We extended thanks to the BSNL management.

Status of court cases-O.A
1271/2020- Retired Telecom Officers' Welfare Association vs.
UOI & Ors.:The
captioned matters were listed today as Item No. 9 & 10 at
02.30 PM before the Hon'ble Member Ms. Aradhana Johri
through virtual hearing at the Central
Administrative Tribunal, Principal Bench, New Delhi.
Ms Gauri Puri Our Advocate appeared on the behalf of the
Applicants. Mr. Manjeet Singh Reen appeared for the
Respondents No. 1, 3 & 4 and Mr. Mohd. Faizal appeared for
the MTNL i.e. Respondent No. 2. Ms Gauri Puri Our
Advocate apprised the Hon'ble
Tribunal that the Rejoinder has been filed to the Counter
Affidavit of Respondent no. 1,3 & 4. Counsel for the
Respondent affirmed service of the same. Counsel for the
Respondent No. 2 (MTNL) sought some time to file the Counter
Affidavit. On this, the Hon'ble Tribunal gives two weeks
time to the Respondent No. 2 to file Reply and 2 weeks time
thereafter to the Applicants to file their
Rejoinder. Accordingly, the matter stands adjourned
to 18.05.2021.
Ms Gauri Puri Our Advocate appeared on the behalf of the Applicants. Mr. R. K Sharma
appeared for the Respondents No. 1, 3 & 4. Mr. R V Sinha
appeared for the Respondent No.2 (BSNL).
Mr. R.V Sinha apprised the Hon'ble Tribunal that MA No.
76/2021 was filed for deletion of name of BSNL from the O.A
as BSNL may be a proper party but not a necessary party
since no relief has been sought against them.
On this,
Ms Gauri Puri Our Advocate apprised the Hon'ble Tribunal that the Reply to
the M.A has been filed along with the objections and
submitted that the BSNL is a proper party in the proceedings
as all the Applicants were have retired from BSNL and
further presence of BSNL is necessary for proper
adjudication of the subject matter. Further,
Ms Gauri Puri Our Advocate submitted
that the DOT has denied the revision of pension on the
ground that the same cannot be done as the Pay has not been
revised by the BSNL. Further,
Ms Gauri Puri Our Advocate submitted that as per Rule
37 of CCS Pension Rules, 1972, BSNL has been paying pension
contributions to the DOT.
Ms Gauri Puri Our Advocate also placed reliance on a
Judgment of the Hon'ble Supreme Court wherein the Hon'ble
Court held that a proper party against whom no relief is
sought may be necessary for effective adjudication to
determine the real controversy in the matter.
Ms Gauri Puri Our Advocate submitted
that while prayer is sought against DOT for revision of
pension, the stand taken by DOPW which is yet to be examined
by DOT is that no pay revision has taken place so far in
BSNL and therefore, pension cannot be revised.
Ms Gauri Puri Our Advocate submitted
that in the event the Tribunal holds this to be correct,
then necessarily BSNL will have to be present to determine
the controversy as to why pay revision has not been done so
far. Moreover, the pension if fixed will be on the last pay
drawn for which BSNL's presence is essential. After hearing
the parties, the Hon'ble Member directed the parties to file
copies of the Judgments they sought to rely upon and
adjourned the matter for hearing on 18.05.2021. |

Tamilnadu Circle hold its 1st Circle Conference at
Trichi.Comrade Prahlad Rai GS AIRBSNLEWA Could not attend
the Circle Conference due continuous increase in Covid-19
cases, Comrade S Shivakumar, GS, AIBSNLEA attended and
address the conference. Circle Conference was conducted in a
decent manner. Comrade S Kamraj along with Comrade Kurpaiha
and others made nice arrangements for successful conduction
of the Circle Conference. A large number of delegates from
Tamilnadu Circle and local members actively participated in
the Conference. New circle body elections were conducted
unanimously. Circle President Comrade M.Chandarasekaran,
Circle Secretary Comrade S.Kamaraj, Circle Finance secretary
Comrade R.Guruprasath are unanimously elected, remaining
Circle Office bearers list will follow. AIRBSNLEWA CHQ

) BSNL CO New Delhi regarding final instalment payment of
Ex- gratia to VRS optees of BSNL .Sr GM(Esst) informed that
today DoT accounts cell has confirmed that by tomarrow Ex-gratia
final instalment amount will be transferred to BSNL account
and BSNL will release Ex- gratia payment to VRS optees of
BSNL in the next week positively.Last week DDG (PM ) DoT
informed to Comrade Prahlad Rai GS AIRBSNLEWA to release the
Ex- gratia payment to VRS optees of BSNL in the first weak
of March-2021.AIRBSNLEWA CHQ continuously pursueded the
matter with DoT and BSNL officers and now being settelled. |
16-02-2021: Income
Tax on leave Encashment paid by BSNL:-
Comrade Prahlad Rai GS AIRBSNLEWA
discussed with GM Taxation BSNL CO on the issue of Income
Tax notices/ demand note received by BSNL pensioners for the
payment of Income Tax on leave Encashment paid by BSNL on
combined leave of DoT and BSNL. Against this AIRBSNLEWA has
written to CMD BSNL for taking up the matter with Income Tax
department. BSNL vide its letter issued in th year 2012
categorically mentioned that DoT period leaves Encashment is
exempted from Income Tax payment
,accordingly the IT was not deducted from leave encasement.
Now IT department has issued notices/ demand note for IT
payment to BSNL pensioners. AIRBSNLEWA has protested against
these notices. GM Taxation BSNL CO New Delhi today informed
that our letter has been discussed with the competent
authority and it is decided that a letter will be sent to
DoT to take up the matter with Ministery of Finance, Govt of
India for the withdrawal of notice/ demand note. |
08-02-2021: Final
payment of Ex gratia to VRS optees of BSNL:-
Comrade Prahlad Rai GS AIRBSNLEWA
discussed with Sr GM Esst BSNL CO New Delhi regarding final
payment of Ex gratia to VRS optees of BSNL. Sr GM Esst BSNL
CO New Delhi informed that DoT has directed to all the CCAs
to verify the claims raised by BSNL .Accordingly CCAs are
verifying the claims raised by BSNL and about 450 cases are
still pending for verification. He expected that this
verification process will be completed by next week and
thereafter Ex gratia payment to VRS optees of BSNL may be
made by the end of this month. BSNL concern circles are
immediately clarifying the CCAs queries. He also informed
that DoT has already received funds from DoE on this
account. |

Meeting with CGMT Rajasthan circle:-
Comrade Prahlad Rai GS and Comrade M L Ostwal, CS Rajasthan
AIRBSNLEWA met CGMT Rajasthan circle and discussed regarding
(a) Payment of pending medical claims upto March- 2019 as
per the BSNL CO decision.
CGMT Rajasthan Circle mentioned the funds received from BSNL
Corporate office were fully utilised. However, remaining
medical claims will be cleared on receipt of the funds.
(b) Pay fixation under FR 22(1)(a)(i) to Officiating JTOs:-
We requested CGMT Raj to consider the pay fixation of
Officiating JTOs under FR 22(1) (a)( i). CGMT called GM(HR)
and directed him to examine the case and an early action.
(c) Payment of pending personal claims of VRS retirees:-
We apprised CGMT Raj for the early settlement of pending
personal claims viz TA/DA claims, leave encasement etc with
some examples of Bhilwara District branch. CGMT Rajasthan
directed to GM( HR) for the settlement the pending cases. He
mentioned that pensioners issues should be settelled on
priority and the ePPOs, leave encasement etc should be given
to BSNL pensioners on the day of their retirement. We
extended thanks for his concern towards pensioners. |

Non reimbursement of long pending
medical claims to BSNL pensioners:- we extended our sincere
thanks to CMD BSNL for clearing medical claims of BSNL
pensioners upto March- 2019 and requested for early payment
of all the pending medical claims of BSNL pensioners. CMD
BSNL appreciated our concern and mentioned that pending
medical claims of BSNL pensioners liability is about Rs
125/- Crores and on availability of funds these medical
claims will be cleared in parts. He assured an early action
in this regard.
(b) Reimbursement of CGHS contribution
paid by BSNL pensioners as one time measure: CMD BSNL
informed that all the CGHS contribution paid by BSNL
pensioners as one time measure are being paid by circles
regularly. BSNL CO New Delhi has already issued instructions
to circles. We apprised CMD BSNL regarding non payment of Rs
1000/- PM to CGHS beneficiaries in the areas/Districts where
CGHS wellness health centres are not available .CMD BSNL
immediately spoke with PGM (Esst) BSNL CO and directed him
to provide us the copy of the orders issued by DoT in this
regard. On receipt of the order copy the same will be
circulated.
(c)
Reimbursement of residential telephone bills of Delhi/Mumbai
area: We requested CMD BSNL for the reimbursement of long
pending residential telephone bills of Delhi and Mumbai
area. CMD assured to look into the matter and settle the
issue.
(d) Revision of pension of BSNL pensioners- court case
status:
we appraised CMD BSNL
regarding the Court case status on revision of pension of
BSNL pensioners filed by AIRBSNLEWA and others in PB CAT ND
and requested him to his good office in convincing Hon'ble
Minister of Communications and Secretary DoT for delinking
of pension revision from pay revision of BSNL employees. CMD
BSNL assured to look into the matter and to discuss with
concern DoT officers.

Meeting with PGM(Esst) BSNL CO:

discussed with PGM Esst BSNL CO regarding:-
(a)
Ex - gratia final instalment payment to VRS optees of BSNL and
MTNL: PGM Esst BSNL CO New Delhi informed that today Ex-
gratia amount about Rs 1050 Crores will received from DoT
and it will be paid within this month itself. MTNL has
already received Rs 214 Crores Ex gratia amount from DoT.
(b) Implementation of Court orders for
FR 22(1)a(i) pay fixation to officiating JTOs uniformly: PGM Esst BSNL CO New Delhi informed FR22(1)a
(i) has to be
given to all the officiating It is through out the country.

the Ld. Single Bench of Mr. Pardeep Kumar through virtual
hearing at the Central Administrative Tribunal, Principal
Bench.Ms. Gauri Puri appeared on behalf of the Applicants in
both matters. The Hon’ble Tribunal was informed by the
Counsel for Respondents No. 1, 3 & 4, Mr. Manjeet Singh Reen,
that the Reply has been filed. The Counsel for Respondent
No. 2 (MTNL), Mohd. Faisal further sought 3 weeks time to
file their Reply. On this, the Hon'ble Tribunal granted 3
weeks time to file their Reply to Respondent No. 2 and
further 2 weeks time to file Rejoinder to the Applicants if
required. In the BSNL matter, the Hon’ble Tribunal was

Respondent No. 2 (BSNL), Mr. R. V Sinha submitted that it is
the matter of policy and Respondent No. 2 has no role to
play in it and sought further 2 weeks time to file their
Reply. On this, the Hon'ble Tribunal gave 2 weeks time to
file their Reply to Respondent No. 2 and further 2 weeks

AIRBSNLEWA discussed with Sr GM(Esst) BSNL CO ND and
expressed our serious concern against non payment of final
instalment of gratia to VRS optees of BSNL and MTNL .Sr G M
(Esst) informed that there is delay fromCircles in
providing final requirement of Ex- gratia to VRS optees of
BSNL and MTNL, still 25000 to 26000 VRS optees of BSNL
information of Ex gratia is awaited from Circles .Director
(HR) BSNL Board is sending a reminder DO to all the CGHS for
sending immediate requirement to BSNL CO fixing personnel
responsibility. He assured an early action in this regard.
(b) Corrections in the PPOs of VRS optees of BSNL mentioning
payment of pension under Rule-37A insteed of ' BSNL VRS-2019
sheme' SR GM Esst mentioned that after our association
meeting with Director(HR) a DO was sent to DoT by
Director(HR) for necessary corrections but still no order
from DoT is received in this regard. Further a reminder will

gratia final instalment payment:-
Comrade Prahlad Rai GS AIRBSNLEWA discussed with DDG PM DoT
and discussed regarding payment of Ex gratia final
instalment to VRS optees of BSNL. DDG PM mentioned that DoT
has sent letters to DOE for the allocation of funds to
release Ex gratia final instalment payment but the funds
have not been allotted in this connection. However, it is
expected that funds allotment will be there in the first
week of November 2020 and Ex gratia payment can be made
before Dipawali. |
01-10-2020: Revision
of pension of BSNL pensioners- Court case:
Dear Comrades,
As you are aware that AIRBSNLEWA CHQ has filed the Court
case in the Hon'ble PBCAT New Delhi for revision of pension
of BSNL pensioners. Pension Revision of BSNL pensioners is
due from 01-01-2017 but DoT waited for 3rd PRC
recommendations for the pay revision of BSNL employees which
was notified in the month of August 2017. On the basis of
3rd PRC report BSNL Board recommended for Pay Revision of
BSNL employees to DOT with 15% fitment benefit in October
17. But DoT administration raised many quarries regarding
affordability and finally kept pending pay revision of BSNL
employees due continuous losses in BSNL .The pension
revision of BSNL pensioners is not considered on the pretext
of non-revision of pay of BSNL serving employees.
AIRBSNLEWA CHQ continuously tried to convince the Hon'ble
MOC, Secretary DoT, Secretary DPE and the concern officers
of DoP&W but the DoT administration categorically told that
since the pay revision of BSNL employees has not taken place
the pension revision of BSNL pensioners cannot take place
other wise pension anomaly will cause i.e.the pre 2017
pensioners will get higher pension then to those who will
retire after 01-01-2017.The anomaly issue was referred to
DoP&W for comments wherein DoP&W replied to DoT to provide
the formula to avoid pension anamoly. But DoT did not reply
to DoP&W and kept pending the issue unresolved. AIRBSNLEWA
CHQ continued its efforts to convince the DoT/ DPE/DoP&W
officers to delink the pension revision of BSNL pensioners
from pay revision of BSNL employees since their pension
contribution was regularly paid by BSNL to DoT on the
maximum of the pay scale as serving employees. Hon'ble MOC
on the Parliament floor and DoT administration categorically
told that pension revision of BSNL pensioners will follow
pay revision of BSNL employees.
All these developments were discussed in detail in the 3rd
AIC of AIRBSNLEWA held at Vijaywada and decided to file a
court case in PBCAT New Delhi for revision of pension of
BSNL pensioners. Accordingly sincere efforts were made by
our CHQ and in particular by our Dy GS Late Comrade Amit
Gupta ji to collect the necessary documents under RTI from
DoT/DPE/DoP&W etc .The draft of OA was prepared by Comrade
Amit Guptaji Dy GS AIRBSNLEWA and after several discussions
among CHQ Office bearers. The draft was finalised by
AIRBSNLEWA CHQ and later on it was shared with the leaders
of other BSNL/ MTNL pensioners Associations wherein their
suggestions were also incorporated. For BSNL pensioners
AIRBSNLEWA and SNPWA came to gather to file the case In the
Hon'ble PBCAT New Delhi along with MTNL pensioner's three
Associations .For MTNL pensioners Associations Comrade M K
Bagchi, President RTWOA MTNL took the lead in coordinating
and finalising the OA draft for MTNL pensioners. Comrade GS,
President CHQ, Dy.GS and some comrades of Delhi Circle along
with other Association leaders of BSNL/MTNL met our
Advocates on many occasions to finalise the OA. After
detailed discussions wit some additions and deletions the
draft OA was finalised. Finally our Advocates Sh Rajshekher
Rao and Madam Gauri Puri filed two OAs one for BSNL and
other for MTNL pensioner Associations on 09.09.2020, which
was admitted and posted for hearing on 3rd
November 2020 for
hearings. For BSNL pensioners AIRBSNLEWA and SNPWA has filed
the OA and for MTNL pensioners RTWOA with two other
Associations has filed the case in the Hon'ble PBCAT New
Delhi.
To contest the case regular persuasion and pleadings are
required through our Advocates for which legal expenses will
be there. To meet the legal expenses AIRBSNLEWA in its
Extended Central Executive Committee virtual Meeting held on
19th September 2020 has unanimously decided to collect
Rs 1000/- per member from the branches/ circles and to be
deposited in AIRBSNLEWA CHQ Account through RTGS or NEFT
at the earliest.
Thus we earnestly appeal to all our members to deposit Rs
1000/- per head in CHQ Account through their respective
branches please.

conducted its Extendeded Central Executive Committee meeting
on 19th September-2020 successfully:-
Dear Comrades, Yesterday on 19th
September 2020 Extended (CEC) Central Executive Committee
Meeting was conducted on Google meet commenced sharply at 7
pm and ended by 10.15 pm. Before commencement of the meeting
Comrade President Kishan Singh Ji in his opening remarks
welcomed all the participants and requested to observe two
minutes silence in the memory of our beloved late Comrade
Amit Gupta Ji Dy GS on his sad demise. After this Comrade
President requested all the participants to discuss the
agenda in time limit to give chance to every body .He also
apprised the status of various court cases filed by
AIRBSNLEWA. Comrade GS while welcoming all the esteemed
participants emphasized on the following points and
interacted with all very actively as usual.
1.To immediately form the Circle bodies/District branches in
the Circles and BAs wherever not yet done.
2.Augment our membership base by enrolling more members.
3.Last installment of exgratia of VRS retirees is expected
to be paid by this month end.
4.Delay in reimbursement of long pending MR Claims has been
very strongly taken up with CMD and favorable actions are
anticipated.
5.CGHS payment reimbursement is
being done regularly in all the Circles as assoured by CMD
to this Association.
6. Retention of staff
quarters to VRS optees has been taken up but the BSNL
management has increased the rent on high cost which we have
further taken up and will discuss with Dir HR and CMD BSNL
further for reconsideration.
7.Unjustified deduction of income
tax on the unpaid medical claims has been protested on the
basis of information received from In come tax department
under RTI.
8.The individual issues of
some comrades are being taken up regularly. The ePPOs not
released in Maharastra Circle has also been discussed in
BSNL CO for an early settlement.
9, Discrepancies in the ePPOs
regarding mentioning of 'BSNL VRS SCHEME 2019' is to be
corrected as pension under Rule 37A CCS 1972 rules has been
taken up with DoT Member Finance and Director HR BSNL.
10.Court cases filed by AIRBSNLEWA CHQ for the payment of
78.2% IDA fitment benefit to BSNL pensioners wef 01-01-2007
instead of June 2013 pending in the Hon'ble High Court Delhi
and PBCAT New Delhi 6.Our Pension Revision case of BSNL and
MTNL pensioners filed by AIRBSNLEWA , SNPWA and MTNL
pensioners Associations respectively in the PBCAT New Delhi
are closely being monitored and follow up ensured. GS says,
DOT may go upto the apex court for which we have to be ready
and geared up fully.It is unanimously decided to collect Rs
1000/- per head as legal fund to plead the case.Since the
case has been filled in the name of the Association the
judgement will be applicable to all the members of the
Association.
11. Venue of the next CWC has been fixed as Hyderabad after
lifting of all the prevailing COVID Restrictions.
Issues brought to the notice of GS.
1. Non Mentioning of Commutation details in the EPPO issued
to VRS Retirees.
2. Retirees to be permitted to work as exclusive LCOs, if
desires, for the provisioning of FTTH.
3.Immediate releasing of CGHS payments.
4.Retention of staff quarters to VRS optees of BSNL.
GS agreed to look into the above issues etc.
Generally the virtual meeting was very good with quality
audio and video. Abuot 100 participants attended and
interacted in the virtual Extended CEC Meeting.Most of the
Circles representatives I.e. Assam, Bihar,Jharkhand,West
Bengal, Odissa, Punjab, Haryana Rajasthan, Utterakhand ,Himmachal
Predesh,Delhi UP East, UP West, MP, Gujarat,
Maharstra,Andhra Pradesh, Telengana,Karnataka, Kerala and
Tamil Nadu Circles very actively participated in the
meeting. Vote of thanks was extended by Comrade Pallab Bose,
AGS. Comrade GS also extended thanks to all the comrades for
their active participation and assured that their issues
will be taken up immediately at ' appropriate levels.

on the recognition of BSNL pensioners Association:-
Comrade Prahlad Rai GS
AIRBSNLEWA discussed with GM(SR) and expressed our concern
against the letter given to our Circle Secretary Maharashtra
Circle by AGM Maharashtra Circle office mentioning that only
recognized Associations can make the correspondence with the
Management. In this regards GM(SR) categorically told that
this provision is not applicable for the pensioners
Associations, it is applicable for the serving Executives
Associations only. He assured that he will speak with the GM
HR Maharashtra Circle and will clarify the provisions. |
08-09-2020: Settlement
of pensionery benefits with respect to the VRS Optees of
BSNL :-Comrade Prahlad
Rai, GS AIRBSNLEWA discussed with Sr GM(Esst) BSNL CO New
Delhi regarding settlement of pensionery benefits with
respect to the VRS optees of BSNL in Maharashtra Circle. Sr
GM(Esst) mentioned that he is aware of the matter and has
directed that all the VRS optees of SC/ST category have
apply online to the special committee for verification there
after on clearance the cases will be settled. He
mentioned that about 54 candidates have applied on line and
their cases are clear for them pensionery benefits are being
released. He advised that remaining people should also apply
and take clearance so that their pensionery benefits are
also released.
Corrections in the ePPOs by CCAs:-
We told him that in his presence only the matter was
discussed with Director(HR) and then and there only
Director(HR) spoke over phone with DDG(Acconts) DoT and
explained him that in ePPOs pension rule should be written
under 37A of CCS rule 1972 insteed of BSNL VRS 2019 scheme.
Sr GM(Esst) mentioned that after this meeting immediately a
DO letter was sent to DoT for necessary corrections. He
assured for sending a reminder to DOT on this issue for an
early action. |
07-09-2020:
Final Payment of Ex-
gratia to BSNL and MTNL VRS optees:
Comrade GS Prahlad Rai discussed with Member(Finance),
DOT regarding final payment of Ex-gratia
to VRS optees of BSNL and MTNL. Member(Finance) told that
BSNL has to submit the actual requirements to DoT there
after immediately funds will be released.
He further mentioned that BSNL is preparing
requirement after during all the dues adjustment as this is
the final instalment payment. He advised to pursue in BSNL
for sending the requirement to DoT as early
as possible. Releasing of required funds will not be
the problem from DoT.
(2) Corrections in ePPOs
of VRS optees of BSNL :
We requested Member(Finance) to issue necessary instructions
to CCAs for making correction in SAMPAN Software for
mentioning pension payment under
'Rule 37A"
of CCA pension rule
1972 instead of
'BSNL VRS scheme'.
Member(Finance) told that necessary corrections have
been made in SAMPAN Software however regarding problems of
Kolkatta CCA he assured that he will speak with CCA Kolkatta
for necessary corrections.

Disbursements Comrade Prahlad Rai GS AIRBSNLEWA discussed
with Director (Finance) BSNL Board and discussed regarding
payment of long pending medical claims of BSNL pensioners
which are not paid for the last two years. Director
(Finance) appreciated our concern and mentioned that due non
availability of funds these medical claims could not be paid
however he assured that some funds will be released on this
account to settle pending medical claims. |

are extremely shocked due to sudden death of Comrade Amit

We lost our beloved
Veteran Comrade Amit Gupat Ji, he last breathed today night
at 12.30 Hrs and expired with massive heart attack .Untimely
death of Comrade Amit Guptaji Dy GS AIRBSNLEWA is great loss
to his family and AIRBSNLEWA.
First time I met Comrade Amit Ji in Delhi R K Puram in the
Earstwhile JETA being led by Comrade M K Bagchi Ji as GS.
Comrade Amit Dada was CWC
member of JETA from West Bengal Circle and I was also CWC
member from Rajasthan Circle in the year 1983.........I was
highly impressed with his deliberations and got
motivated.......in the year 1986 Comrade Amit Dada was
Circle Secretary, JETA WB Circle and that time our burning
issue was revision of pay scale of JE Telecome and JETA
launched active trade union actions in terms of Work
Accordingly to Rule which was treamondus success.....during
this struggle Comrade Amit Guptaji was closely associated
with Comrade M K Bagchi GS JETA and played very important
role in achieving JE pay scale revision. During this
agitation period only he very successfully conducted
historical CWC meeting at Binani Bhawan Kolkata where the
strategies were finalised for the success of agitation and
settlement of the demand. Like we continued to work in JTOA
as Circle Secretaries till our
promotion as SDE in the year 1993-94...July 1994 I was
elected CS TESA and Amit Dada as CWC WB Circle and then CS.
After the formation of BSNL CCC Central Coordination
committee of DOT recognised Associations was formed and the
first Convention of CCC was convened at Kolkatta Binani
Bhawan wherein the decision of merging 10 DoT recognised
Associations was taken and formation of AIBSNLEA. Comrade
Amit Ji was the Circle Secretary, EarstwhileTESA WB C 7ircle
and was instrumental in the formation of AIBSNLEA. Comrade
Amit Guptaji worked as CS AIBSNLEA till AIC Kolkatta held in
2010-11 and then worked as OS East, AIBSNLEA till AIC Nasik
and Coseltant till AIC Vijaywada held in July-2019.
Comrade Amit Guptaji was elected as Dy GS,
AIRBSNLEWA in its AIC at Vijaywada and he was continuously
working for the issues of pensioners mainly drafting the OA
for Pension Revision of pension of BSNL/MTNL pensioners.
He was very much concern for
the pension revision and pursued me to Comrade Jogi, GS
SNPWA and Comrade M K Bagchi to file the court case since
DoT is denying pension revision without the pay revision of
BSNL employees and with his hard work he collected all the
necessary documents under RTI from DoT, DoP&W and DPE
etc.Finally yesterday the draft OA was finalised by our
Advocate Mr Rajshekher Rao and being filed on Monday or
Tuesday in PB CAT ND. Yesterday evening we had discussions
on the pension revision court case wherein Comrade Amit
Guptaji expressed his happiness that OA is has been
finalised and being filed in the Hon'ble PBCAT New Delhi on
Monday or Tuesday......I told him that whole credit goes to
him only who has made sincere efforts in collecting all
relevant documents for the last two years and drafting the
OA........this was my last with him yesterday..........I
lost my personal friend, family friend, well-wisher,
guiding factor, he only inspired me to become GS AIBSNLEA
and GS AIRBSNLEWA.....he was only doing our day to day work
of the Association. It is
irreparably lose to the BSNL and MTNL pensioners and
Employees............we convey our heartfelt condolences to
the bereaved family of Comrade Amit Guptaji Dy GS AIRBSNLEWA
on his sad demise.....we pray almighty God to rest soul in

Renting Out Policy (CROP 2020) for renting out its unused
assets including Residential Accomodations. This will solve
the issue of accomodation to pensioners who are still

Prahlad Rai GS AIRBSNLEWA discussed with DDG PM DoT
regarding the information being spread on whatsapp groups on
2nd VRS in BSNL from September-2020. DDG (PM) DoT clarified
that there is no such proposal pending or in process in DoT
to bring 2nd VRS in BSNL. At present 65000 employees are
there in BSNL and are required to run BSNL. These are rumors
only.
2. Payment of Ex gratia 4th installment in BSNL. On this
issue DDG(PM) informed that DoT has send a proposal to DOE
for the allocation of Budget of Rs 1200/- Crores to release
the payment of 4th installment to VRS optees of BSNL. And
either on receipt of budget allocation or the direction to
release Ex gratia payment from the DoT funds is available by
31-07-2020, the Ex- gratia will immediately be paid. |

payment to VRS optees of BSNL:
Comrade Prahlad Rai GS AIRBSNLEWA discussed with DDG PM
DoT today 10th July 2020 regarding payment of Ex gratia
3rd installment to VRS optees of BSNL. DDG PM DoT
informed that DoT is releasing 3rd installment of Ex
gratia to VRS optees of BSNL today about 38%. Thus total
92% Ex - gratia amount is paid against the comlete Budget
allotment of Rs 9988/- Crores.Now DOT will further ask
Budget allotment of Rs 1200/- Carores from Ministery of
Economic Affairs for the remaining 8% Ex-gratia amount
payment to VRS optees of BSNL .He also mentioned that in
case Ministry of Economic Affairs allow DoT to make the Ex
gratia payment from DoT fund than immediately remaining 8%
extra gratia amount will be paid before 31st July-2020
itself. DDG PM assured that Final Ex gratia payment will
be made in the month of August 2020 .He also informed that
still about 1800 PPOs are to be issued and their Ex gratia
payment has to be made available.

Covid-19 no local buses, Metro and trains are available

office and complete the formalies.Also difficult for them to
apply through online since they are not fully equipped or
computer friendly. We requested to extend with voucher/
without voucher option upto 31st August 2020 and not to fix

Comrade, Prahlad Rai ,GS AIRBSNLEWA discussed today
(5-6-2020) with DDG(PM) DoT regarding payment of Ex gratia
to VRS optees of BSNL. DDG(PM) informed that govt has
already allocated the budget amounting about Rs 9000/-
Crores for the payment Ex-gratia to VRS optees .Member
(Finance) has personally gone to Ministry of Economic
Affairs for relaxation in the capping of expenditures.
Secy(T) has also given letter to Secy DoE in this regard.
DDG(PM) mentioned that they are confident that about 60% Ex-gratia
payment will be made before 30th June 2020. He further
mentioned that about 62000 ePPOs have been issued by most of
the CCAs all over the country.
(b) Regarding retention of residential quarters to VRS
optees for next two years on nominal rental charges. DDG(PM)
assured that after 30thJune 2020 this matter will be
examined and necessary action will be taken. |

informed that letters have been sent to Ministry of Economic
Affairs for relaxation in the capping of expenditures.
In
view of Covid-19 government has directed to spent 5% of the
allotted funds in every month. Meetings in this regards have
also taken place in DoE. They assured that efforts are being
made to make the Ex- gratia payment to VRS optees of BSNL
before 30-06-2020. They were confident that Ex- gratia
payment will be made before 30-06-2020. |

Prahlad Rai, GS AIRBSNLEWA discussed with Senior officers of
DoT and enquired about the payment of Ex-gratia to the VRS
optees as per the Govt. decision. It was informed that the
budget allocation has been received in DoT for the payment
of remaining 18.7% of 1st installment and 50 % of the 2nd
installment which will be paid immediately before 30th
June-2020. Secy(T), DoT will be meeting Secy(DoE) shortly for the
relaxation in capping imposed on payments due to Covid-19.
They also informed that till date about 53000- 54000 PPOs
have been issued by the respective CCAs out of about 90000
retirees. DoT is making sincere efforts to ensure release of
all the PPOs before 30-06-2020 so that the Ex- gratia
payment is made to all VRS optees. |

AIRBSNLEWA Rajasthan circle today evening at 18.00Hrs hold

reimbursement has been made with efforts of AIRBSNLEWA. CHQ
has requested to CMD BSNL for early payment of pending
medical claims and after opening of lock down our GS will
meet personally CMD, BSNL in this regard, he also apprised
the status of the Court cases on 72.8% fitment benefit wef
1-01-2007 and explained that since DoT is not revising the
Pension of BSNL pensioners on the pretext that Pay revision
of BSNL employees has not taken place, in view of this after
waiting for the last three years now legal action is the
only way to get resolved the issue. Comrade Amit Gupta Dy GS
in his address impress upon to growth of the Association by
enrolling more members to strengthen the Association. He
also explained the need of filing a court case in PBCAT ND
on pension revision case. Comrade Kishan Singh Ji, President
requested all the members to contribute for court case on
pension revision of BSNL pensioners court case. After detail
discussions for one hour Comrade M L Ostwal Circle Secretary

2020 pension:
Comrade Prahlad Rai GS AIRBSNLEWA discussed with CCA Jaipur
and expressed our concern that CCA Jaipur has not given IDA
fixation @160.7% in the April2020 pension to BSNL
pensioners. CCA Jaipur appreciated our concern and mentioned
that due to confusion on the basis of Govt decision to freez
the CDA for Central Govt Employyees and pensioners the
pension was prepared before 28-04-2020 i.e. before issuance
of the DoT order in this regard. He confirmed that
Advisor(Finance) DOT has also discussed the matter with
him. However CCA Jaipur assured that IDA arreare will be
paid as per DoT order soon. |
29.04.2020: With
holding of IDA of BSNL / MTNL Pensioners in the month of
April 2020:
Comrade Prahlad Rai, GS AIRBSNLEWA discussed with Advisor
(Finance) DOT today and expressed our concern against with
holding of IDA of BSNL and MTNL pensioners for the month of
April 2020 and giving IDA fixation 157.3% to the BSNL and
MTNL pensioners wef 01-01-2020 instead of 160.7% (on present
rate) by respective CCAs.
Advisor(Finance) DoT appreciated our concern and assured to
discuss the matter with concern officers of CCAs to make the
payment of IDA @ 160.7% in April Pension as per DPE orders.
Regarding DoT order to fix up the pension wef 01-01-2020 @
157.3% to the employees retiring in April 2020, he informed
that it is done in view of the probability that in case DPE
endorses the DOE order dated 23-04-2020 then recoveries may
be avoided from the pensionery benefits.
We requested to withdraw DoT letter dated 28-04-2020 in this
regard. Advisor(Finance) informed that matter is under
discussions in Ministery and shortly some final decision
will be taken. |

01-01-2020 to 31st July-2021- impact on IDA:-
Comrade Prahlad Rai, GS AIRBSNLEWA discussed with Sr GM(Esst)
BSNL CO and discussed regarding freezing of DA of Central
Govt. employees and pensioners wef 01-01-2020 to 31st
July-2021 and it's impact on IDA of CPSU employees and
pensioners. Sr GM Esst BSNL CO mentioned that he has
discussed the matter with concern DoT officers and it was
informed that till the time DPE issue the orders DoT/ BSNL
can't issue any order in this regard. We also discussed that
IDA for the last quarter January 20 to March20 has been
implemented in BSNL. VRS optees pensionery benefits e.g.
leave encasement and Ex gratia etc have been paid on the
last pay drawn including IDA effecting from January 2020,
thus any order can't be implemented retrospectively. He
further mentioned that let the DPE issue order in this
regard than only any action will be taken by DoT/ BSNL .
It is to be mentioned that till today evening DPE has not
issued any order on IDA freezing. |

Haryana Circle Formed:
First meeting of AIRBSNLEWA Haryana was held at Gymkhana
club Karnal on 6/3/2020 to elect the circle body. Sh O P
Kamboj RETD DGM(F), Sh Darbara Singh AGM RETD, Sh O. P VERMA
CAO RETD were elected unanimously as CP, CS and FS
respectively. The Circle started its Journey with 22
members, who attended the meeting. Very soon Branch
Committees will be formed in all SSAs.

Meeting with DDG(PM) DoT 13.03.2020:-

Comrade GS Prahlad Rai met DDG (PM) DoT and discussed
regarding
1)Discrepancies in the ePPO issued by CCAs to the employees
retired on VRS:
DDG(PM) appreciated our concern and advise us to meet
Member(Fin) DoT for necessary corrections. Accordingly we
tried to meet Member (Fin) but due to his business in some
meetings we could not meet him today but submitted our
letter on discrepancies in ePPOs(<<<Click here

However we will meet Member (Fin) shortly to resolve the
issues.
(b) Payment of Ex gratia, leave encasement to the employees
retired on VRS:
DDG(PM) mentioned that leave encasement is being paid by
BSNL shortly and regarding payment of Ex-gratia Rs 5000
crores funds have allotted by Govt against the requirement
of Rs 8200 crores for 50% payment of Ex-gratia.Through this
fund about 40% ex-gratia payment of first installment will
be paid before 31st March 2020 and remaining 60% ex- gratia
amount will be paid in the next financial year.
(c)
Regarding rumers on social media on next VRS in BSNL:DDG(
PM) categorically told that in DoT there is no such proposal
is under consideration at all. This is falls propaganda
only....need not be believed. |
13.03.2020:
Meeting with Director (HR) BSNL Board 13-03.2020:
Comrade GS Prahlad Rai met Director (HR) BSNL Board and
discussed regarding
1) Discrepancies in the ePPO issued by CCAs to the employees
retired on VRS as mentioned in our letter serial nos 1 to
10:
Director (HR) appreciated our concern and immediately spoke
with DDG Accounts DOT and discussed the discrepancies in
ePPO as raised by us(<<<Click here

He expressed his concern and asked him to correct the
discrepancies in ePPOs of VRS optees. DDG Account DoT
assured him to look into the matter and meet him in person
today evening to discuss the matter. Director (HR) also
marked our letter dated 09.03.2020 to Sr. GM(Esst) BSNL CO
to put up for necessary action. Sr. GM(Esst) and GM(SR) were
present in the meeting. Director (HR) assured an early
action in this regard.
(b) Payments of Ex-gratia, Leave encasement to the retirees
on VRS:
Director ( HR) mentioned that Leave encasement payment will
be made shortly and Ex-gratia payment will also be paid
before 31st March 2020.
(C) Reimbursement of CGHS contribution paid by BSNL
pensioners as one time measure in all the Circles:
We requested Director (HR) to release funds to all the
Circles to clear the pending claims of CGHS contribution
paid by BSNL pensioners as one time measure. In some Circles
it has been paid as assured by CMD BSNL but in many circles
viz Telangana, Andhra Pradesh, West Bengal and NTR/NTP
circles no claims are settled till due to non availability
of funds. Director (HR) assured to look in the matter for
early settlement of the claims. |

Report from Advocate on record.
The captioned matter was listed before Hon'ble High Court
yesterday as item No. 15 before a bench comprising of
Hon'ble Justice Siddharth Mridul and Hon'ble Justice i in
Court No. 37.
Mr. Rajshekhar Rao appeared on behalf of the Petitioner,
instructed by me. Counsel for the Respondents were also
present.
Pursuant to the previous Order, the matter was listed for
preliminary hearing. Due to paucity of time, the matter was
not taken up and the same was mentioned by Mr. Rao at about
4:30 PM seeking an early hearing. Mr. Rao apprised the Court
that a short date maybe given in as much as the matter
pertained to retired BSNL officers seeking increased
pension.
Accordingly, the matter has been placed before the Ld. Joint
Registrar on 12.04.2020 for completion of pleadings, and on
26.05.2020 for hearing before the Court. |

regarding implementation of Rule206 for the eligible
executives. PGM (pers) mentioned that some executives have
filed the contempt petition in this regard in the Hon'ble
Supreme court which was recently heard wherein BSNL Sr
Advocate Shri RD Aggarawala further asked to Submit the
rejoinder which was considered by the Hon'ble Supreme court
and now the case has been posted for hearings on 28th April
2020.He explained that let now the Hon'ble Supreme court
clarify the judgement thereafter only further action will be
taken by BSNL. |

First Circle Executive Commitee Meeting at Jaiselmer on 29th
February 2020:
AIRBSNLEWA Rajasthan
circle hold its First Circle Executive Meeting at Jaiselmer
on 29th February2020. In the opening remarks Comrade K G
Arora Circle President welcomed all the members and
requested to cooperate the dias in completing the agenda.
Comrade M L Ostwal Circle Secretary in his welcome address
explained the status of BSNL pensioners and requested for
strengthening AIRBSNLEWA. After the self introduction
comrade R C Vyash TDM Jaiselmer welcome the CEC Members in
Jaiselmer The 'Golden City of India'. He assured full
cooperation in conduction of the CEC Meeting. All the
Distrct secretaries submitted their reports. The District
Secretaries Barmer, Bhilwara, Jaipur, Jaiselmer, Nagaur,
Jodhpur and Udaipur District branches gave their reports.
Asst Circle Secretaries and Organising Secretaries also gave
their report. Comrade Circle Secretary sum up the report and
placed his report wherein he explained that in true sense
AIRBSNLEWA is settling the issues of BSNL pensioners and
requested to strengthen AIRBSNLEWA by doing hard work. He
informed that in Rajasthan Circle the CGHS contribution paid
by BSNL pensioners as one time measure has now been
reimbursed with the help of AIRBSNLEWA CHQ. He informed that
in Rajasthan circle all the branches at all SSAs are being
formed shortly. Sriganganagar DS could not attend the CEC
Meeting due to his personal work. He assured full
cooperation to CHQ.
Comrade Prahlad Rai GS AIRBSNLEWA in his address extended
thanks to Rajasthan circle for organising First Circle
Executive Meeting at Jaiselmer on 29th February in a
befitting manner. He appreciated the efforts of Rajasthan
circle body in growing AIRBSNLEWA in all the District HQs.
He assured full cooperation and support of CHQ. Comrade GS
in his address explained the status of the issues related to
BSNL pensioners ie Reimbursement of CGHS contribution paid
by BSNL pensioners as one time measure in lieu of BSNL MRS,
efforts for the settlement of pending medical claims,
payment of GPF, Ex gratia, leave encasement, protested
against the wrong mention of Pension rule in the PPOs of VRS
optees instead of Rule-37A under CCS 1972 rules, provisional
pension to VRS Optees and filing of court case on 78.2%
fitment benefit and revision of pension of BSNL pensioners
since the Govt is linking pension revision of BSNL
pensioners with the pay revision of BSNL employees. He
informed that in all the Circles AIRBSNLEWA Circle and
District Bodies are being formed shortly. CEC Jaiselmer co
opted Comrade AK Tiwari Retd DE as Organizing Secretary West
Zone, Comrade Devi Lal Retd CAO as Organizing Secretary
South Zone and Comrade P C Khandelwal Retd. DGM finance as
Circle Vice President and Comrade R C Vyash as CWC member..
Jaiselmer, Barmer and Nagaur Districts Branches were formed.
Both the Organising Secretaries and Secretaries assured to
form the branches in all the Districts to increase the
members.
After passing the resolutions comrade R C Vyash TDM
Jaiselmer extended Vote of thanks. Comrade K G Arora Circle
President declare the CEC closed. All the CEC Members
attended and felicitated to Comrade R C Vyash TDM Jaiselmer
on his retirement on superannuation on 29th February 2020
Comrade GS in his address appreciated the contribution of
Comrade R C Vyash in JTOA, TESA and AIBSNLEA. The CEC
Meeting was organised in a nice manner.

GRANT OF ONE NOTIONAL INCREMENT FOR
THOSE RETIRED ONE DAY EARLIER TO INCREMENT :Supreme
Court of India has allowed the petition of
Sh. P Ayyamperumal of Tamil Nadu for
granting one
notional increment for his retrial benefit as he retired
one day earlier to his increment day. Subsequently MP High
court also allowed similar benefit to Sh Rajendra Prasad
Tiwari. For finding out the final decision of Govt in P
Ayyamperumal
case, our
Deputy GS Com Amit Gupta filed a RTI to Finance Ministry
as below:
1) whether the subject matter as refered in your letter
no F no A 26017/16/2019 -AD.IIA dt 18-3-2019 regarding
grant of one notional increment to those who are
retiring earlier day of his next increment has reached
to a finality.
2) if not then what is the present status of the case.
3) If yes then kindly provide a copy of the final order.
In
reply the Ministry of finance has furnished a copy of
their final decision. They have allowed such benefit only
to Sh
P Ayyamperumal as according to them the court decision is
in personam not in rem.
Now the
similarly placed pensioners also may take legal action for
extending such benefit to them. Before that they have to
represent along with the documents for creating the ground
for legal action. All papers are placed below for their
ready reference.

17.02.2020:
Today we met Pr. CCA Kolkata
and enquired about payment of provisional pension to VRS
retirees. Pr CCA confirmed that as per order issued by DOT
they are all set to pay provisional pension on 29th
February, 2020 provided the information as mentioned in
Annexure- A & B from BSNL in excel sheet is received.
Therefore, all are requested to ensure that information as
per annexure A&B are sent by BSNL offices to concerned CCA
offices in time.

RTI on Income Tax Deductions on Medical Reimbursement: Com
Amit Gupta Our Deputy GS file a RTI applications asking
some information on TDS deductions on medical
reimbursements. Income Tax authorities have finally
replied the queries as below. As per reply of Question No
3, the practice of BSNL to deposit TDS without actual
specified payment is not as per rule. We shall be taking
up the issue with BSNL CMD soon.
Question 1) Information on the actual rules of Income
Tax for paying Tax and deducting TDS on:
a) For
reimbursing actual expenses for outdoor Medical treatment
to senior citizens
b) For
reimbursing actual expenses for Indoor Medical Treatment
to senior citizens
c) Are
such reimbursements as a & b above to the Senior Citizens is
considered as taxable income and for which TDS are to be
deducted and I Tax is to be paid ?
Reply : Yes according to Union Budget 2018, reimbursement
on actual expence for outdoor & Indoor medical treatment
to senior citizens is considered as taxable income in
respect of employees other than Government employees and
for which TDS is to be deducted and Income Tax is to be
paid.
Question 2)
CGHS is not deducting any TDS. Kindly inform whether the
reimbursement received by CGHS beneficiaries on account of
1a & 1b above is a taxable income? Pl note that CGHS is
supposed to extend free treatment to its beneficiaries.
Question of reimbursement comes only for some specialised
treatment or medicines which CGHS cannot provide in house.
Reply:
Reimbursement received by CGHS beneficiaries on account of
1(a) & 1(b) above is not a taxable
income.
Question 3)
BSNL is deducting TDS on the medical reimbursement claims
of the pensioners which are ready for payment but not
actually paid (only liabilities are created in their
system).
a) Kindly
inform the rule of I Tax for such TDS deductions of
actually unpaid claims.
b) How
long such claims for which TDS is deducted can be kept
pending.
Reply : 3(a) TDS on medical reimbursement claim is
deducted on actual payment u/s 192 of IT Act 1961 & Rule
3 of Income Tax Rules, 1962
3(b) Any person making specified payment mentioned under
Income Tax Act are required to deduct TDS at the time of
making such specified payment which is to be deposited to
the Government by 7th of
Subsequent month.
Since
this issue relates to the internal practice of the BSNL,
Hence this office is unable to give any specific reply.
Question 4)
BSNL is deducting TDS for the reimbursement of lifetime
contribution paid to CGHS by the pensioners who are
migrated to CGHS. Kindly inform the I Tax rule for such
TDS deduction.

Special General Body meeting
of AIRBSNLEWA Rajasthan Circle at Jaipur:-
AIRBSNLEWA, Rajasthan circle
hold its special GB meeting on 15th Feburary 2020 in
Federation Hall, PGMTD, Campus, Jaipur to welcome the new
members retired on VRS and superannuation. Comrade K.G. Arora
Circle President welcomed all the members and guests and
requested all the members to strengthen AIRBSNLEWA by
enrolling more members.

superannuation are present today in this meeting and taking
life long membership. He assured to strengthen AIRBSNLEWA by
bringing more members.

Rai for settling the issues of BSNL pensioners and
strengthening AIRBSNLEWA.
Comrade GS Prahlad Rai
in his address congratulated the AIRBSNLEWA Rajasthan Circle
body for organising a nice meeting to welcome the new
members retired on VRS and superannuation and welcome the
new members. He explained that AIRBSNLEWA was formed in the
year 2009 with help of AIBSNLEA CHQ and functioning very
well through out the country. More than 5000 members are
there which will further increase on joining of new members
retired on VRS and superannuation. Thus the membership will
grow many folds. Rajasthan circle will also have District
Bodies in all the districts at the earliest before CEC
Meeting at Jaiselmer on 29th February 2020. He explained the
achievements of AIBSNLEA during his tenure as GS AIBSNLEA
and assured that he will continue his efforts for the
settlement of BSNL pensioners issues manly Pension Revision
of pension of BSNL pensioners. He explained that with the
efforts of AIRBSNLEWA CHQ the 60:40 provisions in pension
payment was withdrawn, CGHS contribution paid by BSNL
pensioners as one time measure has been reimbursed. He
explained the status of court case on pension arrear payment
of 78.8% fitment benefit wef 1-1-2007 in the Hon'ble PBCAT
ND and Hon'ble High Court Delhi. Also explained that DoT is
not revising the Pension of BSNL pensioners on the pretext
that Pay revision of BSNL employees has not taken place
which is not justified. Now AIRBSNLEWA CHQ has decided to
file a court case in PBCAT ND for revision of pension of
BSNL pensioners shortly.
He requested all the members
to contribute for court case as and when it is requested. At
last he thanked AIRBSNLEWA Rajasthan Circle for arranging a
excellent meeting. In the interactive session Comrade GS
explained that there is no difference between normal
retirement on superannuation and retirement on VRS. Both are
getting pension under Rule 37A CCS 1972. The half ex-gratia
payment to VRS optees will paid before 31st March 2020.
Leave encasement payment will be released after the NOC. GPF
payments are being made. December 2019 salary is released
today and CGHS contribution will be paid to BSNL pensioners as one
time measure along with this etc.

14.02.2020: Today
our Second Pension Arrear Case OA 1018/2018 along with MA
2021/2018 for condonation of delay came up for hearing in
court no 2 PCAT New Delhi.
BSNL advocate pleaded for
dismissal as similar OA 2260 is already dismissed. Our
advocate protested and cited judgement of Chandigarh CAT
which went in favour of pensioners. DOT advocate mentioned
that he has not received MA for condonation of delay. Our
advocate mentioned that it is available with OA only. Court
has adjourned the case to 13th April 2020. |

10.02.2020: Status
of Rule 206 court case in the Hon'ble Supreme court :
The contempt petition filed by Comrade Karan Singh and
others in the Hon'ble Supreme court on wrong implementation
of Rule206 by BSNL. The Hon'ble Supreme court judgment was
delivered on16th December 2016 . Today Shri Rajshekher Rao
Advocate pleaded the case and asked time to file the
rejoinder. Hon'ble Supreme court posted the case for hearing
on 2nd March2020. |

General Body meeting of Varanasi Dist. UP (East) Circle on

A well organized
special General Body meeting of “ALL INDIA RETIRED BSNL
EXECUTIVES' WELFARE ASSOCIATION” Varanasi, District UP(East)
Circle was held on 28th Jan 2020 at Hotel The AMAYA in
Varanasi in the presence of Sr. Com Rameshwar Lal, Com
Pallab Bose Circle Secretary & Circle Finance Secy Com
C.S.Verma.
BSNL pensioners
from Varanasi, Mau, Gazipur & Jaunpur district attended the
meeting, which lasted more than 4 hours. The meeting started
with opening remarks from Com Preetum Chandra Varanasi Dist.
President and he welcomed all members of Association.
Com Pallab Bose
Circle Secretary apprised the members about “AIRBSNLEWA”
being the only association which is seriously working for
the welfare of Rtd BSNL executives for a very long time. He
expressed his concerns regarding BSNL's current financial
situation.
All the present
developments related to pensioners were explained in detail.
He also discussed other critical issues such as the Pension
revision, medical issues, CGHS scheme, VRS and explained the
actions being taken by AIRBSNLEWA. Com Bose CS informed the
house regarding our associations organisational activities
in detail such as how we repealed the 60:40 clause of
pension formula by which our pension is secured today. He
requested all attending VRS executives to become member of
this Association.

Comrade Prahlad Rai GS AIRBSNLEWA, Comrade Kishan Singh Ji,
President CHQ ,Comrade M K Bagchi, Chief Mentre and Comrade
A K Kaushik, Legal Advisor, attended and address the
meeting. Comrade Nandi, Circle President welcomed all the
members and guests. Comrade A G Ram ji, CS Delhi Circle
explained the activities of Delhi Circle. Comrade GS in his
address explained the status of organisational matters e.g.
pension revision of BSNL/MTNL Pensioners, CGHS facility
instead of BSNL MRS and viability of BSNL and MTNL etc.
Comrade GS also explained the status of the Court cases on
pension related issues i.e. 78.2 % fitment benefit to BSNL
pensioners wef 1-1-2007 , rule 206 contempt case, pension
revision case to be filed. Writ Petition filed by AIRBSNLEWA
on 78.2% fitment benefit was heared in Hon'ble High Court
Delhi on 24th January 2020 and posted for hearing on 11th
March2020. Our advocate Shri Rajshekher Rao pleaded for
delinking of our case from other Association case due to
difference in prayer which was also not protested by the
other Association advocate. 78.2% fitment benefit 2nd case
filed by AIRBSNLEWA in PB CAT ND is coming for hearing on
11th February 2020. Contempt case filed by some individuals
is coming for hearing on 10th February 2020 in the Hon'ble
Supreme court in court no 6 .The application filed by
AIBSNLEA in the Hon'ble Supreme court for clarification on
Rule206 judgement delivered on16th December 2016 is being
pursued for an early hearing. AIRBSNLEWA CHQ alongwith other
sister Associations has consulted some advocates to file a
case for Pension Revision of pension of BSNL/MTNL pensioners
and now decided to file the court case at the earliest.
On the issue of CGHS contribution
payments, GS apprised that it was the only efforts of
AIRBSNLEWA to get released the payments. He requested for
arranging a meeting to welcome the new members at the
earliest.

with DDG (Estt.) DoT:-

Kumar, GS AIBSNLEA and Comrade M K Bagchi, President RTWOA
MTNL met DDG (Estt.) DoT today (7th Feb) and discussed
regarding
(a) First-time bound promotion after 5 years of service
under EPP: We requested DDG (Estt.)
DoT to issue clarification to CCA Kolkatta regarding
first-time bound promotion after years of service after 5
years of service under EPP. DDG (Estt.) DoT mentioned
that a letter has been sent to CCA Kolkatta seeking some
clarification and on receiving the reply necessary
instructions will be issued to CCA Kolkatta in this regard.
He assured an early action in this regard.
(b) Withdrawal of Additional increment in the same scale
twice on time bound promotion and on functional promotion.
DDG (Estt.) DoT informed that court case in the
Hon'ble High Court Delhi is coming for hearing on 10th
February 2020 and after the judgement only necessary action
will be taken. AIBSNLEA has filed the contempt petition in
this regard. |
07.02.2020: Meeting
with Member (Finance) DoT:

discussed with Member (Finance) DoT today 7th February.....
a) Regarding first-time bound promotion after 5 years of
service under EPP : Member
(Finance) immediately spoke with CCA Kolkatta and directed
him to resolve the issue immediately.
(b) Payment of salary to the BSNL and MTNL employees:
Member (Finance) informed that one month salary i.e.
December 2019 will be paid before 15th Feburary 2020 to BSNL
employees but for MTNL he was non committal.
(c) Ex gratia payment to VRS optees:
Member (Finance) informed that half amount of Ex gratia will
be paid before 31st March 2020 to BSNL VRS optees. GPF
payments are being made. |

A welcome meeting for all VRS optee Executive's of Calcutta
Telephones, West Bengal Circle, ETR, ETP, Telecom factory by
W.B.Circle AIRBSNLEWA today.
Circle President Shri Dhananjay Biswas presided over the
meeting and gave briefing regarding our associational
activities.
C.H.Q. Organising Secretary Shri Prasun Mukherjee &
C.H.Q.Vice President Sri Manas Roy informed our associations
organisational activities in detail such as how we repealed
the 60:40 clause of pension formula by which our pension is
secured today. Both of the leaders requested all attending
VRS executives to become member of this Association.
Circle Secretary, WB Circle presented a brief description
about formation of our circle body with 7 members ten years
ago and our journey till date having 1200 members and still
growing having full confidence of the members as we are
working towards pension revision and medical benefit issues
earnestly.
Then C.H.Q.President of AIBSNLEA Shri Subhasish Mitra kindly
addressed the house bringing in notice how on compulsion VRS
to be accepted by BSNL employees and apprehending further
risky journey for BSNL in future.
As everybody was eager to hear from CHQ Deputy G.S. Sri Amit
Gupta, he discussed in detail the present scenario of BSNL
and future of BSNL VRS retirees as well as the steps we are
going to take for Court Proceedings for our pension revision
along with VRS optee's by 7th. C.P.C. He also gave a
suggestion for opting for CGHS Medical Scheme as BSNL MRS is
becoming insecure due to paucity of fund allotment. He
clarified regarding apprehensions raised by attending VRS
optees in detail in question, answer session afterwards.
It is heartening that around 159 VRS optee executive's
attended the meeting and 79 responded by taking membership
there itself, another 50 attending optees took Admission
form to be filled and submitted later as assured by them.
Circle Secretary, WB Circle gave a vote of thanks to
all attending optee executive's assuring them that this
Association is their own association and we will fight for
all their claims .
The meeting lasted for about 4 hours, during which their was
pin drop silence in the hall and all were very attentive,
which exhibits their mental agony about future.

G. B. MEETING at Nasik on 05.02.2020:

The G. B. Meeting of our Nashik branch was held on
05.02.2020 at 11.00 hrs in Samarth Banquet Hall, Canada
corner, Nashik under the president ship of Shri Y. E.
Saindane. The meeting was started with welcome of members
especially new members by giving flowers. Shri B. P.
Kulkarni was felicitated with bukey , shawl and book for
completion of 75 years of his age.
Shri S. S. Dhangar circle
organiser elaborated the importance of association and
opening of new CGHS wellness centre at Nashik. Shri V. P.
Kulkarni, Ex CS MH told the house regarding present bsnl
situation and appealed new members for enrollment of
membership. Shri M. L. Deore, DS explained the house the
necessity of legal action for pension revision and the
present position of pension arrears case. Total 120 members
attended the meeting. And 40 new members enrolled their
membership in the meeting Shri P. B. Vispute , Shri D. N.
Gharde , Shri S. N. Sonawane , Shri K. A. Baviskar , Shri N.
B. Patole, Shri S. D. kale , Shri G. B. Jorvekar , Shri D.
G. Ghate , Shri R. N. Dixit , Shri P. C. Nemade , Shri S. M.
Shaikh. took active part for the grand success of the
meeting. Remaining VRS optees will be contacted for
enrolment of membership.

Status of Court Case regarding 78.2% fitment arrear payments
w.e.f. 01.01.2007 instead of June'2013 to BSNL Pensioners:
The captioned matter was listed before
Hon'ble High Court on 24.01.2020 before a bench comprising
of Hon'ble Justice G.S. Sistani and Hon'ble Justice Anup
Jairam Bhambani in Court No. 37 as Item No. 4.
Mr. Rajshekhar Rao appeared on behalf of the Petitioner,
instructed by me. Counsel for the Respondents were also
present.
Mr. Rajshekhar Rao appeared on behalf of the Petitioners,
and apprised the Hon'ble Court at the outset, that the other
Petition at Item 3, although was filed against the same
Impugned Order, but the grounds raised therein were entirely
different and in fact, even the relief sought was different.
The Counsel appearing for the Petitioners in the other
appeal agreed to the aforementioned submission advanced by
Mr. Rao.
After hearing the submissions briefly, the Hon'ble Court was
pleased to issue notice in the matter returnable for
11.03.2020, with liberty to the Respondents to file a
response. |

item no 4. Our advocate pleaded for delinking of our case

24.01.2020:
Meeting with CMD BSNL:
Comrade GS Prahlad Rai along with Comrade Kishan Singh Ji,
CHQ President met CMD BSNL Shri Purwar Ji and discussed
regarding
(a) Reimbursement of CGHS
contribution paid by BSNL pensioners as one time measure in
lieu of BSNL MRS : we
extended our sincere thanks to CMD BSNL for the
reimbursement of CGHS contribution to BSNL pensioners and
requested him to release funds for the settlement of pending
medical claims also. We also apprised about the difficulty
being faced in uploading pending medical claims ERP incurred
prior to opting CGHS. Also apprised CMD BSNL regarding wrong
deductions of Income Tax 30% from CGHS contribution
reimbursement claims and not settling these claims with
November 2020 salary by GM(Finance) NTR.
After detailed discussions
CMD appreciated our concern and assured that all the CGHS
contribution payments will be immediately paid by BSNL. He
immediately spoke with CGM NTR and directed him to resolve
the issue immediately. Regarding other issues of Kolkatta
circle non reimbursement etc, he advised us to give him in
writing for necessary action. |
24.01.2020:
Meeting with Director
(Finance) BSNL:
Comrade GS and President met Shri S.K. Gupta Ji,
Director(Finance), BSNL Board and discussed regarding non
reimbursement of CGHS contribution in CGM NTR and CGMT
Kolkatta Circles on one or the other pretexts. We requested
him for his kind intervention and direct these Circles for
immediate reimbursement of CGHS contribution paid by BSNL
pensioners as one time measure in lieu of BSNL MRS as
assured by CMD BSNL. Director (Finance) assured to look into
the matter and early settlement of the issue. |
24.01.2020:
Meeting with PGM(Pers), BSNL
CO: Comrade GS and
President met PGM(Pers) and discussed regarding
implementation of the Hon'ble Supreme court judgment on
judgment delivered on14-12-2016 on implementation of Rule206
for TES Group B officers seniority fixation. PGM(Pers)
mentioned that a committee has been formed to ensure
implementation of the Hon'ble Supreme court judgment after
31-01-2020. He further mentioned that implementation will
take place as per the advice given by ASG.
It is understood that Pers
Cell is holding review CPCs on year to year basis vacancies
wherein reversion of juniors will take place as per the
Rule206 seniority fixation thus the seniors can't claim
benefits wrt their juniors ie retrospective promotions, pay
upgradation, and other pensionery consequential benefits. He
further mentioned that in manner the Hon'ble Supreme court
judgment on judgment is being implemented to avoid contempt
of court case. |
23.01.2020:
Meeting with DDG(Estt) DoT:-
Comrade GS Prahlad Rai along with
Comrade M K Bagchi, President RTWOA(MTNL) met DDG(Estt) DoT
and discussed regarding
(a) Revision
of pension of BSNL pensioners:
DDG(Estt) clearly mentioned
that after the reply given by Hon'ble MOC in the parliament
on this issue further no action is being taken by DOT. DoT
stand is very clear that pension revision of BSNL and MTNL
pensioners can take place after the pay revision of BSNL
employees. Thus in this situation the legal action is the
only way to get resolved the issue. AIRBSNLEWA along with
other Associations has taken the legal opinion and feels
that its a fit case for legal action.
AIRBSNLEWA has prepared a
draft and has circulated to to all the like minded
associations to have the common approach and most of them
have appreciated our draft and has also given their
suggestions for its finalization. AIRBSNLEWA along with some
like minded associations will shortly file the court case in
this regard.
(b) First-time bound
promotion after 5 years of service under EPP instead of
6years of service who touch minimum of the pay scale of next
pay scale: CCA
Kolkatta has raised objections and made recovery of BSNL
pensioners. We requested DDG(Estt) to issue clarification to
CCA Kolkatta in this regard. DDG Esst informed that the
matter is under consideration in DOT and shortly reply will
be given to CCA Kolkatta. He wanted to have some more
discussions with us on the provision of the EPP which we
will shortly discuss. |

"B" officers absorbed in BSNL, who have opted for IDA pay
scale from the date of promotion after 01.10.2000

Marvelous General Body
meeting of UP (East) Circle :
A well organized General Body Meeting of “ALL INDIA RETIRED
BSNL EXECUTIVES' WELFARE ASSOCIATION” UP(East) Circle was
held on the 4th of January 2020 (Saturday) at "India Awadh
Hotel" Hazratganj, Lucknow.
More than a hundred esteemed BSNL pensioners from Lucknow
district attended our meeting which lasted for more than 4
hours. The meeting started with opening remarks of Com
S.M.Abbas (Circle President) and where he warmly welcomed
all members of the association. Com Pallab Bose (Circle
Secretary) then apprised the members regarding the present
day situation of BSNL. He furthermore asked members to
recruit more incoming incoming VRS executives. The members
were instructed to talk about the Association to at-least
two new VRS executives each.
Members are encouraged to talk about the sincere efforts
undertaken by AIRBSNLEWA regarding crucial and important
issues like - the 60:40 pension sharing with BSNL, and 78.2%
IDA merger issues of retired executives of BSNL at CHQ
level.
He reminded the members that the only association to
initially raise the 60:40 pension sharing issues was
AIRBSNLEWA. He also mentioned that today, many associations
are falsely claiming credit for achieving the things that
our associations accomplished over the past few years. After
the continuous and combined struggle of AIBSNLEA and
AIRBSNLEWA, the 60:40 sharing provision from pension rule
was withdrawn. This ruling has strengthened the way for
future pension revision of BSNL Pensioners.
Com Bose (AGS/CS) conveyed his sincere thanks to Com Prahlad
Rai, GS AIRBSNLEWA, Com Amit Gupta Dy GS, Com Kishan Singh
CHQ President for their endless efforts for Pension revision

Meeting was also addressed by the following honorable

Four new members joined our association in this meeting. The
General body meeting ended with a vote of thanks by Circle
President.
In the second session a workshop on “Customer
Financial Awareness”
was conducted by ICICI Securities & HDFC Mutual Fund. Most
pensioners actively participated. An interactive session
with ICICI Financial experts followed where doubts raised by
our pensioners regarding safe investment and Income tax were
answered. At the end of session - all members of AIRBSNLEWA
UP(E) were served Snacks & Tea.

11.01.2020:
Reimbursement of CGHS
contribution to BSNL pensioners:
As per the assurance given by
CMD BSNL to Comrade GS, AIRBSNLEWA Com. Prahlad Rai on
reimbursement of CGHS contribution to BSNL pensioners now
have been reimbursed in all the Circles in along with the
salary payment of November 2019 to all the eligible CGHS
beneficiaries. However in some Circles it has not been
reimbursed as reported by the concern Circle Secretaries to
CHQ. Comrade GS Com. Prahlad Rai immediately spoken with
Shri Bhatt, Sr. GM (Budget) BSNL CO and requested to issue
necessary instructions to all the Circles for reimbursement.
Sr. GM (Budget) inform that Rs 370 Crores have been released
to all the Circles to reimburse the pending claims of CGHS
contribution paid by BSNL pensioners as one time measure. In
case circles IFA want any clarification they can directly
contact him. The concern Circle Secretaries may meet the
IFAs immediately in this regard. |
10.01.2020:
Report of activity by CS West
Bengal and his team in view of huge retirement on 31st
January 2020.

With a request letter for preparation of pending list of
medical claims of pensioners a team comprising of myself,
Prosun Ghosh, K C Samadder, Debobroto Roy and Biswajeet Guha
have done organisational activities as under--------
1.Met Dr.Biswajit Pal C.G.M. CTD at his chamber
and discussed in detail
regarding preparation of medical list for pensioners as per
our letter . CGM was kind enough to give us a patient
hearing and called D.E. Healthcare and issued instructions
to comply with preparation of list as per our letter
immediately in all three categories. Also discussed issue of
pensioners of EZBC merged with CTD. CGM issued instructions
to CAO to forward all the cases to CGM W.B.Circle for final
settlement.
2. Then we met Shri Gautam Guha CGM ETR on
same issues and submitted our representation. He assured
that nothing much is pending for pensioners and he will
instruct to do needful for all pending cases at the
earliest.
3.Submitted the same subject letter at the office of Shri
Ramakant Sharma CGM West Bengal Telecom Circle
as he was not available but met GM HR & Admin. and discussed
on the issue and submitted the letter for necessary action.
Then we made an enquiry in the section and found action on
reimbursement claims for CGHS deposit has already started
and 17 cases for reimbursement has been sanctioned and
processed and ready for posting in ERP.
4.Met G.M.Sri Deb of Calcutta SSA WBTC and discussed
the above issues with him and he assured necessary action
will be taken at the earliest.
5. A letter on subject overcrowding in the counters for
enrollment at CGHS
Headquarter Kolkata was submitted at the office of
Additional Director, Kolkata CGHS .Esplanade East.
Explaining a large number of VRS optees will be crowding
daily for CGHS. Also a copy of our booklet on CGHS was also
presented to him to show our activity on this subject. We
also requested for an appointment to discuss various CGHS
related issues.

at Bardhaman West Bengal:

In the 5th January meeting at Bardhaman Retired Executives
and vrs opted Executives to be retire on 31.01.2020
assembled in Bardhaman Telephone office Ground floor in
large number. State President Com.Dhananjay Biswas preside
over the meeting assisted by Sr. Member of Asansol Com.Y L
Karna. Mihir Chanda on behalf of Bardhaman unit welcome the
State Body members and Veterans Leader Com.Amit Gupta
Dy.General Secretary, Com Prasun Mukhopadhyay OS, and Com
Prasun Ghosh Advisor from CHQ and other leaders from Circle
with Flowers. Meeting started with the Self introduction of
the members present in the meeting. Com Dhananjay Biswas and
State Secretary Com. Sitangshu Sarkar in their celebration
presented the status of Pension revision and medical
payments. Role of AIRBSNLEWA also focused in their speeches.
Prasun Mukhopadhya Organising Secretary East briefly
narrated how the Authority is non committal for pension
revision. He also mentioned for the necessity of TAKING a
APOLITICAL STAND for the welfare of pensioner. The prime
attraction was the deleberation presented by AMIT Gupta,
Dy.General Secretary CHQ New Delhi. In his speech he
elaborately stated the history and Development of Pension
Status and why the Association decided to File the court
case for Pension Revision in the interest of All Bsnl
Pensioners. We Have only one identity I.e. PENSIONER . Now
time has come for the Demand of Pension revision in
accordance with 7th cpc. where most of the recommendation
are implemented except two major recommendation I.e.
Revision of pension and minimum pension of ₹9000 which are
simply over looked. He call for the unity of the Bsnl
pensioner. After Lunch Break members participated in the 40
minutes Question Answer session and the Leadership
interacted with this. Numbers of Non executives also
gathered to listen the deleberation of the Dignitaries and
cooperate with the organizers. In the vote of thanks Com.
Mihir Chanda of Bardhaman expressed gratitude to the State
Leadership and also Dy.GS for attaining the meeting and
motivation given by them. Constraint for coming from Kolkata
overlooking the self assignment and physical problem at this
age. The meeting end with the formation of a steering
Committee which will conduct a conference for opening of
Bardhaman Branch comprising Bardhaman, Durgapur and Asansol
pensioners shortly.

WP 13202/2019 Appeal to Delhi High
Court on Pension Arrear issue:
Our appeal against the
Judgement of PCAT on pension arrear 1st case (OA2260/2017)
came up for hearing today. The WP of other association
12231/2019 whose OA was tagged with our OA in PCAT, has
also already been filed in Delhi HC for which next date of
hearing is already scheduled on 24th Jan 2020. Following
is the report from our Advocate on Record regarding
today's proceedings._
The captioned matter was
listed today as Item No. 34 in Court No. 37 before Hon'ble
Justice G.S. Sistani and Hon'ble Justice Anup Jairam
Bhambani at the Delhi High Court.
Mr. Rajshekhar Rao
appeared on behalf of the Petitioners instructed by me.
Mr. Rao submitted that the Hon'ble Court was already
apprised of another matter which had challenged the same
Impugned Order passed by the Hon'ble Tribunal, Principal
Bench, and was listed on 24.01.2020. Thereafter, Mr. Rao
pointed out that the grounds taken by the Petitioners in
that Writ Petition were different than the ones sought to
be raised in the present Petition, which fact was also
noted by the Hon'ble Tribunal in its Impugned Order, but
had proceeded to tag them since both OAs challenged the
same Orders passed by the DOT & BSNL. Mr. Rao further
pointed out that no notice was issued in the other Writ
Petition.
However, the Hon'ble
Bench was of the view since the challenge has been made to
the same Impugned Order, both the matters should be listed
on the same day. The matter therefore stands adjourned to
24.01.2020.
Please note, that no
notice has been issued in the matters and on the next date
of hearing, the difference in the matters can be pointed
out. But since the matter in CAT whereby both the OAs had
been clubbed together was not challenged, it is difficult
to adopt that position at this juncture and would be
argued when the matters are taken up for hearing.

Dear Comrade,
Greetings from AIBDPA.
I am writing this as per the decision of Central Executive
Committee Meeting of All India BSNL DOT Pensioners
Association held at Guwahati on 24-25, November, 2019.
Our CEC has unanimously decided against seeking legal remedy
for Pension Revision of BSNL retirees at present, as we feel
that it should be the last option. Further, it is our
considered opinion that the government has at no point
rejected the demand and we should wait for the post VRS
scenario.
Meanwhile, the CEC has decided to wage the following phased
programme of agitation to exert pressure on the government,
for which we are seeking the cooperation of all the
important pensioners organizations to make it a joint
struggle. The proposals are subject to modifications, to
consider the opinions of all the oraganisations.
1. Signature campaign in the memorandum addressed to the
Prime Minister seeking his intervention for Pension Revision
of BSNL retirees – December,2019.
2. Meeting the Parliament Members , irrespective of their
political affiliation to muster maximum support, by District
wise delegation.—January, 2020
3. Mass Hunger Strike at CCA offices- February, 2020.
4. Parliament March during the Budget Session of Parliament-
March,2020.
It would be better to have a joint meeting of the
organizations to give the final shape of the agitation with
dates of each programme, preferably in the 3rd week of
December,2019. In case, if it is not possible to attend the
meeting, your opinion may please be communicated through
email.

Reimbursement
of CGHS Contribution paid by BSNL Pensioners:
Com. Prahlad Rai, GS AIRBSNLEWA discussed with Sr. GM(Budget),
BSNL Corporate Office, New Delhi regarding reimbursement of
CGHS Contribution paid by BSNL Pensioners as one time
measurement as assured by CMD, BSNL. Sr. GM(Budget) informed
that separate ERP Code has been opened in ERP SAP Module to
book the of CGHS Contribution paid by BSNL Pensioners and
the instructions have been issued to reimburse the CGHS
contribution paid by BSNL Pensioners along with the Nov. 2
019 salary (like other medical claims payment) and
thereafter CGHS contribution will be reimbursed regularly
along with salary payment for new optees. |

“Bijoya
Sanmeloni” Organised by AIRBSNLEWA WB State Circle at
Kolkata on 22.11.2019:
AIRBSNLEWA West Bengal State Circle organized Annual “Bijoya
Sanmeloni” , a traditional get-together after Puja festive
season, Kolkata in CTO Conference Hall. More than 600
members attended the meeting. On this occasion Special G.B
Meeting was organized which was Presided over by Com. D.
Biswas, Circle President, WB Circle, Com. Sitanshu Sarkar,
Circle Secretary AIRBSNLEWA WB Circle welcomes the guests
Com. Manas Roy VP CHQ, Com. Prahlad Rai GS AIRBSNLEWA, Com.
Amit Gupta, Dy. GS, Com. Prasun Ghosh, Advisor(E), Com.
Prasun Mukhopdhyay, OS(East) and Com B Mandal, AGS CHQ and
special gusts were Com. Subhasis Mitra, President AIBSNLEA
CHQ. Com. S. Sivakumar, GS AIBSNLEA and all the members
present in the meeting. He briefed the organizational
activities of AIRBSNLEWA, WB Circle and informed that WB
Circle is having about 1220 members who actively participate
in all the activities of the Association. On the issue of
revision of pension he appraised the present status and
asked the house to take a resolution for taking legal course
of action. He also discussed implementation of Rule-206 of
TES Group-‘B' seniority case, reimbursement of medical
claims etc.
Com. Amit Gupta, Dy. GS in his address explained the status
of pension revision of BSNL pensioners and the issue by
linking with the pay revision of BSNL employees thus he
proposed legal action in this regard. He further explained
the status of pending medical claims, CGHS medical facility
option etc. He appreciated the activities of AIRBSNLEWA WB
State body and requested to Circle Office bearers to enroll
new members who are opting VRS.
Com. Prahlad Rai, General Secretary, AIRBSNLEWA in his
address extended sincere thanks to AIRBSNLEWA WB Circle for
inviting him and welcoming in the meeting. In his address he
explained the efforts of AIRBSNLEWA in getting withdrawal of
the 60:40 provision from 37A pension rule in the 2016 at
that time of 78.2% fitment benefit provided to BSNL
pensioners. He also appraised the efforts taken by
AIRBSNLEWA for getting settled the pension revision of BSNL
pensioners but due to the total negative attitude of DoT
officers in Estt. Cell and Finance Cell the issue is being
dragged on the pretext of non-revision of pay scales of BSNL
employees. He explained the delinking of pension revision
from pay revision with justification. He also opined to take
legal course of actions now since the three years have
passed and in future also DoT is not inclined to resolve the
issue. On the issue of reimbursement of medical claims, he
explained that matter was recently discussed with CMD BSNL
and he assured to immediately clear the CGHS contribution
payment and settlement of the pending bills. Com. GS
explained that due to the delayed action of DoT support to
BSNL this kind of situation has developed. The predatory
pricing in Telecom Sector has created this situation.
However, revival plan has been approved by Govt. wherein VRS
is also one of the important issue and now more than 80000
BSNL and 13000 MTNL employees has exercised option for VRS.
Some queries are being raised regarding pension revision,
3rd PRC implementation, DA increase etc. He explained that
employees retiring through VRS will also get pension under
Rule 37A only like other pensioners retired on
superannuation. Thus they will get the similar treatment. He
appealed all the executives taking VRS to join AIRBSNLEWA on
retirement, AIRBSNLEWA is committed to safeguard the
interest of retired employees. He extended special thanks to
Com. Amit Gupta, Dy.GS and Com. Sintanshu Sarkar, CS WB
Circle AIRBSNLEWA for helping CHQ in day to day work and for
their valuable suggestions. He lastly extended thanks to
AIRBSNLEWA WB Circle and requested Com. GS & President
AIBSNLEA CHQ to take legal action jointly for pension
revision case.
Com. Prasun Mukhapdhyay, OS(East) in his addressed
appreciated the organizational activities of WB Circle and
requested CHQ to file a court case on pension revision which
should also take care of all retired employees including VRS
optees.
Com. S. Sivakumar, GS AIBSNLEA in his address appreciated
the functioning of AIRBSNLEWA CHQ functioning and assured to
extend fullest support to AIRBSNLEWA to strengthen it. He
also gave his consent to file a legal court case on the
issue of pension revision alongwith AIRBSNLEWA.
Com. Subhasis Mitra, President CHQ AIBSNLEA also assured
fullest cooperation & support to AIRBSNLEWA at all the
levels.
Lastly vote of thanks was extended by Com Sudipta
Gangopadhyay.
On this “Bijoya Sanmeloni” occasion a colourful and
glittering cultural programme was also organized nicely.

Meeting
with CMD BSNL
:Com Prahlad Rai, GS AIRBSNLEWA met CMD BSNL Shri Purwar Ji
and discussed regarding:
(a)
Delay in the reimbursement of CGHS contribution paid
by BSNL pensioners as one time measure in lieu of BSNL MRS
and the settlement of pending medical claims of BSNL
pensioners.
He requested for early settlement of pending CGHS
contribution and medical claims of BSNL pensioners.
AIRBSNLEWA letter dated 13th Nov on this issue was given him
by hand on which itself CMD BSNL directed Sr. GM (Budget)
and GM(CA) for opening a new account code for the entry of
CGHS contribution paid by BSNL pensioners immediately. Also
directed them to collect the information from Circles of
pending CGHS contribution claims and to provide funds for
the settlement. He also assured for the settlement of
pending medical claims. We further explained that in ERP,
feeding of Medical claims of BSNL pensioners has been
restricted which needs to be opened. CMD BSNL assured to
look into the matter.
(b) Revision of pension of BSNL pensioners:
We apprised CMD BSNL regarding our discussions held
yesterday with Secretary (Telecom) on revision of pension of
BSNL pensioners and revival of BSNL and requested him to use
his good office in helping BSNL pensioners for their pension
revision by delinking from pay revision. CMD assured that he
will certainly discuss the matter with Secy(Telecom) after
31-01-2020.Also mentioned that the VRS package is an
attractive one which is beneficial to the employees as well
as to the BSNL and MTNL. |
19.11.2019:
Meeting with Director (Estt) DoT Shri
Sanjay Agarwal Ji: Com Prahlad
Rai GS AIRBSNLEWA met Director (Estt) DoT and discussed
regarding
(a) Revision of pension of BSNL pensioners and enquired
about the DoT reply to DoP&W letter dated 19-3-19.
Director (Estt) further mentioned that
Estt cell stand is very clear that when the pay scales of
BSNL employees will be revised, the pension of BSNL
pensioners will also be revised. Otherwise the anomaly will
arise e.g. the pre-retired pensioners before 1-1-2017 will
get more pension then the post retiring employees after
1-1-2017 whose pay is not revised. We pleaded to settle the
issue through anomaly committee instead of dragging the
issue. But Director (Estt) is firm to his opinion. He
clearly told that in case higher ups takes the decision for
delinking of pension revision from pay revision, Estt cell
will start working on this issue. Regarding reply to DoP&W
letter, he informed that the reply was given to DoP&W and
now DoP&W has suggested to settle the issue at DoT level
only but avoiding anomaly situation. He advised that
everyone should try that BSNL is turn around and it's
balance sheet becomes positive to consider pay revision.
Thus we can't expect any solution from DoT Establishment
cell at present.
(b) Clarification on first-time bound promotion after 5
years years of service under EPP to CCA Kolkatta.
Director (Esst) informed that the reply given by BSNL on
this issue is under consideration and shortly clarification
will be sent to CCA Kolkatta. We expect the clarification
from DoT will be in the same line of BSNL letter.
(c) Family pension case of Km B Usha of Telangana circle
given by our HTD District President Com Shivaramadu.
Director (Estt) informed that he found
that it's a genuine case hence he has forwarded to Director
(PF) DoT Mr Bhaskaran for necessary action. He advised to
meet with Director(PF) for early settlement of the case.
(d) Withdrawal of Additional increment in the same scale
twice on time bound promotion and after post based
promotion- On implementation of
the Hon'ble High Court Delhi direction. Director( Estt)
mentioned that a meeting was convened between DoT officers
and BSNL officers and now the report has been processed to
the Secy(T) for approval through internal finance of DOT. In
case it is approved the necessary direction will be issued
otherwise on the basis of the Hon'ble High Court Delhi
direction further action will be taken. The next hearing
date is 10th February, 2020 . |

AIRBSNLEWA meeting wit Secy(T), DoT Sh. Anshu Prakesh ji:
On the request of GS AIRBSNLEWA, Secy(T), DoT Shri Anshu
Prakash ji granted a meeting today to AIRBSNLEWA at 17:30
hours which was attended by Comrade Prahlad Rai GS, Comrade
Kishan Singh Ji President CHQ, Comrade A.K. Madan, Advisor
AIRBSNLEWA Delhi Circle and Com. K.M.Goyal, FS, AIRBSNLEWA
Delhi Circle. In the beginning of the meeting we
welcomed/ felicitated Shri Anshu Prakash ji for resuming the
high prestigious post of the Secretary (T), DoT by
presenting bouquet & shawl.

We drew his kind attention towards the long pending issue of
BSNL pensioners for their pension revision by submitting our
